Editor's Note: This power of the municipality to adopt ordinances concerning traffic and parking is contained in N.J.S.A. 39:4-197. Various statutory provisions throughout Title 39 control the manner in which municipalities may regulate parking and traffic. N.J.S.A. 39:4-8 requires that all traffic and parking ordinances be approved by the Motor Vehicle Commission.

The purpose of this chapter is to regulate parking in locations established as parking meter areas in accordance with the terms of an agreement between the Borough of Point Pleasant Beach and the Parking Authority of the Borough of Point Pleasant Beach dated November 25, 1958.

The locations described in Schedule A attached to and made part of this chapter are designated as parking meter zones. No vehicle shall be parked in any of the locations described in the schedule on the days and during the hours indicated in the schedule without payment of the fee set forth in the schedule and otherwise complying with the provisions of this chapter.[1]

In areas designated as parking meter zones, the parking authority or the appropriate department of the Borough of Point Pleasant Beach as designated by the Mayor and Council shall outline with clearly visible markings individual parking meter spaces, adjoining each of which shall be erected a parking meter which, upon deposit of the required fee, will indicate the duration of the legal parking period and will also indicate when that parking period has expired. The maximum legal parking time and the hours and days during which payment of a fee is required in order to park shall be indicated either by appropriate signs installed in the parking lot or by a legend on the parking meter itself. No meters shall be installed in areas where parking is prohibited under N.J.S.A. 39:4-138.
In areas where multi-space parking meter terminals are in use, there shall be a centrally located terminal which will indicate the maximum legal parking time and the hours and days during which payment of a fee is required.

In areas designated as pay station parking zones, the parking authority or the appropriate department of the Borough of Point Pleasant Beach as designated by the Mayor and Council shall outline with clearly visible markings individual parking spaces, which shall each have a pay station located nearby for the payment of parking fees and the dispensing of tickets that indicate the duration of the purchased legal parking period and the expiration of that period. The hours and days during which payment of a fee is required in order to park and the cost of parking shall be indicated by appropriate signs installed in the parking lot or along the appropriate roadway.

No vehicle parked in an area designated as a parking zone shall be parked other than in a space indicated as a parking space. The vehicle shall be parked wholly within the lines indicating that particular parking space.

No person shall cause a vehicle to be parked or remain in a parking space when the meter or pay ticket indicates that the time for parking has expired, except as provided in § 9-14 (Residential Parking Program).
No person shall park a vehicle in any parking space with a coin-operated meter during the time that payment of a fee is required without depositing one or more coins representing the required fee in the meter adjoining the space and turning the lever to cause the parking meter to operate, except as provided in § 9-14 (Residential Parking Program). Fees may be paid in coins of any denomination that the meter will accept, but no person shall deposit into a parking meter anything other than lawful coins of the United States of America. No person shall deposit additional coins in a parking meter for the purpose of extending the time of a vehicle beyond the maximum legal parking time.
No person shall park a vehicle in any parking space that is located in a designated pay machine lot or space without purchasing a pay ticket from a pay machine, except as provided in § 9-14 (Residential Parking Program). A pay ticket shall be purchased for a minimum of one-hour parking and for a maximum of 24 hours.
Coins deposited in meters operated by the Parking Authority of the Borough of Point Pleasant Beach shall be collected by a member of the Police Department or parking meter maintenance men of the Borough of Point Pleasant Beach and turned over to the Treasurer of the Borough of Point Pleasant Beach for deposit in the proper account. Amortization and division of fees shall be made in accordance with resolutions passed by the Mayor and Council of the Borough of Point Pleasant Beach.
This chapter shall be enforced by the police Department and/or Parking Enforcement Officer of the Borough of Point Pleasant Beach.
Whenever the governing body of the Borough of Point Pleasant Beach or the parking authority shall designate certain parking spaces, including those designated in Schedule XXI of Chapter 9A, as handicapped parking pursuant to N.J.S.A. 39:4-197.5, it shall be unlawful for any person to so park in said space, unless the vehicle which they are driving is a special vehicle pursuant to N.J.S.A. 39:4-205. In the event anyone violates the provisions of this section and a penalty is not provided for by statute, then the penalty shall be in accordance with § 3-15 of Chapter 3 of the Revised General Ordinances of the Borough of Point Pleasant Beach.
In addition to the enforcement provisions set forth in § 10-5 of the Code of the Borough of Point Pleasant Beach, the Borough Code Enforcement Department and its various officers and employees are hereby designated as enforcement personnel in connection with handicapped parking violations.

Any person who violates any one or more subsections of this chapter shall be subject to the penalties imposed by § 3-15 of Chapter 3.
