A. 
Word usage.
(1) 
Words used in the present tense include the future; the singular number includes the plural and the plural the singular. The word "shall" is always mandatory. The word "lot" includes the word "plot." The word "building" includes the word "structure." The term "such as," where used herein, shall be considered as introducing a typical or illustrative, rather than an entirely exclusive or inclusive, designation of permitted or prohibited uses, activities, establishments or structures. The words "zone" and "district" are synonymous.
(2) 
Any word or term not defined herein shall be used with a meaning of standard usage for the context in which the word is used or shall be defined in the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.).
B. 
For the purposes of this chapter, the following terms shall have the meanings indicated:
ACCESSORY USE
A use naturally and normally incidental and subordinate to a principal use on the same premises.
ACCESSORY, IMPROVEMENT, OR STRUCTURE
A subordinate building, improvement, or structure on the same premises with a main building, occupied or devoted to an accessory use. Where an "accessory building" is attached to a main building in a substantial manner by a wall or roof, such "accessory building" shall be considered part of the main building.
ACRE
An area of land, which includes 43,560 square feet.
ADAPTIVE REUSE
The creation of a different use for an existing building.
ADULT DAY CARE CENTER
A nonresidential facility in which adults are provided with supervision and assisted care.
ADULT USE
An establishment offering primarily entertainment, products or activities of a sexual nature and intended for consumption by adults.
AFFORDABLE HOUSING
Housing with a sales price or rent within the means of a household meeting the NJ Council on Affordable Housing (COAH) standards for low and moderate income, where the instrument or subsidy required to sustain such pricing will remain in effect for the minimum period required for eligibility as affordable, pursuant to COAH regulations.
AIR RIGHTS
The interest in the use of the space above the land or above structures or improvements affixed to the land.
AISLE
The traveled way by which cars enter and depart parking spaces.
ALLEY
A minor way, which is used primarily for vehicular access to the back or the side of properties otherwise abutting a street.
ALTERATION OF BUILDING
Any change in the supporting members of a building, such as bearing wall columns, beams, girders and interior partitions, as well as any changes in the size or location of doors or windows or any addition to or diminution of a building.
AMUSEMENT CENTER
An establishment, place or location whose primary use is the operation of amusement or mechanical device machines.
AMUSEMENT OR MECHANICAL DEVICE MACHINES
Any coin operated machine, apparatus, contrivance, appliance or device which may be operated or played upon the placing or depositing of any coin, check, slug, ball or any other article or device or by the paying thereof, either in advance of or after use, and operated by the public for use as a game, entertainment or amusement, the object of which is to achieve either a high or low score, which by comparison to the score of other players, whether playing concurrently or not, demonstrates relative skill or competence or indicates in any other way competitive advantage of one player over another, regardless of skill or competence. This shall include devices, such as marble machines, skill ball, pinball, mechanical grab machines, machines or contrivances commonly known as "bagatelle," "baseball," "football," "hockey," "pool table," "target shooting," "shuffle board" or "shuffle alley," "electronic video games," "miniature bowling machines" or any similarly named device or any device which utilizes an electronic display to reproduce symbolic figures and lines intended to be representative of real game activities; which machines or devices are operated, maintained or used in any public or quasi-public place or in any building, store or other place wherein the public is invited or wherein the public may enter, which provides no free play, no prizes or return of any money. Specifically excluded shall be any device, whether operated by coin or not, which merely provides a ride, sensation, electronic reading or weight for use by and to the amusement of the public or dispensing or vending of merchandising or music or any mechanical or amusement device which is otherwise the subject of regulation and licensure in the Code of the City of Orange Township.
APARTMENT
One or more dwelling rooms, with private bath and kitchen facilities, comprising an independe self-contained dwelling unit within a larger building.
APARTMENT HOTEL
A facility offering transient lodging accommodation to the general public and where rooms or suites may include kitchen facilities and sitting rooms in addition to the bedroom.
APPLICANT
A developer submitting an application for development.
APPLICATION FOR DEVELOPMENT
The application form and all accompanying documents required by ordinance for approval of a subdivision plot, site plan, conditional use, zoning variance or direction of the issuance of a permit pursuant to Section 25, Chapter 291 (N.J.S.A. 40:55D-34) or Section 27, Chapter 291 (N.J.S.A. 40:55D-36).
APPROVED COMBUSTIBLE MATERIAL
Wood or materials not more combustible than wood and approved plastics.
APPROVED PLASTICS
Only those slow burning plastics, such as cellulose acetate or methyl methacrylate or other plastics of no greater combustibility, as now approved by the Underwriter's Laboratories, Inc., for sign use.
ARCADE
An area contiguous to a street or plaza that is open and unobstructed to a height of not less than 12 feet and that is accessible to the public at all times. Any portion of an arcade occupied by building columns, landscaping, statuary, pools, or fountains shall be considered part of the arcade for the purpose of computing a floor-area premium credit. The term "arcade" shall not include off-street loading areas, driveways, off-street parking areas, or open pedestrian walkways. The floor of any arcade shall be level with the adjoining street or plaza.
ARCADE, AMUSEMENT
Any electric or electronic machine (e.g., pinball, video games) which provides amusement, enjoyment, or entertainment and which may be operated upon the insertion of a coin or token. This term shall not include juke boxes, children's mechanical rides (e.g., horses, rocket ships), or machines that sell merchandise. A place or facility where pinball or other similar electronic games are played for amusement only. Shall not be construed so as to include bingo games nor shall it be construed so as to include gambling devices or any other devices prohibited by law.
ARCHITECTURAL FEATURES
A part, portion, or projection that contributes to the beauty or elegance of a building or structure, exclusive of signs, that is not necessary for the structural integrity of the building or structure or to make said building or structure habitable. Architectural features of a building shall include cornices, eaves, gutters, belt courses, sills, lintels, bay windows, chimneys, and decorative ornaments.
ARTISANAL MANUFACTURING
A production process characterized by minimal automation, little division of labor, and a small number of highly skilled craftsman as opposed to a larger, less-trained traditional workforce. Participants in an artisan process may be self-employed, or employed by a smaller-scale business.
ASSISTED LIVING FACILITY
Services in these establishments include assistance with daily activities, such as dressing, grooming, bathing, etc. These are also referred to as board and care establishments.
ATTIC
That part of a building that is immediately below and wholly or partly within the roof framing.
AUTOMOBILE BODY REPAIR CENTER
A garage or building used for general repair, rebuilding, or reconditioning of engines, motor vehicles, or trailers, including bodywork, welding, and major painting service. Automobile repair center is a garage or building used for the replacement or repair of any automobile part.
AUTOMOBILE OR TRAILER SALES AREA
An area used for the display, sale or rental of new or used motor vehicles or trailers in operable condition, where no repair work is done.
AUTOMOBILE RECYCLING
See definitions for "junkyard."
AUTOMOBILE SALES USED
The use of land and buildings for the display and sale of primarily used motor vehicles and may include repair and service facilities as well as financing and leasing services.
AUTOMOBILE SALES, NEW
The use of any building, land area, or other premise principally for the display, sale, rental, or lease of new automobiles (but may include light trucks or vans, trailers, or recreation vehicles), and including any vehicle preparation, warranty, or repair work conducted as an accessory use.
AUTOMOBILE SALVAGE
The dismantling or disassembling of used motor vehicles or trailers or the storage, sale or dumping of dismantled, partially dismantled or wrecked vehicles or their parts, as associated with a junkyard.
AUTOMOBILE SERVICE STATION
Any building, land area, or other premises, or portion thereof, used for the retail dispensing or sales of vehicular fuels; servicing and repair of automobiles; and including as an accessory use the sale and installation of lubricants, tires, batteries, and similar vehicle accessories. A car wash is not an accessory use to an automobile service station.
AUTOMOBILE SERVICE STATION WITH QUICK MART
An automobile service station with a convenience goods outlet, as defined herein, located on the same lot and planned, operated, and maintained as an integrated planned development.
AWNING
Any structure made of cloth, plastic, metal or other substance, with a frame attached to a building or other structure and projecting over a public or quasi public right-way, when the same is so erected as to permit it to be raised to a position against the building or structure when not in use.

AWNING, FIXED
Any roof like permanent sloped cover, as of canvas or vinyl, which projects five to six feet off the face of the building and has an eight to ten-inch vertical fascia drop.
BAR
See TAVERN.
BILLBOARD OR SIGNBOARD
Any structure or portion thereof on which lettered, figured or pictorial matter is displayed for advertising purposes, other than the name and occupation of the user of the premises or the nature of the business conducted thereon, or the products sold or manufactured thereon.
BLOCK
The aggregate of private Lots, passages, rear lanes and alleys, the perimeter of which abuts Thoroughfares.
BOARD
Whenever the word "Board" is used, it refers to the Planning Board or Zoning Board of Adjustment of the City of Orange Township, as applicable.

BOARDINGHOUSE OR ROOMING HOUSE
A dwelling having one kitchen and used for the purpose of providing meals or lodging, or both meals and lodging for pay or compensation of any kind to more than one person other than members of the family occupying such a dwelling.
BREAD AND BREAKFAST
A group of lodging units not to exceed 10 units that may provide services for dining, meeting and recreation.
BUFFER
A strip of land containing planted screening materials and/or fencing used to physically separate and screen one use or property from another so as to minimize adverse impacts.
BUILDING
A combination of materials forming a construction adapted to permanent, temporary or continuous occupancy and having a roof, including the following:
(1) 
DETACHEDA building which has no party walls.
(2) 
SEMIDETACHEDA building, which has one party wall in common with an adjacent building.
(3) 
ATTACHEDA building which has two party walls in common with adjacent buildings.
BUILDING AREA
The total areas taken on a horizontal plane at the main grade level of the principal building and all accessory buildings exclusive of steps. All dimensions shall be measured between the exterior faces of walls.
BUILDING COVERAGE
The ratio of the horizontal area of all principal and accessory buildings measured from the exterior surface of the exterior walls of the ground floor on a lot to the total lot area.
BUILDING HEIGHT
The vertical dimensions measured from the average elevation of the finished lot grade at the front of the building to the highest point of the ceiling of the top story of a flat roof, to the deck line of a mansard roof and to the average height between the plate and the ridge of a gable, hip or gambrel roof.
BUILDING LINE
A line parallel to the street line or other lot line, which touches that part of a building closest to the street line or other lot line. In the case of a cantilevered section of a building, the building line will coincide with the most projected surface.
BUILDING, MAIN OR PRIMARY
A building or buildings, which are devoted to the main or principal use of the lot on which said building is situated.
BULK
A term used to indicate, but not limited to, the size, setbacks, and location of building.
BULK REGULATIONS
Standards that control the height, density, intensity and location of structures.
BUS TERMINAL
Any premises for the storage or parking of motor driven buses and the loading and unloading of passengers.
CANOPY
Any self-supporting structure, other than an awning or marquee, made of cloth, plastic, metal or other substance, providing a roof like shelter over a public or quasi-public right-of-way which is permanently affixed to the wall of a building and which shall be construed to be a part of the building to which it is affixed and is subject to all setback requirements applicable to the building to which it is affixed.
CAR WASH
Any building or premises used for washing motor vehicles.
CARRIAGE HOUSE
A structure usually located at the rear of a building lot immediate to an alley. A carriage house is most often a two-story structure. The ground level was used to protect carriages and horses and the attic story was used to store feed. Living quarters were frequently incorporated into the structure for the driver or hired hand.
CERTIFICATE OF OCCUPANCY
A document issued by the Construction Official allowing the occupancy or use of a building or structure and certifying that the building or structure or use has been constructed and/or renovated according to, and in compliance with all the applicable state codes and municipal ordinances and resolutions.
CHANGE OF USE
A change from one type of use to another classification of use in the same zone, or, any removal of a building from one location to another, or, the conversion of any part thereof to another classification of use in the same zone. However, use changes within the same category (i.e. retail-to-retail, warehouse-to-warehouse, office-to-office, restaurant-to-restaurant, etc.) will not be considered a change of use.
CHILD CARE CENTER
A nonresidential facility licensed by the State of New Jersey, Department of Human Services pursuant to P.L. 1983, c. 492 (C.30:5B1 et seq.) for the daytime care of children.
CHURCH
A building or group of buildings designed or intended for public worship. For the purpose of this chapter, the word "church" shall include chapels, congregations, cathedrals, temples and similar designations, as well as rectories, parish houses, convents and such accessory uses.
CIRCULATION
Systems, structures and physical improvements for the movement of people, vehicles, goods, water, air, sewage or power by such means as streets, highways, railroads, waterways, towers, airways, pipes and conduits and the handling of people, vehicles and goods by such means as terminals, stations, warehouses and other storage buildings and transshipment points.
CITY
City of Orange Township, Essex County, New Jersey.
COMMERCIAL RECREATION
A building, group of buildings or outdoor facilities used for recreational purposes and operated as a business and open to the public for a fee, including skating and roller rinks, bowling alley, pool and billiard halls, indoor batting cages, rock climbing, indoor play areas, sports fields, recreation centers, an indoor swimming pools or tennis courts, arcades, events hall, paintball and laser tag.
COMMERCIAL SALES AND SERVICE ESTABLISHMENTS
Activity involving the sale of goods or services carried out for profit.
COMMON FACILITIES
Includes, but are not limited to, those facilities intended for the common use of two or more residential or commercial units within the development, such as roads, parking areas, sidewalks, recreation facilities or open space.
COMMON OWNERSHIP
The ownership of two or more contiguous lots or parcels of real property by one person or by two or more persons owning such property jointly as joint tenants, as tenants by entirety or as tenants in common.
COMMUNITY CENTER
A building used for recreational, social, educational and cultural activities, open to the public or a designated part of the public, usually owned and operated by a public or non-profit group or agency. A community center shall include those facilities with regular operating hours and staff that provide a broad spectrum of health, social, nutritional and educational services and recreational activities. This use shall also include a Senior Center. This use shall not include Child Care Centers, Substance Abuse Treatment Centers, or Private Clubs.
COMMUNITY FACILITY
A noncommercial use established primarily for the benefit and service of the population of the community in which it is located. Shall include schools, transit improvements, police protection, and on-site pedestrian and bicycle facilities in the public right-of-way.
COMMUNITY RESIDENCE FOR THE DEVELOPMENTALLY DISABLED
Any community facility licensed pursuant to P.L. 1977, c. 448 (N.J.S.A. 30:11B1 et seq.) providing food, shelter and personal guidance, under such supervision as required, to not more than 12 developmentally disabled or mentally ill persons who require assistance, temporarily or permanently, in order to live in the community. Community Residence for the developmentally disabled includes, but is not limited to, group homes, half-way houses, intermediate care facilities, and supervised apartment living arrangements.
CONDITIONAL USE
A use permitted in a particular zoning district only upon a showing that such use in a specified location will comply with the conditions and standards for the location or operation of such use, as contained in the Development Regulations Ordinance, and upon the issuance of an authorization therefore by the Planning Board or Zoning Board of Adjustment.
CONSOLIDATION
The changing or moving of any property line, provided that no additional lots are created. "Consolidation" also includes the assembly or annexation of two or more lots into a fewer number of lots than existed prior to the "consolidation."
CONVENIENCE GOODS OUTLET
Any retail establishment offering for purchase primarily packaged foods, household items, magazines and newspapers, and limited prepared foods such as sandwiches and salads, for off-premises consumption.
CONVENIENCE RETAIL
A retail sales establishment offering prepackaged food products, toiletries, household items, tobacco products, newspapers and magazines, flower arrangements, and freshly prepared foods for off-site consumption. Such use includes bodegas. Such uses do not include take-out restaurants, as defined herein, or are other establishment where the primary use is the retail sale of food. Convenience retail establishments shall not include any commercial cooking appliances for heating or cooking food which produce grease vapors, steam, fumes, smoke or odors that are required to be removed through an independent exhaust system. Such appliances include deep fat fryers; upright broilers; griddles; broilers; steam-jacketed kettles; hottop ranges; under-fired broilers (charbroilers); ovens; barbeques; rotisseries; and similar appliances.
COURT
An open, unoccupied space, other than a yard, on the same lot with a principal building. A "court" entirely enclosed by walls or opening on a side lot is an "inner court," while a "court" opening for its full width on a street, front yard, rear yard or side yard is an "outer court."
CPTED
Crime Prevention through Environmental Design.
CULDESAC
A street with a single common ingress and egress with a turnaround at the end.
CURB
The edge of the vehicular pavement detailed as a raised concrete or stone element, or flush with a swale.
DAYS
Calendar days.
DECK
A raised accessory structure more than 1 1/2 feet above finished grade and not covered by a permanent roof.
DECORATIVE TRIM
Moldings, battens, cappings, nailing strips, latticing, platforms and letters, fixtures, characters or representations in cutout or irregular forms which are attached to the sign structure.
DENSITY
The actual number or requested number of dwelling units per gross area of land to be developed.
Detached parking/Detached parking garage
DEVELOPER
The legal or beneficial owner or owners of a lot or of any land intended for a proposed development, including the holder of an option or contract to purchase, or other persons having an enforceable proprietary interest in such land.
DEVELOPMENT
The construction, reconstruction, conversion, structural alteration, relocation or enlargement of any building or structure and any use, or change in the use, of any building or structure of at least 300 square feet, of any excavation or land fill or use of land, or extension of use of land, for which permission may be required pursuant to this chapter.
DEVELOPMENT REGULATION
Any zoning regulation, subdivision regulation, official map or other municipal regulation of the use and development of land or any amendment thereto adopted pursuant to the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.).
DISPLAY SURFACE
The area made available by the sign structure for the purpose of displaying the advertising message.
DRAINAGE
The removal of surface water or groundwater from land by drains, grading or other means and includes control of runoff, to minimize erosion and sedimentation during or after construction or development and means necessary for water supply preservation or prevention or alleviation of flooding.
DRAINAGE RIGHT-OF-WAY
The lands required for the installation of stormwater sewers or required along a natural stream or watercourse for preserving the channel and providing for the flow of water therein to safeguard the public against flood damage, in accordance with Chapter 1 of Title 58 of the Revised Statutes and including lands intended as flood control basins.
DRIVEWAY
A paved or unpaved area used for ingress or egress of vehicles and allowing access from a street to a lot, building or other structure or facility.
DWELLING
A structure or portion thereof that is used exclusively for human habitation.
DWELLING UNIT
A single unit of one or more rooms providing complete, independent living facilities for not more than one family and two boarders and including permanent provisions for living, sleeping, eating, cooking and sanitation for such family.
EASEMENT
The grant of the right to use private land for certain public or quasi-public purposes.
ELECTRIC VEHICLE CHARGING STATION
An electric vehicle charging station is an element in an infrastructure that supplies electric energy for the recharging of plug-in electric vehicles, including electric cars, neighborhood electric vehicles and plug-in hybrids.
EMINENT DOMAIN
The authority of a government to take or to authorize the taking of private property for public use with the intent of providing just compensation.
FACADE
The external vertical surface of a building.
FACADE
The face of any building whether front, rear or either side.
FAMILY
One or more persons living together as a single, nonprofit housekeeping unit, whose relationship is of a permanent and domestic character. The existence of a fraternity, sorority, club, religious order or similar relationship shall not alone be sufficient to qualify as a "family". Also permitted are children placed with a "family" in a dwelling by the Division of Youth and Family Services in the Department of Institutions and Agencies or a duly incorporated child-care agency or children placed pursuant to law in single-family dwellings known as "group homes." As used herein, the term "group home" means and includes any single-family dwelling used in the placement of children pursuant to law recognized as a group home by the Department of Institutions and Agencies in accordance with the rules and regulations adopted by the Commissioner of Institutions and Agencies, provided, however, that no "group home" shall contain more than 12 children.
FAMILY DAY CARE HOME
A home licensed for family day care use pursuant to P.L. 1987, c. 27 (C.30:5B16 et seq.).
FENCE
A barrier intended to prevent escape or intrusion or to mark a boundary.
FENCE LINE
The established line of existing fences on a street, more or less parallel to the curb line. The fence line may be within the public right-of-way.
FENESTRATION
The arrangement of windows and doors on the elevations of a building.
FINAL APPROVAL
The official action of the Planning Board or Zoning Board of Adjustment, as appropriate, taken on a preliminary approved major subdivision or site plan after all conditions, engineering plans and other requirements have been completed or fulfilled and the required improvements have been installed or guaranties properly posted for their completion or approval conditioned upon the posting of such guaranties.
FINAL PLAT
The map or maps of all or a portion of the subdivision which is presented to the Planning Board or Zoning Board of Adjustment for final approval, in accordance with the regulations contained in this chapter, and which, when approved, shall be filed with the proper county recording officer.

FINAL SITE PLAN
The final development plan indicating the final layout of the site, which is submitted to the Secretary of the Planning Board or Zoning Board of Adjustment, as appropriate, for consideration and final approval as meeting the requirements of this chapter.
FINANCIAL INSTITUTION
Any structure wherein business of primarily a monetary nature is transacted, such as banks, savings and loans associations, mortgage companies and similar institutions.
FLOOR AREA
The area of all floors computed by measuring the dimensions of the outside walls in a building, excluding attic and basement floors, porches, patios, terraces, breezeways, carports, verandas and garages.
FLOOR AREA RATIO (FAR)
The sum of the area of all floors of buildings or structures compared to the total area of the site.
FLOOR AREA, GROSS (GFA)
The plan projection of all roofed areas on a lot, whether fixed or temporary, times the number of stories.
FLOORPLATE
The total indoor and outdoor Floor Area of any given Story of a Building, measured to the exterior of the wall or balcony.
FRATERNAL ORGANIZATION
An activity or organization which is incorporated in the State of New Jersey and determined and defined by the Internal Revenue Service as a fraternal organization. The activity or organization shall be open to the general public for a qualified membership and participation in annual or regularly scheduled meetings.
FREESTANDING FASTFOOD RESTAURANT
A public eating place which provides offstreet parking for its customers and employees and which does not abut any other buildings and where prepared food is available upon a short waiting time and is primarily intended for immediate consumption and/or is packaged and presented in a manner, such as disposable containers, so that food can be readily consumed on or off of the premises and where waiter/waitress service is not provided. A "freestanding fast-food restaurant" shall also include a drive-in/drive-through restaurant but shall be considered separate and distinct from a freestanding restaurant, tavern, in-line restaurant and retail food store.
FREESTANDING RESTAURANT
A public eating place which provides off-street parking for its customers and employees and which does not abut any other building and where food is prepared and sold primarily for consumption on the premises and where meals are served by a waiter/waitress staff to seated patrons. An establishment that receives more than 50% of its gross income from the sale of alcoholic beverages is to be classified as a tavern. A "freestanding restaurant" is to be considered separate and distinct from the classification of a freestanding fast-food restaurant, tavern, in-line restaurant and retail food store.
FRONTAGE
The horizontal linear dimension designated as the primary facade of that portion of a building occupied by a single use or occupancy. A corner tenant will be permitted to use the secondary facade to determine the "building frontage".
FUNERAL HOME
A building used for the preparation of the deceased for burial and the display of the deceased and rituals connected therewith before burial or cremation.
GARAGE, PRIVATE
A detached accessory building or a portion of the main building used primarily for the storage of a passenger vehicle or vehicles and not more than one commercial vehicle owned or used by the occupant of the building to which the garage is accessory.
GARAGE, PUBLIC
An enclosed building intended for the storage, servicing or repair of motor vehicles as a business or any facility that is a part of an agency dealing in new or used motor vehicles. A public garage shall not include a car wash or auto dealing facility. Public parking
GOVERNING BODY
The City Council of the City of Orange Township.
GROUND-MOUNTED SOLAR ENERGY SYSTEM
A solar energy system that is directly installed on solar racking systems, which are mounted to an anchor, rigid pole, or other object permanently fixed in the ground and wired to connect to an adjacent building. Erection of ground-mounted systems may be appropriate when insufficient space, structural and shading issues, or other restrictions preclude roof-mounted systems.

GROUP HOME
A nonprofit or forprofit group home for the sheltered care of persons up to 15 persons with special needs, which, in addition to providing food and shelter, may also provide some combination of personal care, social or counseling services, and transportation.
HISTORIC SITE
Any building, structure, area or property that is significant in the history, architecture, archeology or culture of New Jersey, the City of Orange Township or the United States and has been so designated pursuant to the New Jersey Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.).
HOME PROFESSION
Any occupation or profession carried out for gain by a resident and conducted in the resident's dwelling unit.
HOME PROFESSIONAL OFFICE
An office for the practice of a profession (i.e. law, medicine, dentistry), teaching, consulting or management businesses, and other home businesses (i.e. photography, computer programming, etc.) which do not sell products to the general public on a daily basis, provided that all necessary licenses and permits have been obtained for that professional office.
HOSPITAL
An institution providing primary health services and medical or surgical care to persons, primarily inpatients, suffering from illness, disease, injury, deformity, and other abnormal physical or mental conditions and including as an integral part of the institution related facilities, such as laboratories, outpatient facilities, training facilities, medical offices, and staff residences.
HOTEL
A building containing not less than 50 lodging units under one management, each separate equipped with individual sleeping and bathroom facilities and not furnished with individual cooking accommodations and offered with or without meals to the public for compensation and available to transient guests with or without such customary ancillary facilities as restaurants, bars, gift arcades, auditoriums or convention accommodations. This term includes the term "motel," but is distinct from the terms "boardinghouse," "rooming house," "apartment hotel" and "fraternity or sorority house."
INDUSTRIAL OPERATION OR USE
Any activity conducted in connection with the manufacture, assembly, disassembly, fabrication or processing of materials or products, all of which are marketed off the premises to the ultimate consumer.
INDUSTRY
The location or premises used for any industrial operation.
INFRASTRUCTURE
A facility or structure related to the provision of roads, water and sewer lines, electrical, telephone and cable transmission, and all other utilities and communication systems necessary to the functioning of a community.
INSTITUTIONAL USE
An entity that contains a use such as a church, library, school, hospital or municipally owned or operated building or land use for public purpose.
JUNKYARD
A place where waste, discarded or salvaged materials are brought, sold, exchanged, stored, baled, packed, disassembled, cleaned or handled, including house-wrecking yards, used lumber yards and places for use of salvaged house wrecking and structural steel materials and equipment, automobile recycling but excluding such uses as described above when conducted entirely within a completely enclosed building and excluding pawnshops and establishments for the sale or purchase or storage of used cars in operable condition, salvaged machinery, used furniture and household equipment and the processing of used, discarded or salvaged materials as part of manufacturing operations.
LAUNDROMAT
An establishment providing washing and drying machines on the premises for rental use to the general public and may include drop off dry cleaning with an attendant as an accessory use.
LEED - LEADERSHIP IN ENERGY AND ENVIRONMENTAL DESIGN
It is a widely used Green Building rating system and provides framework to create healthy, highly efficient, cost saving green buildings.
LIGHT MANUFACTURING
A use engaged in the manufacture, predominately from previously prepared materials, or finished products or parts, including processing, fabricating, assembly, treatment, packaging, incidental storage, sales and distribution of such products, and packaging, incidental storage, sales and distribution of such products, and excluding industrial processes which utilize extracted or raw materials, flammable or explosive materials or which potentially involve hazardous or commonly recognized hazardous conditions.
LOADING AREA
An area in which goods and products are moved on and off a vehicle, including the stall or berth and the apron or maneuvering room incidental thereto.
LODGER OR ROOMER
A person, other than a member of a family, occupying a part of any dwelling unit who, for a consideration, is furnished living accommodations in such dwelling unit.
LOT
A parcel or portion of land, exclusive of any adjoining street, separate from other parcels or portions by description of map.
LOT AREA
The area contained within the lot lines of any lot described in a certified survey.
LOT COVERAGE
That portion of a lot that is covered by buildings, structures and all other man-made impervious surfaces, such as paved parking areas and driveways.
LOT DEPTH
The shortest horizontal distance between the street line and a line drawn parallel to the street line through the midpoint of the rear lot line. The greatest dimension on a corner lot is its "depth."
LOT FRONTAGE
The distance for which a lot or parcel of land abuts a street.
LOT WIDTH
The "lot width" at any point shall be measured along the line perpendicular to parallel side lines or making equal angles with both converging side lines. Unless further qualified herein, the "lot width" means the width at the front or setback line.
LOT, CORNER
A lot at the junction of and having frontage on two or more intersecting streets.
LOUNGE
See TAVERN.
MAIN STREET SHOPPING DISTRICT
The CBD Zone, Central Business District, which lies on both sides of Main Street from Cleveland Street to Hickory Street and extends north from Main Street generally to William Street and south of Main Street to the NJ Transit railway.
MAKER SPACE
A place in which people with shared interests, especially in computing or technology, can gather to work on projects while sharing ideas, equipment, and knowledge.
MANUFACTURING
Establishments engaged in the mechanical or chemical transformation of materials or substances into new products, including the assemblage of component parts, the manufacturing of products and the blending of materials, such as resins and plastics.
MARQUEE
A self-supporting, rooflike structure constructed of some durable material such as metal, glass or plastic, permanently affixed to and extending from part or all of a building or other structure over a public or quasi-public right-of-way, which shall be construed to be a part of the building to which it is affixed and is subject to all setback requirements applicable to the building to which it is affixed.
MASTER PLAN
A composite of one or more written or graphic proposals for the development of or use of land in the City of Orange Township, as set forth in and adopted pursuant to the Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.).
MEDICAL FACILITIES
Any private or public health clinic, or other similar community health facility providing diagnostic, therapeutic, or preventive medical care, surgical or invasive procedures not requiring inpatient admission, and/or emergency or urgent care to ambulatory patients on an outpatients basis only, including customary laboratories and pharmacies incidental or necessary to its operation or the service of its patients, but without facilities for inpatient care or surgical procedures that require inpatient admission. A clinic or emergency care facility may also be accessory to a hospital or medical institution.
MIXED USE STRUCTURE
Two or more different uses in a building such as but not limited to residential, office, manufacturing, retail, public or entertainment.
MOTEL
See definition of "hotel."
NEW AUTOMOBILE DEALER
A person or entity who is engaged in the sale of new automobiles and who holds a franchise for the sale of new automobiles.
NONCONFORMING LOT
A lot, the area, dimension or location of which was lawful prior to the adoption, revision or amendment of this chapter or becomes lawful by lawful variation of the requirements of this chapter but fails to conform to the requirements of the zoning district in which it is located by reasons of such adoption, revision, amendment or variation.
NONCONFORMING SIGN, AWNING, CANOPY OR MARQUEE
Any sign, awning, canopy or marquee which existed and was permitted prior to the effective date of this chapter and which does not comply with the provisions of the chapter will be considered to be "nonconforming."
NONCONFORMING STRUCTURE
A structure, the size, dimension or location of which was lawful prior to the adoption, revision or amendment of this chapter but which fails to conform to the requirements of the zoning district in which it is located by reasons of such adoption, revision, amendment or variation.
NONCONFORMING USE
A use which is lawfully exercised within a structure or on land at the time of adoption of this chapter or any amendment thereto and which does not conform to the regulations of the zoning district in which it is located.
NONPROFIT OR CHARITABLE ORGANIZATION
A public or quasi-public organization which is recognized or licensed as nonprofit or charitable by the City of Orange Township, the State of New Jersey or the United States Government and which is not a "private institutional use," as defined herein.
NONRESIDENTIAL ZONES
Those zones set forth in the zoning regulations of this chapter for nonresidential activities and known as the "MX" and "CBD" Zones.
NURSING HOME
A building or group of buildings in which nursing care and medical services are prescribed by or performed under the general direction of persons licensed to practice medicine or surgery in the State of New Jersey, for the accommodation of convalescents or other persons who are not acutely ill and not in need of hospital care but who do require skilled nursing care and related medical services.
OCCUPANCY OR OCCUPIED
The residing of a person or persons in a dwelling unit overnight or the installation, storage or use of equipment, merchandise or machinery in any commercial, public or industrial building.
OFFICE
A room or group of rooms used for conducting the affairs of business, profession, service, industry, or government and generally furnished with desks, tables, files, and communication equipment.
OFFICIAL MAP
A map adopted by ordinance pursuant to Article 5 of Chapter 291 of the Laws of New Jersey 1975 (N.J.S.A. 40:55D32 through 55D36) and deemed conclusive with respect to location and width of streets and public drainage ways and the location and extent of flood control basins and public areas and buildings, and streets or ways, whether or not they are improved or unimproved or are in actual physical existence.
OFFTRACT IMPROVEMENT
An improvement, which is not located on the property, which is the subject of an application for development nor on a contiguous portion of a street or right-of-way and includes any of the following:
(1) 
All improvements of the types required for on-site installation where the need for the providing of such improvements off tract is, in whole or in part, made necessary by the proposed application of the applicant and where the making of such improvements will confer a benefit upon the applicant's lands which are the subject of the application.
(2) 
Any improvement or facility, the installation of which is required in the public interest and the public need for which would not arise but for the improvement of lands which are the subject of the applicant's application and the installation of which would confer a benefit upon the applicant's lands which are the subject of the application. In addition to improvements of the type referred to above, the term specifically includes improvements required to maintain a safe flow of vehicular and pedestrian traffic necessary in the public interest.
(3) 
Installation of new improvements and extensions and modifications of existing improvements.
ONTRACT IMPROVEMENT
Any improvement, the installation of which may be required as part of an application for development and which is to be located on the property, which is the subject of an application for development or on a contiguous street or right-of-way.
OPEN SPACE
Any parcel or area of land or water essentially unimproved and set aside, dedicated, designated or received for public or private use or enjoyment, or for the use and enjoyment of owners and occupants of land adjoining or neighboring such open space, provided that such areas may be improved with only those buildings, structures, streets and off-street parking and other improvements that are designed to be incidental to the natural openness of the land, in the judgment of the Board.
OPEN SPACE, COMMON
Any open space area within or related to a site designated as a development and designed and intended for the use or enjoyment of residents and owners of the development, where the developer provides for an organization for the ownership and maintenance of such open space or for the use of the municipality or other governmental agency where such open space is dedicated and made available for public use pursuant to Section 31 of Chapter 291 of the Laws of New Jersey 1975 (N.J.S.A. 40:55D-43). "Common open space" may contain such complementary structures and improvements as are necessary and appropriate for use or enjoyment of residents and owners of the development or the public, as the case may be, pursuant to the above and subject to the direction of the Board.
OUTDOOR LIVING SPACE
Any outside area on a lot, which is accessible and available to all occupants of the building on said lot and is allocated, designed, developed and maintained for outdoor recreation purposes.
OUTDOOR STORAGE
The keeping, in an unroofed area, of any goods, junk, material, merchandise or vehicles in the same place for more than 24 hours.
OWNER
Any individual, firm, association, syndicate, copartnership or corporation having sufficient proprietary interest in the land sought to be processed for development under this chapter.
PARKING AREAS
Any public or private area, under or outside of a building or structure, designed and used for parking motor vehicles, including parking lots, garages, private driveways, and legally designated areas of public streets.
PARKING LOT
An offstreet, ground level, open area that provides temporary storage for motor vehicles.
PARKING SPACE
A rectangular space either outdoors or within a structure and used to accommodate offstreet motor vehicle parking and meeting the area and dimensional standards contained in this chapter.
PARKING STRUCTURE
A building or structure consisting of more than one level and used to store motor vehicles.
PERFORMANCE GUARANTY
A security, which may be accepted by a municipality, including but not limited to surety bonds, letters of credit under the circumstances specified in Section 16 of P.L. 1991, c. 256 (C.40:55D-12).
PERMITTED USE
Any use allowed in a zoning district and subject to the restrictions applicable to that zoning district.
PERSON
Includes any person, firm, partnership, association, corporation, company or organization of any kind.
PERSONAL SERVICE ESTABLISHMENT
An establishment which offers specialized goods and services purchased frequently by the consumer. Included are barbershops, beauty shops, massage facilities, chiropractic clinics, garment repair, laundry cleaning, pressing, dyeing, tailoring, shoe repair, and other similar establishments.
PLACE OF ASSEMBLY
A building or portion of a building designated and built to serve as an entertainment center, theater, or meeting place for social functions or worship area.
PLACE OF WORSHIP
A building or structure, or groups of buildings or structures, that by design and construction are primarily intended for conducting organized religious services and associated accessory uses.
PLANNING BOARD
The Planning Board of the City of Orange Township, established pursuant to this chapter.
PLAT
The map or maps of a subdivision or site plan.
PLAZA
An open space that may be improved, landscaped, or paved, usually surrounded by buildings or streets.
PRELIMINARY APPROVAL
The conferral of certain rights pursuant to Sections 34, 36 and 37 of Chapter 291 of the Laws of New Jersey 1975 (N.J.S.A. 40:55D46, 55D 48 and 55D-49), prior to final approval, after specific elements of a development plat have been agreed upon by the Planning Board or other approving body and the applicant.
PRELIMINARY PLAT
The map or maps indicating the proposed layout of the subdivision, which is submitted to the Secretary of the Planning Board or Board of Adjustment, as the case may be, for Planning Board or Board of Adjustment consideration, as the case may be, and tentative approval and meeting the requirements of this chapter.
PRINCIPAL USE OR STRUCTURE
The primary or predominant use or the structure devoted to the primary or predominant use of any premises.
PRIVATE INSTITUTIONAL USE
Nonprofit institutions that are not "public institutions', and that are limited to the following: hospitals, medical clinics, museums, utility companies and training centers. In addition, an entertainment center, theater, or meeting place used for social functions or worship area.
PRIVATE SWIMMING POOL
Any artificially constructed basin or other structure for the holding of water for the use by the possessor, his family or guests for swimming, diving and other aquatic sports and recreation. The term "swimming pool" does not include any plastic, canvas or rubber pool temporarily erected upon the ground holding less than 500 gallons of water.
PROCESSING AND WAREHOUSING
The storage of materials in a warehouse or terminal and where such materials may be combined, broken down or aggregated for transshipment or storage purposes where the original material is not chemically or physically changed.
PROFESSIONAL OFFICE
The office of a member of a recognized profession, maintained for the conduct of professions including, but not limited to, physicians, chiropractors, dentists, attorneys, engineers, architects, planners, but not including real estate sales offices or nonprofessional business offices.
PROHIBITED USE
Any use not specifically or conditionally permitted.
PUBLIC INSTITUTIONAL USE
Nonprofit institutions that are limited to the following: schools, government buildings for government use, public libraries, and post offices. In addition, an entertainment center, theatre or meeting place used for social functions or worship area.
PUBLIC PARKING
See GARAGE, PUBLIC.
PUBLIC UTILITY FACILITIES
Telephone and electrical lines, poles, equipment and structures; water or gas pipes, valves or structures; mains, or sewer pipes, valves or structures, maintained, operated and conducted for the service, convenience, necessity, health and welfare of the general public, whether owned by any arm or creature of the local, state or federal government or by any privately owned public utility corporation.
QUORUM
The majority of the full authorized membership of a municipal agency, board or governing body.
RECREATION CENTER
An establishment, place or location whose primary use is to provide recreational activities and facilities for individuals or groups by providing courts, diamonds, fields or enclosed facilities for the public's enjoyment.
RESEARCH LABORATORY
A facility limited to laboratories engaged in scientific investigation testing or the production of factual information for industrial, commercial or institutional clients.
RESIDENTIAL DENSITY, GROSS
The total number of dwelling units per unit content of land which may be or are developed on an area of land, before requirements for public access and required open spaces are provided.
RESIDENTIAL DENSITY, NET
The total number of dwelling units per unit content of land which may be or are developed on an area of land after public access and required open spaces are provided.
RESIDENTIAL ZONES
Those zones set forth in the zoning regulations of this chapter and known as the AA, A1, A2, B1 and B2 Zoning Districts.
RESTAURANT
An establishment where food and drink are prepared, served, and consumed, mostly within the principal building.
RETAIL FOOD STORE
An establishment at which packaged foods and/or hot or cold prepared foods are offered for sale and are primarily intended to be consumed off the premises and in which there is not more than 60 square feet of counter/seating/table space for patrons who wish to consume their food on the premises. Retail food store does not include "automobile service station with quick mart," as defined herein.
RETAIL SALES
Establishments engaged in the selling or rental of goods or merchandise and in rendering services incidental to the sale of such goods.
RETAIL SHOPPING CENTER AND RETAIL PLAZA
A group of commercial establishments planned, constructed, and managed as a total entity, with customer and employee parking provided on-site, provision for good delivery separated from customer access, aesthetic considerations and protection from the elements, and landscaping and signage in accordance with an approved plan.
ROOF LINE
Either the edge of a flat or hip roof or the top of the parapet, whichever forms the top line of the building silhouette, and where a building has several roof levels, this roof or parapet shall be the one belonging to that portion of the building on whose wall a sign is located.
ROOF-MOUNTED SOLAR ENERGY SYSTEM
A solar energy system that is directly installed on solar racking systems, which are mounted on the roof of a building. Erection of roof-mounted systems are preferred for all applications.

ROOM
As applied to garden apartment developments a "room" is defined as a living room, dining room, kitchen and/or bedroom. A kitchenette which does not include space for eating and a dining area of which one full wall is open into a living room shall be counted as one-half room. A bathroom shall not count as a room.
SATELLITE DISH ANTENNA
Any accessory structure capable of receiving for the sole benefit of the principal use, radio or television signals from a transmitter or a transmitter relay, located in planetary orbit, also known as "satellite earth stations," "earth stations" or "ground stations."
SCHOOL
Any building or part thereof that is designed, constructed, or used for education or instruction in any branch of knowledge.
SEASONAL MERCHANDISE
Goods and products typically purchased for a holiday, a special day or seasonal time periods, such as Christmas trees, pumpkins, Easter and Mother's Day flowers, etc.
SECURITY GATES
Any rolling or sliding metal enclosure which has an open weave minimum of 60% open (as opposed to a solid metal face), closing vertically or horizontally, installed as a theft protection measure in front of or behind a plate glass window or storefront door/window combination.

SETBACK
The minimum distance by which any building or structure must be separated from a street right-of-way or lot line.
SHARED PARKING
Parking spaces that are available to more than one function. A public or private parking area used jointly by two or more uses.
SIGN
Any object, device, display or structure or part thereof, situated outdoors or indoors, which is used to advertise, identify, display, direct or attract attention to an object, person, institution, organization, business product, service, event or location by any means, including words, letters, figures, designs, symbols, fixture colors, illumination or projected images.
SIGN AREA
The total square foot content of the background upon which the lettering, illustration or display is presented, including any base support or frame. If there is no background, the "sign area" shall be computed as the product of the largest horizontal width and the largest vertical height of the lettering, illustration of display. This shall not be construed to include the supporting members of any sign which are used solely for such purpose. For signs with two display faces, the maximum area requirements shall be permitted on each side. Signs with more than two display faces are prohibited.
SIGN, BUSINESS
A sign which directs attention to a person, organization, institution, activity, event, place, object, product, commodity, business, entertainment, service or profession which is located, sold, produced, provided, conducted or offered upon the premises when such sign is located or to which it is affixed.
SIGN, CANOPY
Any sign inscribed on a self-supporting structure that projects from the face of the building and that is supported, in whole or in part, by the building.
SIGN, CHANGEABLE MESSAGE
Any sign expressly designed for the periodic changing of copy or message manually and not entailing any alteration of the sign structure.
SIGN, COMBINATION
Any type, which combines the characteristics of two or more types of signs.
SIGN, ELECTRIC
Any sign containing internal electric wiring which has characters, letters, figures, design, faces, backgrounds or outlines illuminated by incandescent or fluorescent lamps or luminous tubes as part of the sign proper.
SIGN, FLASHING
A sign, the illumination of which is not kept constant in intensity at all times when in use.
SIGN, GROUND
A sign which is supported by columns, poles, uprights or braces in or upon the ground, which is not a direct part of a building, whether illuminated or not, but shall not include billboards. A "ground sign" is also known as a "freestanding sign."
SIGN, ILLUMINATED
A sign lighted by or exposed to artificial lighting, either by lights on or in the sign or directed towards the sign.
SIGN, MARQUEE
Any sign attached in any manner on a rooflike structure over the entrance of a building.
SIGN, NEON
Any sign consisting of transparent glass or plastic tubing radiating colored or white light.
SIGN, OFF PREMISES
Any sign, which directs attention to a business commodity, service or entertainment not conducted or sold on the premises on which such sign is located.
SIGN, POLE
Any sign supported from the ground by only one member, such as a steel column, pylon, pole or post, with a sign attached thereto, but shall not include billboards.
SIGN, PORTABLE
A sign, signboard, light post, awning, canopy, marquee, framework, flagpole or other similar object which is not securely affixed to the ground or otherwise affixed in a permanent manner to a building or other structure.
SIGN, POSTAL ADDRESS
Any display of the legal address.
SIGN, PROFESSIONAL
A sign listing only the name or profession, or both, of a person practicing a profession on the premises where the sign is located.
SIGN, PROJECTING
A sign, other than a wall sign, suspended from or supported by a building or structure and extending beyond the face of the building or structure.
SIGN, RESIDENTIAL
Signs as permitted herein in residential districts.
SIGN, ROOF
A sign attached to the roof framing, walls and/or column of the building on which the advertising display is above the roofline.
SIGN, SIDEWALK
Any temporary portable exterior sign, including sandwich boards.
SIGN, STRUCTURE
All frames, glass or other coverings, gooseneck arms, light bulbs, lights, shields, shades, reflectors, supports, brackets, braces, screws, bolts, fastenings or other items or devices, which constitute a part of the support system for any sign, awning, canopy or marquee.
SIGN, TEMPORARY
Any sign put up for a limited period of time for the purpose of:
(1) 
Advertising the sale or rental of real estate;
(2) 
Displaying information regarding a special offer of products, services or positions available;
(3) 
Announcing special events, holidays or seasons and/or pertaining to civic, religious, political or philanthropic activities;
(4) 
Construction, engineering or architectural work or a building project of land improvement project.
SIGN, WALL
Any sign, other than a projecting sign, attached to or erected against a wall of a building or erected against a wall or a building or structure or made an integral part of the building plan of said wall, building or structure. So-called "box signs" which are recessed so that they are flush with the facade of a structure and individual channel letters mounted onto the facade are "wall signs."
SIGN, WINDOW
Any sign attached to, etched or painted or placed behind the window, intended to be visible from outside.
SINGLE OWNERSHIP
Ownership by one person or by two or more persons, whether jointly as tenants, by the entirety or as tenants in common, of a separate parcel of real property not adjacent to land held or owned by said person or persons.
SITE
Any contiguous plot, parcel or parcels of land.
SITE PLAN
A development plan of one or more lots on which is shown the following:
(1) 
The existing and proposed conditions of the lot, including but not necessarily limited to topography, vegetation, drainage, floodplains, marshes and waterways;
(2) 
The location of all existing and proposed buildings, drives, parking spaces, walkways, means of ingress or egress, drainage facilities, utility services, landscaping, structures and signs, lighting and screening devices;
(3) 
Any other information that may be reasonably required in order to make an informed determination pursuant to an ordinance requiring review and approval of site plans by the Planning Board or Board of Adjustment, as the case may be.
SITE PLAN REVIEW
The review of a site plan for any public or private project by the designated review agency for the local jurisdiction.
SOLAR ENERGY
Radiant energy (direct, diffused, or reflected) received from the sun.

SOLAR ENERGY SYSTEM
One or more photovoltaic, concentrated solar thermal, or solar hot water device, either free-standing ground, building integrated or roof mounted, as well as related equipment, that is intended for the purpose of reducing or meeting the energy needs of the property’s principal and/or accessory use.

STORE, RETAIL
A building or part thereof in which or from which merchandise is sold only at retail directly to the public.
STOREFRONT
An area the width of the store times the height of the store from finished first floor to finished first floor ceiling.
STORY
That portion of a building included between the surface of any floor above the average elevation of the ground at the foundation wall and the surface of the next floor above it or, if there is no floor above it, then the space between the floor and the ceiling next above it.
STREET
Any vehicular way which is an existing state, county or municipal roadway or is shown upon a plat approved pursuant to law or is approved by other official action and includes the land between the street lines, whether improved or unimproved.
STREET SIDE LINE
The outermost line of the whole area devoted to street purposes on either side thereof. "Street side line" is synonymous with the street right-of-way line and street line.
STRUCTURE
Anything constructed or erected which requires permanent location on the ground or attachment to something having such location.
SUBDIVISION
The division of a lot, tract or parcel of land into two or more lots, tracts, parcels or other divisions of land for sale or development.
SUBDIVISION, MAJOR
Any subdivision of five or more lots.
SUBDIVISION, MINOR
A subdivision of land which involves the creation of not more than four lots, provided that such subdivision does not involve a planned development, any new street or the extension of any off-tract improvement, the cost of which is to be prorated pursuant to Section 30, Chapter 219 (N.J.S.A. 40:55D-42).
SWIMMING POOL, PRIVATE
Any structure that contains water 24 inches in depth and which is used, or intended to be used, for swimming or recreational bathing available only to the family and guests of the householder.
SWIMMING POOL, PUBLIC
Any swimming pool other than a private swimming pool. Public swimming pool does not include a waterpark.
TAVERN
An establishment, duly licensed by the appropriate Alcoholic Beverage Control Board, where the primary business is the retail sale of alcoholic beverages to be imbibed on the premises. An establishment that sells alcoholic beverages, but which receives more than 50% of its gross income from the sale of food is to be classified as a restaurant.
THEATER, MOVIE
A place where motion pictures are shown to the public for a fee.
TOWNHOUSE LOT
The parcel of land, which has been or is intended to be conveyed in fee simple to an individual purchaser, together with a townhouse dwelling unit constructed thereon.
TOWNHOUSE PRIVILEGE YARD AREA
The land area directly accessible from within the townhouse dwelling unit having a total square feet area equivalent to and meeting all front, rear and side yard requirements of an individual townhouse lot and put into common ownership pursuant to the Condominium Act of 1970 (N.J.S.A. 46:8B3-1 et seq.) or a similar or comparable ownership arrangement consistent therewith.
TOWNHOUSE TRACT
The entire parcel upon which a townhouse complex shall be or has been built.
TRAVEL TRAILER AND RECREATIONAL VEHICLE
A vehicular, portable structure built on a chassis designed as a temporary dwelling for travel, recreation and vacation, having a body width not exceeding eight feet and its body length not exceeding 29 feet.
URBAN FARMING
Urban agriculture, urban farming, or urban gardening is the practice of cultivating, processing and distributing food in or around urban areas. Urban agriculture can also involve animal husbandry, aquaculture, agroforestry, urban beekeeping, and horticulture. These activities occur in peri-urban areas as well, and peri-urban agriculture may have different characteristics.
USED CAR LOT
Any indoor or outdoor space used or occupied for the business of selling, buying or dealing in used motor vehicles.
USED MOTOR VEHICLE DEALER
A person engaged in the business of selling, buying or dealing in used motor vehicles.
USED MOTOR VEHICLE AND/OR SECONDHAND MOTOR VEHICLE
Any automobile or motor vehicle that has been previously sold or used.
VARIANCE
Permission to depart from the literal requirements of this chapter.
VENDING MACHINES
A machine licensed by the State of New Jersey, which sells convenience goods to the public.
WALL
A solid, vertical structure of wood, masonry or other material serving to enclose, divide or protect an area.
WAREHOUSING
Terminal facilities for handling freight with or without maintenance facilities.
WHOLESALE TRADE
Establishments or places of business primarily engaged in selling merchandise to other businesses, including retailers, industrial, commercial, institutional, or professional business users, other wholesalers, or acting as agents or brokers and buying merchandise for, or selling merchandise to, such individuals or companies.
WIRELESS TELECOMMUNICATIONS FACILITY
A facility operated by a wireless telecommunications service provider licensed by the Federal Communications Commission (FCC), designed and used for the purpose of transmitting, receiving and relaying voice and data signals from various wireless telecommunications devices and equipment, including antennas mounted on existing structures, any towers, poles or other antenna support structures, and any ancillary electronic equipment with or without enclosures around such equipment. For purposes of this chapter, amateur radio transmission facilities and facilities used exclusively for receive-only antennas are not classified as wireless telecommunications facilities.
YARD, FRONT
An open, unoccupied space, unless occupied by a use as hereinafter specifically permitted, extending across the full width of the lot and lying between the front street property line and the nearest line of the building, provided, however, in the case of a corner lot, that the owner of said lot shall designate which yard, as meeting the "front yard" requirements indicated herein, is to be considered as the "front yard." For purposes of administering the regulations contained in this chapter, the main entrance to the building shall be from the "front yard" as designated by the owner.
YARD, REAR
A space unoccupied, except by an accessory building or use as hereinafter specifically permitted, extending across the full width of the lot between the rear line of any building, other than an accessory building, and the rear lot line.
YARD, SIDE
An open, unoccupied space, unless occupied by a use as hereinafter specifically permitted, on the same lot with the building and between the building and the side lot line, extending from the front yard to the rear yard.
