The Mayor shall be the chief executive of the City government. He shall, without limitation thereto:
(a) 
Address the Council annually on the condition of the City government, its needs and his recommendations for the ensuing year;
(b) 
Enforce the Charter and ordinances of the City;
(c) 
Supervise and direct all of the departments of the City government and coordinate City programs and activities within the executive branch;
(d) 
Require each department to make an annual and such other reports of its work as he may deem desirable;
(e) 
With the advice and consent of the Council, appoint all officers and employees for whose election or appointment no other provision is made by Charter or ordinance; and,
(f) 
From time to time make such recommendations for action by the Council as he may deem in the public interest.

(a) 
Whenever the Mayor shall be unable to attend to the duties of his office, due to his absence, disability or other cause, for a period of less than forty-eight (48) hours, the City Administrator or, in the event of his inability to serve, a department head designated by the Mayor in writing filed with the Clerk, shall serve as Acting Mayor. Whenever the Mayor shall be unable to attend to the duties of his office:
(1) 
For a period less than forty-eight (48) hours and at a time when neither the City Administrator, nor a duly designated department head can serve;
(2) 
For a period of more than forty-eight (48) hours; or,
(3) 
At any time during an emergency declared by the Council; a councilman designated under this section shall serve as Acting Mayor.
(b) 
The Mayor may at any time and from time-to-time designate in writing filed with the Clerk a Councilman to serve as Acting Mayor under the provisions of this section. Whenever the provisions of this section require a Councilman to serve as Acting Mayor, and the Mayor has failed to make such designation or the Councilman so designated by the Mayor is unable to serve, the Council shall by a majority vote of its whole number appoint an Acting Mayor from among its membership.
(c) 
Any person appointed pursuant to this Subsection shall succeed to all of the rights, powers and duties of the Mayor, until the Mayor returns, the disability or other cause ceases, and shall not vacate his office as Councilman or forfeit any rights or privileges inherent therein, except as set forth in Subsection (d) hereof.
(d) 
In the event of the death, resignation or disqualification of the Mayor, (hereby declared an emergency pursuant to Section 3.3 of the Charter), there shall be a vacancy in the office which shall be filled by election for the remainder of the unexpired term at the next general election occurring not less than sixty (60) days after the occurrence of the vacancy. The office shall be filled by the Councilman serving as Acting Mayor until the qualification of the person so elected. During the period such Councilman is serving as Mayor pursuant to this Subsection, his office as Councilman may be filled as in the case of any other vacancy, provided that, upon the election and qualification of the person elected as Mayor, such Councilman may resume his office for the balance of the term thereof.

(a) 
In the exercise of his/her powers of removal of officers and employees under Section 3.5 of the Charter, the Mayor may suspend an officer or employee appointed by him/her pending removal. A suspended officer or employee shall be entitled to regular compensation until the removal takes effect or he is restored to office by a resolution of disapproval by the Council.
(b) 
Within the Office of the Mayor there may be a Confidential Assistant and a Secretary to the Mayor. Individuals appointed to these positions shall be appointed by the Mayor and shall serve during the term of office of the Mayor, subject to removal as provided in Section 2:3-3 and Section 11:12-7 of this Code.

(a) 
Whenever a vacancy exists in any office required by the Charter or ordinance to be filled by the Mayor with the advice and consent of the Council, the Mayor may temporarily fill such vacancy in the absence of any contrary provision in the Charter or ordinance by appointing an acting officer, including the designation of himself or a Department Director as Acting City Administrator or the designation of the City Administrator as an acting department director. Any such appointment shall terminate no later than ninety (90) days after the date of appointment. Provided however that before the completion of an interim appointment as described herein and upon the written application of the Mayor, the City Council by a majority vote, may approve an extension of such appointment for an additional period not to exceed ninety (90) days. No person shall be eligible for a temporary appointment who has previously served a temporary appointment in the same office during the previous twelve (12) consecutive months.
(b) 
Such appointee shall have all of the functions, powers and duties of the office for ninety (90) days or for such longer period as may be approved and provided for pursuant to Subsection (a) above.
(c) 
In the event the City Administrator is designated as an acting department director, the provisions of Section 2:5-9(d) shall apply.

In accordance with Section 4.8 of the Charter, the Mayor shall appoint members of all boards, commissions and other City bodies, with the exception of the Board of Education, with the advice and consent of the Council.

The Mayor may appoint, within the limits of available appropriations, a Chief of Staff who shall serve under the direction and supervision of the Mayor. The Chief of Staff shall serve in the unclassified service and at the pleasure of the Mayor. The Chief of Staff shall:
(a) 
Handle the Mayor's communications with the public;
(b) 
Assist in the creation and implementation of administrative policies and goals, including the priorities for public safety, economic development, budgeting and finance, communications and operations;
(c) 
Coordinate communication between the administration and the City Council;
(d) 
Direct all intergovernmental relations for the City, working with all levels of government including Federal, State, County and School Boards, including shared services, grant opportunities and green initiatives; and
(e) 
Perform all other functions and duties as may be assigned by the Mayor.
