(a) 
No auction or auctioneer's license shall be granted by the Mayor to any person:
(1) 
Of disreputable character;
(2) 
Who has been convicted of violating any City, State or Federal law or any disorderly person provision; or,
(3) 
Who has misrepresented any facts stated in the application.
(b) 
The Mayor may limit, with the approval of the Council the number of such licenses to be granted.
(c) 
Application for such license shall be filed with the License Bureau, as provided in Section 9:1-3.

(a) 
Every application for an auction or auctioneer's license shall be in writing and signed by the applicant.
(b) 
The application for an auctioneer's license shall state the:
(1) 
Name and address of the applicant;
(2) 
Place of residence;
(3) 
Place of business, if any; and,
(4) 
Any other information that may be deemed necessary.
(c) 
The auction license application shall state the:
(1) 
Name and address of the licensee;
(2) 
Purpose of the auction;
(3) 
Place where auction will be conducted;
(4) 
Nature of merchandise to be auctioned; and,
(5) 
Hours during which the auction will be conducted.
No auctioneer licensed under this article shall conduct an auction without first obtaining an auction license for the specific sale.
Nothing in this article shall apply to judicial sales, sales by executors, administrators, trustees or referees in bankruptcy, receivers nor to sales conducted for charitable purposes.

(a) 
The applicant, before being granted an auction license, shall file a bond in the sum of One Million Dollars ($1,000,000.00) with the License Bureau.[1]

(b) 
The bond shall be approved as to surety by the Corporation Counsel.
(c) 
The bond shall be conditioned for the protection of any person purchasing at the auction sale who may be unlawfully injured by any sale in contravention of this article.
(a) 
Upon the Mayor's decision to grant an auction or auctioneer's license and upon payment of the prescribed fee, the applicant shall be issued a license by the License Bureau.
(b) 
The auction license shall state the:
(1) 
Name and address of the licensee;
(2) 
Purpose of the auction;
(3) 
Place where the auction will be conducted;
(4) 
Nature of the merchandise to be auctioned; and,
(5) 
Hours during which the auction will be conducted.
(c) 
The auctioneer license shall state the:
(1) 
Name and address of the licensee;
(2) 
Places of residence for preceding three years;
(3) 
Place of business if any; and,
(4) 
Any other information the Mayor may deem necessary.

Every auctioneer's license shall be issued for a period of one (1) year from June 1 to May 31 of the following year.
The following acts, omissions and practices in connection with sale of goods, wares and merchandise at auction are hereby prohibited.
(a) 
The use of deceit, fraud or misrepresentation of any article;
(b) 
The substitution of any article in place of an article bid upon at auction;
(c) 
The use of false or misleading advertising matters;
(d) 
The use of false bidders or puffers;
(e) 
An auction sale on any of the streets, sidewalks or public property;
(f) 
The substitution of an unlicensed person in place of a licensed auctioneer;
(g) 
Auction sales between the hours of 10:00 P.M. and 7:00 A.M.;
(h) 
Auction sales on Sundays and legal holidays;
(i) 
No person shall conduct an auction in a noisy, persistent or offensive manner. He shall not obstruct the passage of vehicles or pedestrians upon any street, sidewalk or public way or in any public place; and,
(j) 
No person shall conduct an auction in such a manner as to create an immediate danger of a public nuisance or of a public disturbance.
