Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.
a. 
The Chief of Police or, in his/her absence, disability or inability to act, the Chief's designee is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police and in accordance with paragraph a. above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed fifty ($50.00) dollars.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than forty-eight (48) consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.
Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
Unless another penalty is expressly provided by New Jersey Statute or in this chapter, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than fifty ($50.00) dollars or imprisonment for a term not exceeding fifteen (15) days or both.
If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.
All former traffic ordinances of the Township of Aberdeen are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.
When the Township Council hereby finds and declares that problems of traffic control occur and traffic must be moved through or around street construction, maintenance operations, and utility work above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
The Township of Aberdeen, in the County of Monmouth, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations of utility work obstructs the normal flow of traffic. Any person, contractor, or utility, who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.
It shall be the responsibility of the person, contractor, or in the case of a public utility agreement, wishing to conduct work on, under or above the roadway to contact the Police Department in order to arrange a preconstruction meeting in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Police Department is in violation of this section.
The person, contractor, or utility shall provide the Police Department with at least two (2) emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the Township may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Township shall be charged to the person, contractor, or utility for such condition.
There shall be no construction, maintenance operations, or utility work on any roadway in the Township before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the Officer in charge of the Police Department. If it is determined by the Officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.
Road closing and/or traffic detours shall not be permitted unless approved by the Police Department.
Traffic directors shall be posted at all construction or maintenance sites when determined by the Police Department that same is necessary to provide for the safety and expeditious movement of traffic.
The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.
It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights, devices and pavement markings are installed.

a. 
The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.
b. 
Any person who violates any parking regulation, when no other penalty is established by law, shall be liable upon conviction to a penalty of not more than one hundred fifty ($150.00) dollars.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.
c. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.

a. 
Whenever snow has fallen and the accumulation is such that it covers the streets or highways within the Township, an emergency shall exist and no vehicle shall be parked on the streets or highways, or portions thereof, as described herein. This parking prohibition shall remain in effect after the snow has ceased, until the streets have been plowed sufficiently, and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable cost of the removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
A warning may be issued to any motorist violating this subsection during the first snowfall following the effective date of this subsection, and thereafter during the first snowfall of each subsequent season.
d. 
Parking shall be temporarily prohibited for snow removal in accordance with the following provisions:
If snow has fallen and has covered the street or highway on an even numbered day and the resident's house has an even number, parking shall be prohibited from 7:00 a.m. for a period of 24 hours on that side of the street or highway.
If snow has fallen and has covered the street or highway on an odd numbered day and the resident's house has an odd number, parking shall be prohibited from 7:00 a.m. for a period of 24 hours on that side of the street or highway.
The exception to this schedule shall be the commuter parking lot at Line Road (off Lloyd Road) and Bechstein Drive near State Highway 34, as well as the areas in front of residential houses being used as professional offices.

a. 
Definitions. For the purpose of this subsection, the following terms, phrases, words and their derivations shall have the meanings stated herein unless their use in the text of this chapter clearly demonstrates a different meaning. When not inconsistent with the context, words used in the present tense include the future, words used in the plural number include the singular number, and words used in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
PERSON
shall mean any individual, corporation, company, partnership, firm, association or political subdivision of this State subject to municipal jurisdiction.
STREET
shall mean any street, avenue, boulevard, road, parkway, viaduct, drive, or other way, which is an existing State, county, or municipal roadway, and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas, and other areas within the street lines.
ALL-WAY STOP INTERSECTION
shall mean the street(s) or part(s) of street(s) described in Schedule XIV attached to and made a part of this chapter are hereby designated as All-Way Stop Intersections. Stop signs shall be installed as provided therein.
b. 
Prohibited Conduct. To promote obedience and insure visibility of stop signs, the State law parking prohibition provided in N.J.S.A. 39:4-138 that "no operator of a vehicle shall stand or park the vehicle within fifty (50) feet of stop sign" shall be enforced. If a vehicle shall stand or park within the limit, the party responsible for parking must move the vehicle from the said limit or said party shall be deemed in violation of this subsection.
c. 
Enforcement. The provisions of this subsection shall be enforced by the Aberdeen Township Police Department for those stop signs as located within the municipal boundaries of Aberdeen. Where the All-Way Stop Intersection is located within both Aberdeen Township and an adjoining municipality, the Police Department of said adjoining municipality shall enforce the provisions of their ordinance within their municipal corporate limits.
d. 
Penalties. Unless another penalty is expressly provided by New Jersey Statutes, every person convicted of a violation of this subsection or any supplement thereto shall be liable to a penalty of not more than fifty ($50.00) dollars or imprisonment for a term not exceeding fifteen (15) days or both.

Parking Permit Required.
A. 
Use. No person shall park any vehicle in the Railroad Station Parking Lots without a valid municipal parking permit hang-tag displayed on the rear-view mirror of the vehicle.
B. 
No person shall park any vehicle in areas other than those designated with lines or stalls for parking purposes. Permit parkers are to utilize white spaces and daily parkers are to utilize yellow spaces. Handicapped parkers without permits must pay for the spot.
C. 
Permits. Application forms for parking permit hang-tags shall be obtained from the administrative secretary.
Each applicant for a parking permit hang-tag shall register the license plate of the vehicle to be used. Such vehicle must be registered at the applicant's address in the name of the applicant or an immediate member of the applicant's family. One permit will be issued per permit holder. However, a permit holder shall be allowed to register up to three vehicles on one permit. In an emergency when an unregistered vehicle must be used, police headquarters should be advised by the permittee of the make, license plate number and space to be used by the unregistered car. Thereupon, the Police Department shall authorize temporary parking.
D. 
Fees. The annual fee for a permit is $480 payable in advance, and, for a quarter permit, the sum of $140 per quarter, payable in advance and submitted with the application. For each replacement permit hand-tag issued to the applicant, there shall be a charge of $25 to defray administrative expenses. Meter daily parking will be made available at a charge of $3 per day.
E. 
Effective Dates. Permits shall be issued effective January 1 through December 31 of each year. For annual permits, applications and fees shall be submitted to the administrative secretary no later than December 30 of the year proceeding the year for which the permit is applied. Quarterly permits will be issued from January 1 through March 31, April 1 through June 30, July 1 through September 30 and October 1 through December 31, respectively.
F. 
Speeding. The speed limit within the parking lots shall be 10 miles per hour, and the provisions of N.J.S.A. 39:1 et seq. shall be applicable.
G. 
Unlawful Parking. Vehicles unlawfully parked may be towed away and impounded by direction of the Police Department and shall receive summonses for violation of the terms of this subsection. Owners may obtain release of the vehicles by payment of towing and other costs.
H. 
Administration. The Township Manager or his designee shall be the official responsible for the administration of the municipal parking lots.
I. 
The provisions of this subsection shall not apply on Saturdays, Sundays and national legal holidays.
In accordance with the provisions of N.J.S.A. 40:48-2.46, on the following private property that is open to the public and to which the public is invited, the movement of traffic shall be controlled by the types of regulations indicated. No person shall operate or park a vehicle in violation of the following regulations.

The owners of the premises referred to in this section shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual of Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township. The owner shall be responsible for the repair and restoration or replacement of same.

There shall hereby be created bus commuter parking lots in the Township of Aberdeen for the use by the residents and nonresidents. The bus commuter parking lots are more particularly described in Schedule A,[1] which is attached hereto and incorporated into this section.

a. 
No person shall park any vehicle in the bus commuter parking lots without a valid municipal parking permit being displayed.
b. 
No person shall park any vehicle in the bus commuter parking lots in any areas other than those designated with lines or stalls for commuter parking purposes.

Residents and nonresidents shall obtain application forms for bus commuter parking permits from the administrative secretary. Each applicant for a bus commuter parking permit shall register the license plate of up to three vehicles to be used. Such vehicles must be registered at the applicant's address and be in the name of the applicant or in the name of an immediate family member of the applicant. One permit will be issued. In an emergency when an unregistered vehicle must be used, police headquarters shall be advised by the permittee of the make, model and license plate number of the vehicle being parked in the bus commuter parking lot.

a. 
The annual fee for an Aberdeen Township resident's bus commuter parking permit is $100 and the annual fee for a nonresident's bus commuter parking permit is $522 payable in advance. For each replacement permit issued to the applicant, there shall be a charge of $25 to defray administrative expenses.
b. 
Fees previously collected in furtherance of the increase set forth above reflect ratification and approval of those collections by the Township retroactive to 2003 as if adopted prior hereto.

Permits shall be issued effective January 1 through December 31 of each year. Applications and fees shall be submitted to the administrative secretary no later than December 31.

Vehicles unlawfully parked may be towed away and impounded by direction of the Police Department and shall receive summonses for violation of the terms of this section. Owners may obtain the release of their vehicles by payment of towing and other costs.

The Township Manager or his designee shall be the official responsible for the administration of the bus commuter parking lots. The provisions of this ordinance shall not apply on Saturdays, Sundays and national legal holidays.
The following shall be bus commuter parking lots:
a. 
Bechstein Drive.
b. 
Strathmore Lanes Parking Lot.
c. 
ShopRite .
