(a)
Vacancies shall be filled by utilizing competitive promotional examinations, in accordance with the Civil Service Rules of the State of New Jersey.
(b)
Where the Appointing Authority, after consultation with the New Jersey Civil Service Department, finds that no employee is qualified for promotion to the vacancy, the Appointing Authority may order a competitive examination, open to candidates outside the City's employ. In post-examination selection, the Appointing Authority shall give appropriate consideration to the applicant's qualifications, record of past performance, and the length and quality of his service, as well as any veteran's preference rights to which he may be entitled.
(c)
Selection shall be made from the top three (3) interested candidates, as determined by the examination process of the Civil Service Department of the State of New Jersey.

Pending the availability of a suitable eligibility list, the Appointing Authority may fill vacancies by a provisional promotion.
