Any person having care, custody or control of a dog shall be responsible
for the removal and sanitary disposal of any feces left by his or
her dog in or upon any public property, including but not limited
to any sidewalk, street, thoroughfare, beach or wetland, or in or
upon the property of persons other than the owner or person have care,
custody or control of said dog. Any person having care, custody or
control of a dog off the property of the owner or person in custody
of the dog shall have in his or her possession a device or equipment
to pick up and remove dog feces. Individuals with disabilities aided
by service dogs and law enforcement, emergency or rescue officials
with dogs carrying out official duties are exempt from this subsection.
Violations and penalties. Any person found in violation of Chapter 15 by the Animal Control Officer, Assistant Animal Control Officer or a Police Officer shall be subject to payment of a fine of $30 for the first offense; $50 for the second offense and $150 for the third and subsequent offenses. In addition to any other legal remedies that may be available, the Animal Control Officer or other designated enforcing person, may enforce these penalties through the Town's Non-Criminal Disposition as outlined in Chapter 1, Article II of the Town's General Bylaws.
