Pursuant to N.J.S.A. 40:72-4, the administrative functions,
powers and duties of the Board of Commissioners shall be allocated
among and within the following departments:

The Director of the Department of Public Affairs and Public
Safety shall have supervision and control of the Police Department.

Within the Department of Public Affairs and Public Safety, there
shall be a Department of Police, the head of which shall be the Chief
of Police.

The Police Department shall consist of such officers and employees
that may be deemed necessary by the Board of Commissioners to preserve
the peace of the Borough. The Commissioner of Public Safety may appoint
and promote such police officers as may be provided for within the
local municipal budget.

a.
Each applicant for a position in the Police Department of the Borough
of Allenhurst shall be a citizen of the United States. Each applicant
shall comply with all of the laws of the State of New Jersey pertaining
to municipal police. Each applicant shall have a minimum of 2 years
of higher education (i.e. above high school) with preference for a
4 year degree from an accredited college or university. Each successful
appointee shall serve a probationary period after their successful
completion of a course at a State or County accredited police school.
b.
All qualified applicants for a position in the Police Department
of the Borough shall be classified for the position or positions to
be filled in the following classes prior to any appointment being
made:

Residents of the Borough.
|

Class II
|
Other residents of the County of Monmouth.
|
|
Class III
|
Other residents of the State.
|
|
Class IV
|
All other qualified applicants.
|
|
With each such classification, duly qualified applicants who
are United States military veterans shall be accorded all such United
States military veterans' preferences as are provided by law. Persons
discharged from the service within six (6) months prior to making
application to the Borough, who fulfill the requirements of N.J.S.A.
40A:14-123.1 and who thereby are entitled to appointment notwithstanding
their failure to meet the New Jersey residency requirements at the
time of their initial application shall be placed in Class II.

c.
The Commissioner of Public Safety, when making appointments shall
first appoint all those applicants in Class I and then those applicants
in each succeeding class in the order above listed, and shall appoint
a person or persons in any such class only to a vacancy or vacancies
remaining after all qualified applicants in the preceding class or
classes have been appointed or have declined an offer of appointment.
This subsection shall apply to initial appointments and not
to promotional appointments of persons already members of the Police
Department.

Except as otherwise provided by law, no permanent member or
officer of the Police Department shall be removed from his office,
employment or position for any cause other than incapacity, misconduct
or disobedience of rules and regulations established for the government
of the Police Department, nor shall any such member or officer be
suspended, removed, fined or reduced in rank from or in office, employment
or position therein except for just cause as hereinbefore provided
and then only upon written complaint setting forth the charge or charges
against such member or officer. The complaint shall be filed with
the Commissioner of Public Safety and a copy shall be served upon
the member or officer so charged with notice of a designated hearing
thereon by the Commissioner of Public Safety or his designee which
shall not be less than ten (10) nor more than thirty (30) days from
the date of service of the complaint. The hearing shall proceed and
be conducted in accordance with the provisions of N.J.S.A. 40A:14-147
and case law relating thereto.

Pursuant to the Commissioner Form of Government, (N.J.S.A. 40:70-1
et seq.), the "appropriate authority" as set forth in N.J.S.A. 40A:14-118
shall be the Commissioner of Public Safety of the Borough of Allenhurst.
The Commissioner of Public Safety shall adopt and promulgate rules
and regulations for the government of the Municipal Police Department,
and for the discipline of its members. The aforesaid rules and regulations
may be suggested and recommended to the Commissioner of Public Safety
by the Chief of Police. The Chief of Police shall be the head of the
Police Department but shall be directly responsible to the Commissioner
of Public Safety for the efficiency and routine day-to-day operations
thereof. The Chief of Police shall further, pursuant to policies established
by the Commissioner of Public Safety:
a.
Administer and enforce rules and regulations and special emergency
directives for the disposition and discipline of the force and its
officers and personnel.
b.
Have, exercise, and discharge the functions, powers and duties of
the force.
c.
Prescribe the duties and assignments of all subordinates and other
personnel.
d.
Delegate such authority as he may deem necessary for the efficient
operation of the force to be exercised under his direction and supervision.
e.
Report at least monthly to the Commissioner of Public Safety in such
form as shall be prescribed by the Commissioner of Public Safety on
the operation of the force during the preceding month and make such
other reports as may be requested by the Commissioner of Public Safety.
Nothing set forth herein shall prevent the appointment by the
Board of Commissioners of committees or commissions to conduct investigations
of the operation of the Police Department and the delegation to such
committees or commissions of such powers of inquiry as the Board of
Commissioners deems necessary or to conduct such hearing or investigation
authorized by law. Nothing herein contained shall prevent the Commissioner
of Public Safety from examining at any time the operations of the
Police Department or the performance of any officer or member thereof.
In addition, nothing herein contained shall infringe upon or limit
the power of the Commissioner of Public Safety to act and provide
for the health, safety or welfare of the Borough of Allenhurst in
an emergency situation through special emergency directives.

The Police Department shall:
a.
Preserve the public peace, protect life and property, prevent crime,
detect and arrest offenders against the penal laws and ordinances
effective within the Borough, suppress riots, mobs and insurrections,
disperse unlawful or dangerous assemblages and preserve order at all
elections and public meetings and assemblages.
b.
Administer and enforce laws and ordinances to regulate, direct, control
and restrict the movement of vehicular and pedestrian traffic, and
the use of the streets by vehicles and persons, to protect the safety
and facilitate the convenience of motorists and pedestrians, and make
and enforce rules and regulations not inconsistent with the ordinances
of the Borough for such purposes.
c.
Remove or cause to be removed all nuisances in the public streets,
parks and other public places of the Borough, inspect and observe
all places of public amusement or assemblage and all places of business
requiring any State or municipal license or appropriate department.
d.
Provide proper police attendance and protection at fires.
e.
Provide for the attendance of its members in court as necessary for
the prosecution and trial of persons charged with crimes and offenses,
and cooperate fully with the law enforcement and prosecuting authorities
of Federal, State and County governments.
f.
Operate a training program to maintain and improve the police efficiency
of the members of the Department.

Within the Department of Police there shall be a Police Physician
who shall have all the powers, functions and duties of a Borough Police
Physician prescribed by general law. The Borough Physician shall also
be known as the Police Physician.

a.
Rules and Regulations. There shall be a Manual of Police Department Rules and Regulations, hereinafter referred to as the "Manual," consisting of those rules and regulations promulgated by the Commissioner of Public Safety. Pursuant to subsection 2-22.5 this Manual shall be known as the Police Department of the Borough of Allenhurst Rules and Regulations. The Board of Commissioners shall adopt the Police Department Rules and Regulations.
b.
Right to Amend or Revoke. For the good of the service, in accord
with New Jersey Statute 40A:14-118, the right is reserved by the Commissioner
of Public Safety, as the representative of the Governing Body, to
amend or to revoke any of the rules, regulations, or procedures, or
add thereto, as circumstances require.
c.
Previous Rules and Regulations. All rules and regulations, previously
adopted or promulgated contrary to those embodied in the aforesaid
Manual, are hereby revoked. All other rules and regulations, not in
conflict with those contained in the Manual shall remain in force.
d.
Application of Manual. Police regulations are applicable to all officers
of the Department, and where specified, to all civilian employees
of the Department.
e.
Distribution of Manual. One (1) copy of the Manual shall be distributed
to each member of the Department and to civilian employees of the
Department.
f.
Responsibility for Maintenance. All members and employees who are
assigned a Manual shall be responsible for its maintenance and care.
All Manuals shall be kept current and supplementary pages, concerning
additions, revisions or amendments, shall be promptly and properly
inserted.
g.
Familiarization. Each police officer and each civilian employee are
duty bound to thoroughly familiarize themselves with the provisions
of the Manual. Failure to comply shall be considered a neglect of
duty.
h.
Ignorance of Contents of Manual. In the event neglect of duty is
charged against a member for failure to observe the rules and regulations,
department procedures or orders, ignorance of any provision of the
Manual or any Department procedure of order will not be accepted as
an excuse.

Department members, regardless of rank, and civilian employees,
shall be subject to disciplinary action, according to the nature or
aggravation of the offense, for violating their oath and trust by
committing an offense punishable under the laws or statutes of the
United States, the State of New Jersey, or municipal ordinances; or
for failure, either willfully or through negligence or incompetence,
to perform the duties of their rank or assignment; or for misconduct
in office; or for violation of any general and/or special orders or
rule of the Department; or for failure to obey any lawful instruction,
order, or command of a superior officer. Disciplinary action in all
cases will be decided on the merits of each case and in conformity
with controlling State law.

a.
Pursuant to the Special Law Enforcement Officers' Act, N.J.S.A. 40A:11-146.8
et seq., the terms and requirements of which are incorporated herein
by reference, there is hereby created the position of Special Law
Enforcement Officer in and for the Borough of Allenhurst.
b.
The number of Class I members shall not exceed five (5). The number
of Class II members shall not exceed two (2).
c.
Class I members shall be empowered to issue summonses for those offenses
specified in N.J.S.A. 40A:14-146.11 (a) (1).
d.
All issued uniforms, badges and equipment are Borough property and
shall be immediately returned to the Chief of Police upon termination
or other cessation of employment.
e.
The hourly wage to be paid to Class I and Class II officers shall
be as provided in the salary ordinance.

a.
Regulation of Outside Employment. All private persons or entities
requiring the services of police officers within the official limits
of the Borough of Allenhurst contract directly with the Borough of
Allenhurst.
b.
Wage Rates and Fees.
1.
The hourly rate for contracted police services shall include two
(2) components, the hourly wage rate payable to the police officer
and the hourly administrative fee rate due the Borough of Allenhurst.
2.
Hourly wage rates for contracted police officers shall be in accordance
with the hourly wage rates established, from time to time, by PBA
Local 57 and shall be adopted by resolution of the Board of Commissioners.
3.
The hourly rate for administrative services due the Borough of Allenhurst
shall be $25.00 per hour as set by ordinance.

c.
Payment for Services.
1.
Payment for requested services shall be submitted by private persons
or entities, based on estimates of the work to be done, in advance
of services rendered.
2.
Those private persons or entities which require continuous service
must maintain a minimum balance in an amount equal to the average
amount paid to the police officers within a specified time, such as
monthly, semi-annually, or annually, and would be billed as necessary
to ensure a sufficient balance at all times.
3.
At any time should there be insufficient funds on account to cover
the cost of the services requested, the services should be cut off
until the fund is replenished.
4.
All moneys on account, in excess of the cost of the services, will
be returned by the Borough within a reasonable period.
d.
Accounting.
1.
The Chief Finance Officer shall establish a dedicated by rider trust
fund for the receipt of fees collected from private persons or entities
for the payment of wages and fees.
2.
The financial administration of this program fund shall be handled
in the same manner as the Developers' Escrow Fund. Interest will not
accrue on the funds held in this Escrow Fund.

The Fire Department of the Borough is hereby established within
jurisdictional boundaries coextensive with the boundaries of the Borough
and contract.

The Fire Department of the Borough shall consist of the Allenhurst
Fire Company No. 1, which is comprised of a Chief, two (2) assistants
and such engine members and hook and ladder members as may be nominated
by the Department and approved by the Board of Commissioners.

The Chief and assistants shall be nominated by the Department,
with the approval of the Board of Commissioners.

The Fire Department may adopt such by-laws and regulations for
their government with the approval of the Board of Commissioners,
which shall be subordinate to the ordinances of the Borough, and shall
not be inconsistent with the laws of the Borough.

The firefighters shall constitute one (1) company, and shall
be assigned by the Chief to duty or service on the fire engine or
hook and ladder truck. The Department shall consist of as many members
as the Board of Commissioners shall appoint. The Department shall
nominate and recommend to the Board of Commissioners for appointment
such qualified persons as apply for membership.
No person shall become a member of the Department unless he
or she shall promise to perform the duties of a firefighter, as prescribed
in this section; nor shall any person become a member of the Department
unless that person is nominated by a majority vote of the members
of the Department as a suitable person to be appointed.

Every member of the Department shall receive a certificate of
membership, duly executed and signed by the Borough Clerk and Chief.
Every member shall receive a metallic badge, upon the terms and conditions
hereafter specified. The certificate of membership shall be furnished
to the Chief by the Borough Clerk and shall be delivered by the Chief
to the person entitled to receive the same. The commencement of the
term of service of each person appointed as a member of the Department
shall be from the date of the delivery to him or her of such badge
and certificate of membership.

The Chief shall devote his time and attention to the duties
of his office. The Chief shall examine once a month or more often
if necessary, the engine house, fire engine, fire apparatus and the
public hydrants, water supply, and shall keep in his office a record
of the date of such examination and of the condition in which they
were found by him. The Chief shall, under the direction of the Fire
Committee, direct all ordinary and necessary repairs to the engine
house, fire engine, fire apparatus, any new construction and he shall
certify all accounts for such work. The Chief shall keep a record
of the names of the officers and members of the Fire Department, of
all appointments, resignations and removals of the Firemen, as the
same shall take place. The Chief shall take prompt and efficient measures
to extinguish fires in the Borough, have sole control and command
over the members of the Fire Department, and persons assisting the
Department in cases of fire. The Chief shall inquire into all violations
relating to the prevention or extinguishment of fires and shall prevent
the continuance of the same. He shall investigate the cause of all
fires within the Borough and if the resulting evidence shows there
is good and sufficient cause to believe that the fire was started
by an arsonist, the Chief shall report same to the Mayor who may offer
a reward for the apprehension of the arsonist, to be paid on the conviction
of the person so charged. The Chief shall keep a record of all fire
alarms, and of all fires which may happen within the Borough, the
cause whenever the same can be ascertained, the description of the
building injured or destroyed, the names of the owners or occupants,
the amount of loss in such case, and the amount of insurance, as can
be ascertained with diligent inquiry.
On the first Monday of March and at such other times as the
Commissioners shall require or when the interest of the Department
demands, the Chief shall report the conditions of the public water
supply and hydrants, the engine house and fire apparatus, with any
particulars and make such recommendations as he may deem necessary
and proper.

When attending fires the assistants shall obey the direction
of the Chief. They shall arrange the fire apparatus in an advantageous
manner for the effectual extinguishment of fires. It shall also be
the duty of the Chief and assistants to ensure order is observed by
the members of the Department at all times when on duty. In the absence
of the Chief at any fire, the command shall devolve upon an assistant
according to the regulations established for that purpose.

Whenever there is a fire in the Borough, it shall be the duty
of the firefighters to go to the place where such fire is, unless
otherwise directed by the Chief or an assistant, and then, in conformity
with the directions given by the Chief or assistant, to manage the
fire apparatus, and when the fire is extinguished they shall not leave
except by direction of the Chief or an assistant, and they shall return
the fire apparatus to the engine house. Every person who is not a
firefighter and who is present at a fire shall be subject and obedient
to the orders of the Chief or his assistants or in their absence the
Mayor or Fire Committee of the Board of Commissioners or any member
of the Fire Department acting under their directions in extinguishing
the fires, preserving order and the removal and protection of property.

A firefighter who shall be guilty of misconduct or negligent
of his duties shall be reported by the Chief to the Commissioners
and may be dismissed for such misconduct or neglect of duty. Complaints
made by residents or persons to the Chief, Mayor or any Commissioner
against firefighters for misconduct or neglect shall be reported to
the Board of Commissioners for action. Whenever a report shall be
made against any firefighter, a full opportunity shall be given to
him or her by the Board of Commissioners to be heard at a hearing
but the firefighter may be suspended by the Board until final action
on such complaint.

The Engine, Hook and Ladder truck, and other machines and apparatus
of the Fire Department of the Borough, when driven on any street in
attending any fire or fire alarm, shall have the right-of-way and
all persons driving vehicles on such street shall yield to the same.

The Board of Commissioners shall at all times have the power
to make such rules and regulations as they shall deem best for the
good order and proper discipline of the Department.

All property and equipment of the Fire Department which has
been or is purchased by the Borough shall be and remain the property
of the Borough.

a.
This subsection is enacted pursuant to N.J.S.A. 40:42-1 et seq.,
which directs municipalities to act for the health, welfare and safety
of its citizens and to implement N.J.S.A. 15:8-1.1.
b.
Membership in a Volunteer Fire Company means membership in a Volunteer Fire Company organized pursuant to Title 15 or Title 15A of the New Jersey Statutes, membership in a Volunteer Fire Company or similar organization constituted in a Fire District pursuant to N.J.S.A. 40A:14-70.1, membership in a Junior Fire Fighter's Auxiliary established pursuant to N.J.S.A. 40A:14-95, or nonpaid membership as a part-paid fire department or force established pursuant to Chapter 14 of Title 40A of the New Jersey Statutes.
c.
Any person desiring membership in a Volunteer Fire Company shall
complete in duplicate, filing the same with the Volunteer Fire Company,
an application, the form of which may be prescribed by the Volunteer
Fire Company, but which shall contain the following information about
the applicant:
1.
Name;
2.
Home address;
3.
Birth date;
4.
Social Security number;
5.
Driver's License number;
7.
Any conviction or violation of N.J.S.A. 2C:33-3 False Public Alarms;
8.
Any conviction of a crime or disorderly persons violation;
9.
Such other information as the Volunteer Fire Company deems relevant
to the application provided none of such information is prohibited
by law.
d.
Following the filing of such application, the Volunteer Fire Company
shall transmit one (1) of the applications to the Chief of Police
of the Borough of Allenhurst who shall conduct an investigation to
ascertain the truth of the statements made by the applicant upon his/her
application and any such other investigation of the applicant's background
as he deems necessary for the protection of the public good. If, as
the result of such investigation, the applicant is found to have been
convicted of violation of N.J.S.A. 2C:17-1a, b, c, or/and d or N.J.S.A.
2C:33-3 or any other crime or disorderly persons violation or any
other information that would indicate the applicant may be a threat
to the health, safety or welfare of the Borough, the Chief of Police
shall report such information and the particulars thereof to the Volunteer
Fire Company.
e.
In connection with this investigation, the applicant shall submit
to fingerprinting, and the Chief of Police is authorized to submit
applicant's fingerprints card and request State criminal history record
information from the Division of State Police/State Bureau of Identification
for use in considering the suitability of all applicants covered under
this subsection.
f.
This section is intended to make the Volunteer Fire Company an Authorized
Agency as defined by N.J.A.C. 13:59-1.1.
g.
The investigation by the Chief of Police shall be completed within
thirty (30) days of receipt of the application and the fingerprinting
of applicant.

The Director of the Department of Revenue and Finance shall
be the Commissioner in charge of the Department of Revenue and Finance.

a.
Creation of Office. The office of Chief Financial Officer is hereby
created in and for the Borough of Allenhurst pursuant to the provisions
of N.J.S.A. 40A:9-140.10.
b.
Appointment. The Chief Financial Officer shall be appointed by the
Board of Commissioners and shall serve in accordance with the provisions
of N.J.S.A. 40A:9-140.8.
c.
Qualifications. The applicant for the position of Chief Financial
Officer shall hold a Municipal Finance Officer Certificate.
d.
Supervision. The Chief Financial Officer shall at all times be under
the supervision of and responsible to the Board of Commissioners in
all actions relative to the duties and responsibilities of said office
to the extent not prohibited by law.
e.
Duties. The Chief Financial Officer shall oversee financial operations
of the Borough.
f.
Compensation. The Chief Financial Officer shall receive as compensation
the amount set forth in the salary ordinance.

a.
Appointment; Term. There shall be a Borough Treasurer appointed by
a majority of the Board of Commissioners. The Treasurer shall serve
for a term of one (1) year.
b.
Powers and Duties. The Treasurer shall have, perform and exercise
all the functions, powers and duties as provided by general law and
Borough ordinances. The Treasurer shall keep and maintain books and
records of all financial transactions of the Borough in accordance
with the standards and requirements of the Division of Local Finance
in the Department of Community Affairs of the State of New Jersey.
The Treasurer shall have custody of all public moneys of the Borough
and shall make monthly reports to the Board of Commissioners of all
receipts, expenditures, commitments and unexpended appropriations.
All moneys received from any source by or on behalf of the Borough
or any department, board, office or agency thereof, except as otherwise
provided by Borough ordinance, shall be paid to the Treasurer who
shall, by the next ensuing bank day after their receipt, deposit them
in the authorized public depository of the Borough to the credit of
the proper account.
c.
Deputy Treasurer. There may be a Deputy Treasurer appointed by the
Board of Commissioners to serve at the pleasure of the Board. The
Deputy Treasurer shall assist the Treasurer and shall perform the
duties of the Treasurer in his absence.

There shall be an account to be designated the Borough of Allenhurst
Payroll Account. The Borough Treasurer, on receipt of a check for
an amount due the payroll account, shall deposit it to the credit
of the payroll account, charging the appropriate budgetary accounts
therewith. Disbursement from the payroll account may be made by payroll
checks signed by the Treasurer or, in the Treasurer's absence, by
the Clerk upon pre-audit by the Treasurer and approval by the Board
of Commissioners of the entire payroll. In case of error or adjustment
in the payroll, the Treasurer shall make proper correction and appropriate
record thereof.

a.
Appointment; Term. There shall be a Tax Assessor appointed by a majority
of the Board of Commissioners. He shall serve for a term of four (4)
years from the first day of July next following his appointment.
b.
Qualifications; Tenure. The Tax Assessor shall be qualified by holding
a Tax Assessor Certificate as required by N.J.S.A. 40A:9-148.1 et
seq. A person reappointed to office, after receiving a Tax Assessor
Certificate, and thereafter serving in office for four (4) consecutive
years, shall be entitled to tenure pursuant to N.J.S.A. 54:1-35.31.
c.
Powers and Duties. The Assessor shall:
1.
Have, perform and discharge all the functions, powers and duties
prescribed by law for a Municipal Assessor.
2.
Make assessments for benefits for local improvement and for that
purpose have and exercise the powers and duties of a Board of Assessment
for local improvement as provided by law.
3.
Maintain adequate assessment records of each separate parcel of real
property assessed or exempted.
4.
Maintain a current Tax Map of the Borough as a public record and
cause to be recorded thereon all changes in ownership or character
of the real property assessed, employing for that purpose the facilities
of other departments as provided by the Code.
5.
Report to the Board of Commissioners as to equalization proceedings
and other matters involving the County Tax Board and make recommendations
as to action to be taken in that regard.
d.
Compensation. The Tax Assessor shall receive as compensation the
amount set forth in the salary ordinance.

a.
Creation of Office. The office of Municipal Tax Collector is hereby
created in and for the Borough of Allenhurst pursuant to the provisions
of N.J.S.A. 40A:9-141 et seq.
b.
Appointment; Qualifications; Term; Vacancy; Removal from Office.
1.
The Municipal Tax Collector shall be appointed by a majority of the
Board of Commissioners and shall serve for a term of four (4) years
from the first day of January next following his appointment. Any
person who is appointed as Tax Collector shall hold a Tax Collector
Certificate.
2.
Any vacancy in the office of Municipal Tax Collector shall be filled
by appointment of the Board of Commissioners for the unexpired term
pursuant to N.J.S.A. 40A:9-142.
3.
In the event of the absence or disability of the duly appointed Municipal
Tax Collector, the Municipal Clerk shall perform the duties of that
office during each absence or disability. Such absence or disability
shall be limited to three (3) months, after which time such absence
or disability may be deemed a vacancy.
4.
The Municipal Tax Collector shall not be removed from office except
in accordance with N.J.S.A. 40A:9-145.8.
c.
Duties. It shall be the duty of the Municipal Tax Collector to collect
taxes upon real property in the Borough.
d.
Compensation. The Municipal Tax Collector shall receive as compensation
the amount set forth in the salary ordinance.

The Department of Public Works, Parks and Public Property shall
be under the immediate control and direction of the Director of Public
Works, who is the Commissioner of Public Works.

The Superintendent of Public Works shall be appointed by a majority
of the Board of Commissioners. The Superintendent shall hold such
certifications for the position as required by statute.

The sewer operator shall be appointed by a majority of the Board
