For the purpose of this chapter, certain words and phrases are defined as follows, and certain provisions shall be construed as herein set forth, unless it shall be apparent from their context that they have a different meaning.
A. 
Word usage. Words used in the singular include the plural. Words in the present tense include the future.
B. 
Definitions.
CAMP CAR AND/OR TRAILER
Is any unit used for living or sleeping purposes and which is equipped with wheels or similar devices used for the purpose of trans-porting said unit from place to place, whether by motive power or other means.
A distinction is hereby made between "Camp Car" which shall be transitory in nature and readily towed or driven along a highway and "Camp Ground" which is a place for camp cars to stay for short periods of time. A "Mobile Home or House Trailer" is one which is equipped for year round or permanent living and kept in a "Mobile Home Park" or "House Trailer Park."
It shall be the duty of the Township Committee to enforce all of the provisions of this chapter, and for the purpose of securing enforcement thereof the Building Inspector or any of his duly authorized representatives shall have the right and are hereby empowered to enter upon the premises of any campground now operating or which may hereafter be operated within the Township of Barnegat to inspect the same and all accommodations connected therewith.
It shall be unlawful for any person, firm or corporation to operate or maintain or to offer for public use within the con-fines of the Township of Barnegat, as hereinafter set forth, any campground without first applying for and receiving from the Township Committee a permit so to do, in the manner herein-after provided, or without complying with regulations herein-after set forth or any rules and regulations which may be formulated by the Fire Department relative to the health and safety of residents therein, and the laws of the State of New Jersey.

Each application for such permit shall be in writing, upon a form provided by the Township Committee for that purpose. It shall state the name and address of the applicant and a description of the property whereon or wherein it is proposed to conduct a campground. It shall also contain such other in-formation as the Township Committee may require and it shall be filed by the applicant. It shall be filed with the Township Committee not less than five (5) days nor more than fifteen (15) days before said campground is made ready for use, and it shall be accompanied by a fee of five hundred dollars ($500), for which the Township Committee shall issue a receipt. There shall be an annual fee thereafter for a mobile home park of two hundred fifty dollars ($250) per year plus an occupancy charge of seven dollars ($7) per month for each space to be paid by the park operator to the Township of Barnegat. The park operator must keep his records available to the Township of Barnegat, so that the Township Auditor or other Township designated official may make such inspection as is required.
Upon the filing of such application accompanied by the fee, it shall be the duty of the Township Committee or any of its duly authorized representatives to investigate the premises and determine whether said proposed camp or the site selected therefor confirms with the requirements of this chapter, the rules and regulations of the Township Committee and the laws of the State of New Jersey, and no permit shall be issued unless such campground or the site selected therefor complies with such requirements and meets the approval of the Township Committee, and said Township Committee may at its discretion approve or reject any proposed campground site.
Any permit granted hereunder shall be subject to revocation or suspension by the Township Committee in the following manner, to wit: A notice shall be served on the person holding said permit, specifying wherein he has failed to comply with this chapter and requiring him to appear before the Township Committee at a day and hour therein specified, not less than five (5) days after the personal service of said notice on such permit holder, requiring him to show cause at said time and place why said permit should not be revoked or suspended at the time and place mentioned in said notice; the person holding said permit shall have the right to appear in person or by counsel and to introduce such evidence as he may desire, and the Township Committee shall confront said permit holder with any charges that said Health Department may have against him, and after said hearing the Township Committee may, at its discretion, revoke or suspend the permit.
Such permit shall be transferable upon the written application of the holder of the permit to the Township Committee and with its consent endorsed thereon. A permit may be granted at any time during the year, and unless previously revoked, shall expire one (1) calendar year following the date of issue.
It shall be unlawful for any person, firm or corporation to establish, maintain, conduct or carry on any campground unless there shall be at all times posted in a conspicuous place at said campground the permit obtained from the Township Committee in accordance with provisions of this chapter.
The provisions of this chapter shall be applicable to every campground within the incorporated area of the Township of Barnegat, and it shall be unlawful for any person, firm or corporation maintaining, operating, conducting or carrying on any such campground, or for any person living or sleeping in any camp car and/or trailer located in any campground, or any other person, to violate or contribute in any way to the violation of any of the provisions of this chapter.
Every person owning or operating a campground shall maintain such campground and any toilets, baths or other permanent equipment in connection therewith in a clean and sanitary condition and shall maintain said equipment in a state of good repair.
The Township Committee is hereby empowered to formulate from time to time and to enforce any rules and regulations that said Township Committee may deem advisable governing the operation of campgrounds or camp cars and/or trailers bearing on any matters of sanitation or housing.
Every campground hereafter established shall be laid out with and all existing campgrounds shall provide, available unoccupied space of not less than eighteen by twenty (18 x 20) feet for each camp car and/or trailer, and such available unoccupied space shall not be construed to mean the space directly under any portion of any camp car and/or trailer. Camp cars and/or trailers shall be arranged in rows abutting or facing on a driveway or clear, unoccupied space of not less than twenty (20) feet in width, which space shall have unobstructed access to a public street or alley.
Every campground hereafter established shall be located on a well-drained area and the premises of every such campground or any existing campground shall be properly graded so as to prevent the accumulation of storm or casual waters.
An adequate supply of pure water for drinking and domestic purposes shall be supplied to meet the requirements of the Township Committee. Such water supply shall be obtained from faucets only, conveniently located in said campground, and no dipping vessels or common drinking cups shall be permitted.
It shall be unlawful for any person, firm or corporation owning or operating a camp car and/or trailer located in a campground, individual plot of ground or otherwise, to remove or cause to have removed the wheels or any similar transporting devices from said camp car and/or trailer or to otherwise permanently fix it to the ground in a manner that would prevent the ready removal of said camp car and/or trailer, without first obtaining a permit so to do from the Building Inspector of the Township of Barnegat. Any alteration to any camp car and/or trailer as above set forth shall be construed as removing it from the requirements of this chapter and converting it into a dwelling, and it shall thereupon be subject to the requirements of the Building Code[1] of the Township of Barnegat and the State Housing Act of New Jersey.

There shall be provided in every existing campground and every campground which may hereafter be established, one (1) water closet for each sex: one (1) of such water closets shall be distinctly marked "For Men," and one (1) of such water closets shall be distinctly marked "For Women," and there shall be provided an additional water closet for each sex for every five (5) or fractional part thereof in excess of five (5) males or five (5) females living in said campground, and such water closets shall be properly connected with a sewer; provided, however, that the Township Committee may exempt any campground existing at the time of the passage of this chapter from fully complying with the provisions of this section when, in its discretion, such deviation will not be detrimental to the health of persons occupying said campground or to the proper sanitation of the premises.
There shall be provided in every campground heretofore or hereafter established, such number of tight receptacles with close-fitting metal covers for garbage, refuse, ashes and rubbish as may be deemed necessary by the Township Committee, and such garbage receptacles shall at all times be maintained in a clean and sanitary condition.

In any case where the Township Committee shall have given approval to allow an individual camp car and/or trailer to be parked within the territorial limits of Barnegat Township and the owner of said camp car and/or trailer park, the license fee shall be five dollars ($5) per year per person for the privilege of parking said trailer.
Every campground heretofore or hereafter established shall be provided with means of lighting the same at night, and all public water closets and bath units shall be provided with sufficient lighting facilities which shall be kept lighted during the time from one-half (1/2) hour after sunset until one-half (1/2) hour before sunrise.
In the case of an individual camp car and/or trailer, said owner or person in custody of said camp car and/or trailer must apply to the Building Inspector for a permit, said permit to cost five dollars ($5) per person for each person occupying said trailer and shall be for a period of one (1) year from the date of its issuance and shall be paid in advance, and there shall be no refund for periods of less than one (1) year.
Every person, firm or corporation violating or contributing in any way to the violation of any provision of this chapter shall be deemed guilty of a separate offense for each day during which such violation continues, and shall be punishable therefor as herein provided.

It shall be the duty of every person, firm or corporation owning, leasing, renting or operating a campground in the Township of Barnegat to comply with all the provisions of this chapter and/or any rules and regulations formulated by the Township Committee and/or Fire Department governing campgrounds; and any such person, firm or corporation violating any of the provisions of this chapter or said rules and regulations, or contributing in any way to the violation thereof, shall, upon conviction hereof, be punished by a fine not exceeding five hundred dollars ($500) or by imprisonment in the county jail not exceeding ninety (90) days, or by both such fine and imprisonment. Each day that a violation of any of the terms and provisions of this chapter is continued shall constitute a separate offense.
