Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Saving Time as may be in current use in the borough.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY-NO PARKING signs are displayed. The chief of police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY-NO PARKING signs when weather conditions, accidents, fires and public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that the EMERGENCY-NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in § 7A-1 Schedule I attached to and made a part of this chapter.

No person shall park a vehicle between the hours specified in § 7A-4 Schedule II of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in § 7A-4 Schedule II attached to and made a part of this chapter.

No person shall stop or stand a vehicle between the hours specified in § 7A-9 Schedule III of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in § 7A-9 Schedule III attached to and made a part of this chapter.

a. 
No person shall park a vehicle for longer than the time limit shown in § 7A-10 Schedule IV at any time between the hours listed in § 7A-10 Schedule IV of any day upon any of the streets or parts of streets described in § 7A-10 Schedule IV attached to and made a part of this chapter.

b. 
Exemptions. The Chief of Police shall be permitted on an annual basis to issue to any qualifying active volunteer member, as defined in § 32-1.2, a permit exempting them from the provisions of § 7A-10 Schedule IV related to overnight parking only. Said permit shall be valid for one calendar year and shall only be issued and in effect so long as said active volunteer member qualifies as the same. Any authorized Borough of Bogota volunteer who is not covered by Chapter 32 benefits shall be eligible for a permit under this section upon certification of their department head that they have participated in at least 50% of the calls.

Notwithstanding any other provisions of section 7-3 of this chapter, parking shall be permitted at the times and places specified in § 7A-36 Schedule XX attached to and made a part of this chapter.

Pursuant to N.J.S.A. 39:4-135, angle parking of motor vehicles shall be permitted on the streets or parts thereof described in § 7A-37 Schedule XXI attached to and made part of this chapter.

No person, except as designated, shall park a vehicle between the hours specified in § 7A-38 Schedule XXII upon any parking space as specified therein.

a. 
No vehicle shall be parked on any streets or highways or portions thereof whenever snow has fallen and the accumulation is such that at least two (2) inches of snow cover the street or highway.
b. 
The above parking prohibitions shall remain in effect after the snow has ceased to fall and until the streets have been plowed sufficiently so that parking will not interfere with snow removal activities and with the normal flow of traffic.

No person shall park or stand any vehicle, except a bus waiting to pick up or drop off passengers, in any area or portion thereof designated as a bus stop in § 7A-28 Schedule XII attached hereto and made a part hereof.

All motor vehicles bearing the plates of the Municipal Government of the Borough of Bogota, which are assigned to or part of the emergency services of the Municipality, which include and are not limited to the fire department, fire prevention bureau, rescue squad, ambulance squad and police department are hereby permitted to park on any street in the Borough of Bogota at any time without any limitation or restriction, unless an emergency has been declared for the particular street.

No person shall park a vehicle so that any part of the vehicle is not within any parking space that is marked by lines on the pavement as marked upon any of the streets or parts of streets described in § 7A-18 Schedule IV H attached to and made a part of this chapter.

Trucks having a gross vehicle weight of over four tons are hereby excluded from the streets or parts of streets described in § 7A-20 Schedule V except for the pick up and delivery of materials on such streets. Schedule V being attached to and made a part of this chapter.

Pursuant to N.J.S.A. 40:67-16.1, the streets or parts of streets described in § 7A-21 Schedule VA attached to and made a part of this chapter are hereby designated as a Route for Trucks Over Four Tons. All trucks having a total gross vehicle weight in excess of four tons shall be excluded from all streets except from those streets which form a part of the system of truck routes.
No trucks shall be prevented from making deliveries of merchandise or other property along streets from which trucks are excluded and no truck shall be excluded from any street in the borough used by public utility companies in connection with the construction, installation, operation or maintenance of public utility facilities.

Any person who is convicted of violating the provisions of § 7-4 herein shall be subject to a fine of $250 for a first offense, plus court costs, $350 for a second offense, plus court costs, and $500 for a third or subsequent offense, plus court costs.

The streets or parts of streets described in § 7A-22 Schedule VI attached to and made a part of this chapter are hereby designated as one-way streets in the direction indicated.

Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in § 7A-23 Schedule VII attached to and made a part of this chapter are hereby designated as Through Streets. STOP signs shall be installed on the near right side of each street intersecting the Through Street except where YIELD signs are provided for in the designations.

No person shall make a right turn when facing a steady red signal (STOP) indication whenever an official sign is present prohibiting such turn on the red signal as described in § 7A-32 Schedule XVI.

Any person shall make a right turn only at any of the locations described in § 7A-39 Schedule XXIII attached hereto and made a part of this chapter.

No person shall park a vehicle in a parking space designated and marked as being set aside for the physically handicapped, as set forth in § 7A-33 Schedule XVII, unless the vehicle shall have affixed thereto an identification certificate or marker issued by the New Jersey Director of the Division of Motor Vehicles. Parking in such a space without the aforesaid vehicle identification shall create a rebuttable presumption that use of the space was not for the physically handicapped.
a. 
Public property. Parking spaces for the physically handicapped may be designated on public streets and parking lots and on parking lots open to the public or to which the public is invited, in accordance with the guidelines set forth in subsection 7-11c.
b. 
Private property. In addition to paragraph a, any person, partnership, association or corporation owning, leasing or occupying property as hereinafter provided, may establish restricted parking spaces for physically handicapped persons on such property and after approval of same by ordinance of the mayor and council, may request and receive enforcement of these parking restrictions by the police department.
c. 
Guidelines for construction and location. Spaces reserved for handicapped parking shall be twelve (12) feet wide, marked with blue lines and the International Symbol of Access shall be painted on the center of each such space. In addition each space or group of spaces shall be identified with a clearly visible sign displaying the International Symbol of Access along with the following words "This space reserved for the physically handicapped only."
d. 
Any person who violates any provision of this section shall, upon conviction thereof, be punished by a fine of two hundred fifty ($250.00) dollars for the first offense and, for subsequent offenses, a fine of at least two hundred fifty ($250.00) dollars and up to ninety (90) days community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.
No person shall park a vehicle at any time in the areas designated as fire zones as described in § 7A-34 Schedule XVIII.
Vehicles may stop in such lanes, however, under the following circumstances:
a. 
A vehicle may stop to discharge or pick up passengers in a fire lane providing that the engine remains running and the driver remains at the wheel at all times;
b. 
A vehicle may load or unload goods in a fire lane providing:
1. 
The enterprise to or from which they are moving goods has no other entrance usable for such purposes or designated loading area; and
2. 
The vehicle remains running and unlocked so that it can be moved in case of emergency; and
3. 
If the vehicle is over fifteen (15) tons in gross weight, the driver shall remain with the vehicle at all times to operate it in case of emergency.
c. 
Vehicles violating this subsection shall be subject to being towed and impounded at the owner's expense at the direction of a member of either the Bogota Police Department or of the bureau of fire prevention, provided that no such vehicle shall be towed unless a proper sign has been erected and is in place designating the fire zone as a tow-away zone.

The lane locations described in § 7A-35 Schedule XIX attached to and made a part of this chapter are designated as "Lane Use Reservations" and traffic shall move only as directed.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this ordinance or any supplement thereto shall be liable to a penalty or not more than fifty ($50.00) dollars or imprisonment for a term not exceeding fifteen (15) days or both.

Pursuant to N.J.S.A. 40:67-16.7 the Mayor of the Borough of Bogota is hereby authorized to close by regulation any portion of any street within the block on which is located any public or private school if he shall find that a safety problem exists for ingress and egress of any such school or for the provision of recreational facilities for children attending such schools, or both, due to lack of a suitable area surrounding the school.

Such portion of such street shall be closed for use of through traffic during such time as he shall determine, not to exceed one (1) hour between 7:30 a.m. and 10:00 a.m., two (2) hours between 11:00 a.m. and 2:00 p.m. and one (1) hour between 2:30 p.m. and 4:30 p.m. on any days upon which such school is in session.

Proper warning signs and temporary barriers shall be posted in said street indicating that said street is so closed, and the reason therefor, during the time when the same is closed.

No regulation established pursuant to this section shall be effective unless and until it shall have been approved by the commissioner of the department of transportation.

Any violation of any regulation established pursuant to this section shall be deemed a violation of this chapter and shall be punishable as such.

The following agencies and/or property owners have filed a written consent with the Borough of Bogota that the provisions of Subtitle One, Title 39 of the Revised Statutes of New Jersey be made applicable to the semipublic roads, streets, driveways and parking lots, located in the Borough of Bogota, County of Bergen and the following regulations and provisions shall be enforceable:
I. 
All vehicles must park only in designated areas between the lines provided.
II. 
Handicapped Parking. All stalls shall be twelve (12) feet wide as shown on the attached site plan[1] and signed with R7-8 (Reserved parking sign and penalty plate), in the designated parking areas for persons who have been issued the Handicapped Parking permits by the Division of Motor Vehicles.

III. 
Reserved Parking. The parking lot has reserved parking for various types of vehicles which must be properly identified as per site plan.[2]

IV. 
Tow Away. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exit ways, loading zones, oil filling areas, any grass area, pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicle at the owner's or operator's expense.
V. 
All signs, posts, bolts, or other necessary materials shall be installed and paid for by the applicant property owner. Work shall be checked by the police department to insure that installations meet State and Federal specifications, and all signs shall conform to the current Manual on Uniform Traffic Control Devices.
VI. 
Speed Limits.
1. 
The speed limits for both directions of traffic in the parking lots shall be fifteen (15) mph.
2. 
Regulatory and warning signs shall be erected and maintained to effect the above designated speed limits authorized by the Department of Transportation.
VII. 
One Way Entrance and Exit. The following described entrance and exit as shown on each respective site plan[3] are hereby designated as one-way in the direction indicated.

VIII. 
Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this section or any supplement thereto, shall be liable to a penalty of: a) first offense, one hundred ($100.00) dollars; b) second or subsequent offenses, not less than one hundred ($100.00) dollars nor greater than one thousand ($1,000.00) dollars plus community service up to ninety (90) days or imprisonment for a term not exceeding fifteen (15) days or both.
IX. 
Effect of Regulations. If any part of this regulation is for any reason held to be invalid, such decision shall not effect the validity of the remaining portion of the regulation.
X. 
Fee Owners. The following parcels and/or individuals shall be subject to the specific provisions of this Ordinance:
(A) 
Bogota High School.
Subject to Provisions I, II, IV, V, VI, VII, IX;
(B) 
Bogota Swim Club.
Subject to Provisions II, III, IV, VIII, XI;
(C) 
Borough of Bogota/Municipal Police and Fire Complex.
Subject to Provisions I, II, III, IV, V, VIII, IX;
(D) 
Bogota Recreation Center.
Subject to Provisions I, II, IV, V, VI, VII, VIII, IX;
(E) 
Bogota Savings and Loan.
Subject to Provisions I, II, IV, V, VI, VII, VIII, IX;
(F) 
Welch Farms.
Subject to Provisions I, II, IV, V, VIII, IX;
(G) 
Classic Launderette.
Subject to Provisions I, II, IV, V, VI, VIII, IX;
(H) 
Kenbee Realty for Quick Check Rite Aid.

All parcels and fee owners who are subject to this section shall receive from the borough clerk within twenty (20) days of adoption of this section, the site plan prepared by the Department of Transportation, and shall, at their sole cost and expense, undertake any and all improvements to comply with the site requirements delineated thereon.
