The purpose of this chapter is to reduce hazardous traffic conditions resulting from the use of streets within areas reserved for residential use for the parking of vehicles by persons using districts zoned for commercial and the business uses, to protect those districts from polluted air, excessive noise, and trash and refuse caused by the entry of such vehicles, to protect the residents of those districts from unreasonable burdens in gaining access to their residences; to preserve the character of those districts as residential districts; to promote efficiency in the maintenance of those streets in a clean and safe condition, and to reduce the use of streets within areas zoned for residential uses for the parking of vehicles used by all-day commuters and to thereby encourage car pooling. In order to promote these goals the board of commissioners of the Township of Lyndhurst ordain the following.

A resident parking program shall be instituted as follows:
a. 
From 9:00 a.m. through 5:00 p.m. on Monday through Friday, excluding Saturday, Sunday and holidays (New Year's Day, Lincoln's Birthday, Presidents' Day, Memorial Day, July 4th, Labor Day, Thanksgiving Day and Christmas) on the streets of Lyndhurst listed on the attached Schedule A[1] which streets will be designated resident parking permit only.

b. 
From 10:00 p.m. through 3:00 a.m. each day, including weekends and holidays, on the streets of Lyndhurst as listed on the attached Schedule B[2] which streets will be designated resident parking permits only.

The following rules and regulations shall apply to the Lyndhurst Resident Permit Parking Program:
a. 
A resident parking permit tag of a design specified by the public safety department will be issued to the resident owner of the vehicle. The permit tag shall display the zone in which the vehicle may park. The vehicle must be owned by a person residing in the zone specified in Schedule A of Chapter 7A in the Township of Lyndhurst and have a gross weight of no more than 2 1/2 tons. The resident tag shall permit the resident to park on the street only in the zone for which the permit is issued.
b. 
Proof of residency of the owner of a vehicle must be presented when applying for a permit. The following is acceptable proof of residency:
1. 
A copy of a valid New Jersey driver's license reflecting an address within Lyndhurst; and
2. 
A copy of a valid New Jersey motor vehicle registration for the vehicle for which the permit is sought showing an address within Lyndhurst. In the case of a vehicle claimed to be leased and used by a Lyndhurst resident, a copy of a valid motor vehicle registration and a copy of the automobile lease shall be presented to the township in lieu of the New Jersey motor vehicle registration.
c. 
The resident's tag is to be placed on the rear view mirror of the registered vehicle.
d. 
The public safety department shall have the authority to issue temporary resident permit parking stickers to persons who reside on streets marked "Permit Parking Only" who (1) show proof of residence in the township satisfactory to the department, including, but not limited to, deed, lease, letter from landlord or owner, or utility bills, but who have not yet changed their driver's license or their motor vehicle registration to reflect the Lyndhurst address, or (2) hold a current resident permit tag but whose vehicle has been stolen or incapacitated and who is driving a temporary vehicle. The temporary sticker shall be valid for a period not to exceed 90 days, at which time the resident must obtain a permanent tag by presentation of the proofs of residency set forth in subsection 7A-3b above. Temporary permits are valid only within one block of the resident's address.

a. 
One annual visitor permit of a design specified by the public safety department shall be issued to any resident who meets one of the following qualifications:
1. 
The resident owns a vehicle which qualifies for a resident parking permit; provided, however, that no other person residing in the same household as the resident has been issued a visitor permit; or
2. 
In a household where the residents do not have a car, a current utility or phone bill in the name of one of such residents, or a notarized lease inclusive of utilities in the name of one of such residents (valid for at least one year) is presented to the public safety department provided, that no other person in the same household has been issued a visitor permit; or
3. 
A household in which the residents own a vehicle which has not been issued a resident parking permit will be issued one visitor permit for use on their visitor's vehicle only.
b. 
A visitor permit will not be issued to anyone residing in any building exclusively used by students and affiliates of a college.
c. 
Additional visitor permits, in numbers as specified by the public safety department, may be issued to doctors, dentists, and lawyers, and other professionals upon written request. The request must be sent on the applicant's business letterhead and there must be no off street parking available in the area of the applicant's place of business.

a. 
One visitor permit shall be issued per household for use by visitors only, while visitors are actually visiting the household to which the permit was issued. The presumption shall be that any vehicle parked more than one block from the household for which the visitor permit has been issued shall not be visiting such household.
b. 
All visitor permits are to be displayed on the front dashboard above the steering wheel and must be fully readable from the exterior of the vehicle. A visitor permit should be returned to the resident at the conclusion of the visit as it will not be replaced if lost.
c. 
One temporary visitor permit may be requested in writing to the public safety department. A temporary visitor permit will be issued for a specific period of time and the expiration date will appear on the front of the temporary visitor permit.

The temporary visitor permit shall require the vehicle identification number and license plate of the vehicle, the driver's license number and such other information as may be required by the department of public safety.

a. 
Business establishments located in the Township of Lyndhurst may obtain business permits for any non-resident employee of such business establishment who commutes to work by automobile, in accordance with the provisions of this section.
The permit shall be limited to the hours during which the nonresident employee works. In order to obtain such permits, the business establishment must present a letter to the public safety department verifying that there is no adequate off-street parking available to the employee. The letter shall list the name of the employee, the vehicle identification number and the license number, the employee, and such other information as may be required; which information shall be placed on the permit.
b. 
All written requests for business permits shall be executed by a responsible officer of the employer. The public safety department shall be entitled to obtain periodic verification of all relevant information and shall have the power to invalidate or not renew any business permit issued pursuant to this section if the information indicates nonentitlement to the business permit or requested information to verify entitlement is not furnished.

a. 
Any abuse in the use of a visitor permit or business permit will result in its revocation in the following circumstances:
1. 
Any such permit is used on any vehicle owned and controlled by a resident; or
2. 
The extended use of a visitor permit by a visitor without prior approval of the public safety department.
3. 
Any such permit is used on a car other than the car originally issued the permit.

a. 
There is no permit fee.
b. 
A fee of $5 will be charged for the replacement of a lost tag.

Resident permits, and visitor permits will expire annually as reasonably determined by the public safety department. Any vehicle bearing an expired resident permit, visitor permit, or temporary visitor permit, and parked on a street posted "Permit Parking Only" shall be subject to the same penalty as a vehicle parked on the street without a resident permit, visitor permit or temporary visitor permit.

Any vehicle parked on a street posted "Permit Parking Only" without a valid resident permit, visitor permit, temporary visitor permit, shall be subject to a parking fine of $50. Persons who engage in the unlawful or unauthorized use of resident permits, visitor permits, or temporary visitor permits are subject to revocation of the permits for one year and a $100 fine.

Any vehicles parked in a resident permit parking only zone (as defined in this chapter) without a valid resident permit, visitor permit, or temporary visitor permit, will have two hours grace period after which they will be ticketed.
