The following words, as used in this chapter, shall have the following meanings hereby respectively ascribed thereto:
PERSON
Any natural person, partnership, association or corporation.
WEEDS
Any Canadian or Russian thistle, chicory, burdock, nettle, poison ivy, sumac, goldenrod, wild lettuce, wild mustard, wild parsley, ragweed, milkweed or any other plant or vegetation whatsoever, not edible or planted for an ornamental or agricultural purpose.
Every person owning or occupying land within Lower Pottsgrove Township shall cut or remove, or cause to be cut or removed, all grass and weeds in excess of eight inches in height; provided, however, this requirement shall not apply to grass or grain grown for purposes of cutting and harvesting for hay or other agricultural purposes; provided, further, this requirement shall not apply to land located in a Floodplain Conservation District.
Written notice shall be given by personal service or by mail to the last known address of the owner or occupant in violation of the provisions of this chapter, directing and requiring such owner or occupant, as the case may be, to cut or remove all such grass or weeds so as to conform to the requirements of this chapter within five days after the date of this notice. In case any person shall neglect, fail or refuse to comply with the notice within the specified time, the Board of Commissioners may cause such grass or weeds to be removed or cut and the cost thereof, together with such maximum penalty as may be authorized by law, to be collected from such person as a municipal claim or in any other manner provided for by law. The written notice provided in this section may be given by the Code Enforcement Officer, or any such person as the Board of Commissioners may, from time to time, designate, authorize and direct.
Any person who shall violate any provisions of this chapter shall, upon conviction thereof, be sentenced to pay a fine not exceeding. $600 plus cost of prosecution. Each day that a violation of this chapter continues shall constitute a separate offense.
If any sentence, clause, section or part of this chapter is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any part of the remaining provisions, sentences, clauses, sections, or parts of this chapter. It is hereby declared as the intent of the Lower Pottsgrove Township Board of Commissioners that this chapter would have been adopted had such unconstitutional, illegal, or invalid sentence, clause, section or part thereof, had not been included herein.
