The Borough of West Reading hereby adopts the intergovernmental cooperation agreement for the Township of Spring to provide fire inspection services for commercial properties located in the Borough of West Reading, fire investigation services for properties located in the Borough of West Reading and special event services for special events held in the Borough of West Reading in accordance with the authorization of the Act of December 19, 1996 P.L. 1158, No. 177, § 1 et seq. Said intergovernmental cooperation agreement is attached to this Ordinance as Exhibit A (hereinafter referred to as "Exhibit A" or the "agreement").[1]

The acceptance by the Borough of West Reading of the provisions of the agreement with Spring Township shall continue in effect until terminated by a subsequent ordinance of the Borough Council of The Borough of West Reading or the Township of Spring or any subsequent member municipality. The agreement entered into by these municipalities shall be binding upon Borough of West Reading and Township of Spring.
The purpose of this intergovernmental cooperation agreement shall be to allow the parties to cooperate in the provision of the following by Spring Township: fire inspection services for commercial properties, fire investigation services related to properties, and special event services for special events.
The cost for services rendered pursuant to the agreement shall be as set forth in the agreement and any amendments thereto.
A. 
The Borough of West Reading shall provide worker's compensation insurance for any and all of its employees engaged in performing work under the terms and conditions of this ordinance or Exhibit A.
B. 
Spring Township shall provide worker's compensation insurance for any and all of its employees engaged in performing work under the terms and conditions of this ordinance or Exhibit A.
C. 
At no point in time under the agreement shall employees of one municipality be construed to be in the employ or service of another municipality.
D. 
General liability insurance for machinery, vehicles and equipment shall be maintained by the municipality that owns said machinery, vehicles and equipment.
The organizational structure necessary to implement this agreement is as set forth in the agreement.
Any real or personal property acquired by either the Township of Spring or the Borough of West Reading in furtherance of the goals and objectives of the agreement shall remain the property of the acquiring municipality, unless otherwise agreed to in a subsequent writing.
