Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a. 
The Chief of Police or, in his/her absence, disability or inability to act, the ranking member of the Police Department, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police and in accordance with paragraph a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a minimum fine of $500.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute, or by this chapter every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not less than $100 nor more than $200 or imprisonment for a term not exceeding 15 days, or both, together with court costs.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

The Governing Body finds and declares that problems of traffic control occur and traffic must be moved through or around street construction, maintenance operations and utility work, above or below ground, which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through and around construction and maintenance zones and to provide safety for the work force performing these operations.
The Township of Piscataway, in the County of Middlesex, State of New Jersey, does hereby adopt the current Manual on Uniform Control Devices for Streets and Highways hereafter known as the M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor or utility who fails to comply with the provisions of the M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility as required under the public utility agreement, wishing to conduct work on, under or above the roadway to contact the Police Department in order to arrange a preconstruction meeting in order to submit plans for the safe movement of traffic during such period of construction or work. Any person, contractor or utility who fails to comply with this section prior to the start of such work, or whose plans are not approved by the Police Department of the Township of Piscataway is in violation of this section.

The person, contractor, or utility shall provide the Police Department with at least two emergency contact telephone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If, for any reason, emergency contact cannot be reached, or if the emergency contact person does not respond to a call from the Police Department to correct such hazardous condition, the Township may respond to correct the hazardous condition(s). The reasonable fees for such emergency services by the Township shall be charged to the person, contractor, or utility responsible for the condition.

There shall be no construction, maintenance operations, or utility work on any roadway in the Township before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the officer in charge of the Police Department. If it is determined by the officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

Road closings and/or traffic detours shall not be permitted unless approved by the Township Police Department.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Township Police Department that same is necessary to provide for the safe and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights, devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense, pay a fine of not less than $250 nor more than $1,000 and/or be imprisoned in the County jail for a term not exceeding 90 days. For a second offense, the person, contractor or utility shall, upon conviction thereof, pay a fine of not less than $1,000 and/or be imprisoned in the County jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

Any motor vehicle that is located on the exterior portion of a person's property must be both registered and operable.

The parking of no more than two motor vehicles on the non-paved areas of the front and/or side yard of the principal property is permitted for a period of no longer than 24 hours.

a. 
Definitions.
ELECTRIC VEHICLE
Means any vehicle that is licensed and registered for operation on public and private highways, roads, and streets; and operates either partially or exclusively using an electric motor powered by an externally charged on-board battery.
ELECTRIC VEHICLE SUPPLY/SERVICE EQUIPMENT OR (EVSE)
Means the equipment, including the cables, cords, conductors, connectors, couplers, enclosures, attachment plugs, power outlets, power electronics, transformer, switchgear, switches and controls, network interfaces, point of sale equipment, and associated apparatus designed and used for the purpose of transferring energy from the electric supply system to a plug-in electric vehicle. "EVSE" may deliver either alternating current or, consistent with fast charging equipment standards, direct current electricity. "EVSE" is synonymous with "electric vehicle charging station."
b. 
Publicly-accessible EVSE shall be reserved for parking and charging electric vehicles only. Electric vehicles shall be connected to the EVSE.
c. 
Electric vehicles may be parked in any parking space designated for parking, subject to the restrictions that would apply to any other vehicle that would park in that space.
d. 
Public Parking. Pursuant to N.J.S.A. 40:48-2, publicly-accessible EVSE parking spaces shall be monitored by the State, county, or municipal law enforcement officers or parking enforcement officers shall enforce the parking restrictions enforced in the same manner as any other parking. It shall be a violation of this section to park or stand a non-electric vehicle in such a space, or to park an electric vehicle in such a space when it is not connected to the EVSE. Any nonelectric vehicle parked or standing in a EVSE parking space or any electric vehicle parked and not connected to the EVSE shall be is subject to fine and/or impoundment of the offending vehicle as described in the penalties provisions of this chapter.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Mayor or the Mayor's designee is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fires or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.
c. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.
d. 
The minimum penalty for a violation of this section shall be, upon conviction, a fine of $250.

a. 
Whenever snow has fallen and the accumulation is such that it covers the street or highway, an emergency shall exist and no vehicles shall be parked on the following streets or highways or portions thereof listed below which are located within the Township of Piscataway.
The parking prohibitions listed below shall remain in effect after the snow has ceased, until the streets have been plowed significantly, and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

a. 
Definitions.
PARKING METER
Shall mean any mechanical device or meter placed or erected for the regulation of parking. Each parking meter installed shall indicate by proper legend the legal parking time and, when operated, shall at all times indicate the balance of legal parking time and, at the expiration of such period, shall indicate illegal or overtime parking.
PARKING METER SPACE
Shall mean any space within a parking meter zone, which is adjacent to a parking meter and which is duly designated for the parking of a single vehicle by lines painted or otherwise durably marked on the curb or on the surface of the street or lot adjacent to or adjoining the parking meters.
b. 
Use of Meter and Space. No person shall park a vehicle in any parking space alongside, next to, or abutting, where a parking meter has been installed during the restricted and regulated time applicable without depositing the appropriate legal coin or coins as hereinafter provided, or shall have previously deposited therein for an unexpired interval of time.
No person shall permit a vehicle within his control to be parked in any such parking meter space during the restricted and regulated time applicable to the parking meter zone in which such meter is located while the parking meter for such space indicates by signal that the lawful parking time in such space has expired.
No person shall park a vehicle in any such parking meter space for a consecutive period of time longer than that limited period of time for which parking is lawfully permitted in the space, irrespective of the number of amounts of the coins deposited in the meter.
c. 
Overtime Parking. No person shall cause, allow, permit or suffer, any vehicle registered in the name of, or operated by such person to be parked overtime or beyond the period of legal parking time established for any parking meter zone, as herein described.
No person shall permit a vehicle to remain or be placed in any parking space adjacent to any parking meter while the meter is displaying a signal indicating the vehicle occupying such parking space has already been parked beyond the period of time prescribed for such parking space.
d. 
Designated Area. The provisions of this Section B. shall have applicability solely to those parking meter spaces set forth on a plan entitled "UMDNJ, Piscataway Campus, SP 1 & 2, Site Plan, dated 9-24-1990," a copy of which is on file at the Office of the Township Clerk.
e. 
Hours of Operation. Meters shall be in operation Monday through Friday, from 5:00 a.m. to 6:00 p.m.
f. 
Fee. The fee for metered parking shall be $0.25 per 15 minutes.
g. 
Violations and Penalty. Any person violating this section shall be subject to a fine of $35 per violation.

No vehicles are parked on the streets or parts of streets designated in subsection 7-17.8, Schedule of Residential Permit Parking Areas, during the hours designated in the schedule, unless:
a. 
The vehicle is owned or operated on a regular basis by a resident of that street and the vehicle has displayed a current residential parking permit on its left rear window in such a manner as to be closely examined by a Police Officer; or
b. 
The vehicle falls under one of the exemptions to the parking ban set forth in subsection 7-17.2.

The following vehicles are exempt from this parking permit section.
a. 
Visitors. A vehicle displaying a current visitor parking permit may park a maximum of two days provided that the operator of the vehicle is a bona fide guest of a residence within the permit parking area. The visitor's permit is displayed on the left rear window of the vehicle in such a manner as to be clearly visible to a Police Officer enforcing parking regulations.
b. 
Contractors, Service and Delivery Vehicles. Contractors, service, and delivery vehicles bearing the name and address of a commercial business may park without a permit during the time they are rendering service to a residence within the permit parking area.
c. 
Emergency Vehicles. Emergency vehicles and public service, telephone, cable, internet, and other public utility vehicles may park within the permit parking area during the time they are rendering service of repairs within the permit parking area.

Whenever the Business Administrator, or his or her designee, shall determine that certain streets exclusively or primarily servicing residential land uses, or portions of such streets, are being used for parking by the operators of vehicles who do not reside on the streets, and that the average number of such vehicles parking in such manner is in excess of 25% of the number of parking spaces on such streets and that the total number of parking spaces actually occupied exceeds 65% of the total number of parking spaces on such streets on the weekdays of any month, as disclosed by an engineering or traffic study, then the Business Administrator or his or her designee shall recommend to the Township Council that such streets be included within this section.

Applications for parking permits under this section are made in writing on forms provided to the Business Administrator, or his or her designee. Permits are granted only under the following terms and conditions:
a. 
To persons who are residents on the street or portion upon which parking is restricted by this section, a permanent permit, valid for up to a year for tenants and three years for owner-occupants, may be issued for every vehicle owned or principally operated by such person.
b. 
One visitor permit may be issued for each residential unit in a structure or any street or portion upon which parking is restricted by this section for use by visitors to a resident of a residential dwelling unit within such structure subject to a maximum of two permits per structure. A multi-family structure which is owner-occupied may be issued one additional visitor permit. Such visitor permit must be obtained by and issued to the owner of the structure and will be valid for a period of one year. Such permits may be renewed for succeeding years or months as needed.

a. 
No person, unless authorized by virtue of his or her employment, shall:
1. 
Copy, reproduce or otherwise create a resident parking permit or a visitor parking permit authorized by this Section;
2. 
Create a facsimile or counterfeit resident parking permit or visitor parking permit;
3. 
Display or use a resident parking permit or visitor parking permit knowing the same to have been copied, reproduced or otherwise created in violation of paragraphs 1 or 2 above.
b. 
No person shall furnish false information or fraudulent documents in connection with an application for a resident parking permit.
c. 
Any person violating the provisions of paragraphs a or b above shall be liable to a fine not to exceed $500 and/or imprisonment for not more than 10 days and forfeits the right to receive or use a parking permit under this section for a period of three years.
d. 
No permit authorized may be issued to a person with three or more outstanding summonses for violations of this section.

A resident parking permit does not exempt a resident from obeying all traffic rules and regulations including but not limited to parking too close to stop signs or intersections, or parking in a no parking zone.

All parking of motor vehicles upon and along the roadways and parking areas of all structures owned by the Township of Piscataway, including the Piscataway Municipal Complex, the John F. Kennedy Memorial Library, the Joanna F. Westergard Library, and the Piscataway Senior Citizen Center, the Little League Complex, the Academy Street Recreation Facility, the Fire Training Center, the Police Substation, as well as on all vacant lots owned by the Township of Piscataway, is prohibited. Parking shall be permitted only in areas specifically designated and marked for this purpose; and only between the hours of 7:00 a.m. and 10:00 p.m.
b. 
Such signs as required by N.J.S.A. 39:4-198 shall be erected to designate parking and no-parking areas.
c. 
The Police Department of the Township of Piscataway is hereby authorized to enforce the provisions of this subsection.
d. 
The time restrictions imposed pursuant to paragraph a above shall not apply to any Township employee actively employed in a Township facility appurtenant to the parking area in which their vehicle is parked. The time restrictions imposed pursuant to paragraph a above shall not apply to the vehicle of any individual attending a meeting or other activity in a Township facility appurtenant to the parking area in which their vehicle is parked.
e. 
Pursuant to the authority of N.J.S.A. 39:5A-1, as approved by the New Jersey State Department of Transportation, the Township of Piscataway may enforce and apply Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey upon parking areas appurtenant to the Piscataway Municipal Complex, the John F. Kennedy Memorial Library, the Johanna F. Westergard Library, the Piscataway Senior Citizen Center, the Little League Complex and the Academy Street Recreation Facility.

The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Piscataway.

A. Parking. No person shall park a vehicle at any time upon the following portions of the driveways to Redbud Park.
1. West side of the north driveway entrance to Redbud Park.
2. East side of the south driveway to Redbud Park.
In accordance with 40 U.S.C. § 318B and a written request from the Postmaster, the following various traffic regulations are hereby made applicable to the properties listed below as follows. No person shall operate or park a vehicle in violation of the regulations listed below.

The owners of the premises referred to in subsections 7-40.2 and 7-40.3 shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual On Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Piscataway. The owner shall be responsible for the repair and restoration or replacement of same.

The provisions of this chapter shall apply to electric scooter operation and placement upon any street or upon any public right-of-way within the Township of Piscataway, subject only to those exceptions stated in this section. Where the provisions of this chapter contradict and/or overlap with any state laws, the state law shall govern.

As used in this chapter, the following terms shall have the meanings indicated:
ELECTRIC SCOOTER
Means a scooter with a floorboard that can be stood upon by the operator, with handlebars, and an electric motor that is capable of propelling the device with or without human propulsion at a maximum speed of 19 miles per hour.
OWNER
Means any company, entity or individual that has ownership of an electric scooter.
PRIVATE ELECTRIC SCOOTER
Means any electric scooter owned and operated by a private individual.
SHARED ELECTRIC SCOOTER
Means any electric scooter owned by a company authorized and permitted by the Township of Piscataway to offer publicly accessible electric scooters through a pay-per-ride or subscription program under an agreement that incorporates the provisions of Section 7-41.7 of this chapter.
USER
Means any person who is operating an electric scooter.

Every person riding an electric scooter within the Township of Piscataway shall be granted all the rights and shall be subject to all the duties applicable to the driver of a vehicle by the laws of this state including the provisions of Chapter 4 of Title 39 of the New Jersey Revised Statues applicable to bicycles as defined in N.J.S. 39:4-10 and the traffic provisions of this code applicable to the driver of a vehicle, except as to special regulations in this chapter and except as to those provisions of laws and ordinances which by their nature are inapplicable to such persons.

Obedience to Traffic Control Devices.
1. 
Any person operating an electric scooter shall comply with New Jersey Statutes, including Chapter 4 of Title 39 of the Revised Statutes, Rules and Regulations applicable to bicycles as defined in N.J.S. 39:4-10.
b.

c. 
User Age Restrictions. No person younger than 17 shall operate an electric scooter.
d. 
Manner of Riding an Electric Scooter. No electric scooter shall be used to carry more persons at one time than the number for which it is designed and equipped.
e. 
Speed Restrictions. No person shall operate an electric scooter at a speed greater than is reasonable and prudent under the condition then and there existing provided it does not exceed 19 miles per hour.

Riding Locations.
1. 
No person shall ride an electric scooter upon a sidewalk.
2. 
Any person traveling on the sidewalk with an electric scooter shall dismount before entering the sidewalk throughway and walk the electric scooter along the sidewalk.
3. 
No person shall start or stop an electric scooter trip on the sidewalk.
4. 
Riding shall be limited to bike lanes and/or multi use pathways within the Township.
k. 
Carrying Articles. No person operating an electric scooter shall carry any package, bundle, or article which prevents the user from keeping both hands upon the handlebars.

m. 
Lamps and Equipment on Electric Scooters.
1. 
Electric scooters in use at nighttime shall be equipped with a lamp on the front which shall emit a white light visible from a distance of at least 500 feet to the front with a lamp emitting a red light visible from a distance of 500 feet to the rear.
2. 
Electric scooters shall be equipped with a kick stand to prevent them from toppling over when parked.
n. 
Electric Scooter Parking/Placement.
1. 
Electric scooters are permitted to be secured at the bicycle racks in the Township for up to four consecutive days without being utilized.
2. 
Electric scooters shall be parked in designated electric scooter parking areas if they are available and advertised as such by either signage, pavement markings, or racks.
3. 
Electric scooters may be attached or secured to the bicycle rack with a U-lock, chain lock, or any type of lock made specifically for bicycles. No person shall attach or secure an electric scooter to any fixed object not suited for electric scooter parking or typically used for bicycle parking. No person or owner shall leave an electric scooter lying on or standing upon the sidewalk or any portion of the Township's right-of-way as to impede the pedestrian egress pathway such that less than four feet shall remain for pedestrian travel.
o. 
Abandonment of Electric Scooters.
1. 
An electric scooter may be deemed abandoned by the Township if:
(a) 
It has been parked for a period of 48 or more consecutive hours except in designated bicycle racks and approved marked areas;
(b) 
It appears visually to be in a state of prolonged disuse such that it has deflated tires, damaged or missing equipment making it inoperable, accumulated debris associated with it;
(c) 
It is found in any other condition in which an electric scooter would be deemed abandoned; or
(d) 
It is parked, placed or left on a roadway or in any public right-of-way in violation of this chapter.
2. 
It shall be unlawful for any person, user or owner to abandon any electric scooter within the Township.
3. 
In the event that an electric scooter is deemed to be abandoned as defined herein, the Township's Department of Code Enforcement and Public Works and the Township Police Department shall have the authority to seize and impound same or place an abandoned electric scooter notice, in the form of an adhesive sticker, on the electric scooter itself to notify the user and/or owner that said electric scooter is deemed to be abandoned pursuant to this section and that it will be removed and disposed of if not removed.
4. 
The notice in the form of an adhesive sticker shall state the following:
(a) 
The date after which the electric scooter may be removed if the owner/user does not remove and reclaim it; and
(b) 
The name and contact information of a Township representative to contact in case the electric scooter has been mistakenly identified as abandoned.
5. 
Once an abandoned notice sticker has been placed on the electric scooter, the owner of the electric scooter shall have 48 hours as set forth on the notice sticker to remove the electric scooter from the location. If it is not removed within the forty-eight-hour notice period as provided on the sticker, it may thereafter be removed from its location by any means necessary and held by the Township until claimed by the owner as provided for in this section. If the electric scooter is not claimed, it shall be disposed of by the Township in accordance with the law.
6. 
Any electric scooter seized by the Township pursuant to this section shall be impounded by the Township and only released to the owner after payment to the Township of the seizure and impoundment fee of $100. Any electric scooter not claimed by its owner within 10 days of the date of impoundment shall pay a $2 per day fee from the date of impoundment. Any electric scooter not claimed by the owner shall be disposed of by the Township in accordance with the law.
p. 
Shared Electric Scooter Rental Restriction. The shared electric scooter user shall be the same person who made the rental reservation. No person shall rent a shared electric scooter for another user.
q. 
Electric Scooter Charging. No electric scooter battery shall be recharged in the public right-of-way without prior written authorization from the Township.
r. 
Electric Scooter Disposal. All electric scooters shall be disposed of in a manner in accordance with state and federal regulations as they relate to hazardous materials disposal.
s. 
All operators of electric scooters shall certify once (at the time of sign-up for an electric scooter program), prior to riding, that they have read Township of Piscataway Code Section 7-41 and shall comply with state law (N.J.S.A. 39:1-1 et seq.) as applicable, governing electric scooter use.
t. 
Scooters shall not be operated within public parks unless they are being operated on a bicycle path or roadway through the park, or if it is necessary to cross through the park to reach an e-scooter parking location, users must dismount from the scooter and walk it to the destination.

a. 
Except as detailed below, in the event that any user or owner violates the terms of this chapter, the violator shall be subject to a fine in the Municipal Court of the Township of Piscataway in an amount of $100.
No court appearance shall be required for this violation.
b. 
If the offense is for carrying more persons at one time than the number for which the vehicle is equipped in violation of Section 7-41.4d, the penalty for the first offense shall be $50;
1. 
The penalty for the second offense and any subsequent offenses shall be $100.
No court appearance shall be required for this violation.
c. 
If the offense is for riding on a sidewalk in violation of Section 7-41.4j, the penalty for the first offense shall be $250;
1. 
The penalty for subsequent offenses shall be $500 per occurrence.
No court appearance shall be required for this violation.
d. 
If the offense is for electric scooter parking/placement, in violation of Section 7-41.4n, the penalty shall be $100 per offense and each continuing day shall be deemed a separate offense.
No court appearance shall be required for this violation.

a. 
Any shared electric scooter company may operate their service within the Township of Piscataway provided they meet the following criteria:
1. 
The company providing the shared electric scooter service shall agree with the Township on the number of electric scooters that they can operate at any given time. The number of electric scooters per each company will be set or altered upwards by the Township of Piscataway Council by resolution at a frequency of not more often than every once per calendar month. The company may at their own discretion adjust the number of scooters downwards without Township council action.
2. 
All electric scooters that are part of a shared electric scooter service shall be required to have a minimum of two wheels.
3. 
The company that expresses interest in offering a shared electric scooter service in the Township will agree to a pilot program of not more than 90 days with no more than 200 initial electric scooters during that time period.
4. 
The company will provide the Township a fee of $50 per scooter in an effort to mitigate the cost of additional electric scooter enforcement, the creation of electric scooter infrastructure, and education around the topic of electric scooter safety.
5. 
The company will provide the Township with a payment of $0.15 per scooter trip to support increased enforcement of Township scooter regulations and related infrastructure improvements.
6. 
The Township will set a maximum number of electric scooters provided in aggregate by all companies to be permitted to operate within the Township. The number is to be no more than 600 electric scooters.
7. 
The company will use any reasonable means of technology, such as but not limited to geofencing, to limit their electric scooter operations to comply with Chapter 7, Section 41 of the Township Code.
8. 
Company shall provide Township with proof of insurance coverage exclusively for the operation of stand-up electric scooters including:
(a) 
Commercial general liability insurance coverage with a limit of no less than $1,000,000 each occurrence and $2,000,000 aggregate;
(b) 
Automobile insurance coverage with a limit of no less than $1,000,000 each occurrence and $1,000,000 aggregate;
(c) 
Umbrella or excess liability coverage with a limit of no less than $5,000,000 each occurrence/aggregate; and
(d) 
Where company employs persons within the Township, workers' compensation coverage of no less than the statutory requirement.
9. 
If company collects anonymized fleet and ride activity data for all trips starting or ending within the jurisdiction of the Township on any vehicle of licensee or of any person or company controlled by, controlling, or under common control with licensee, then that data will be shared with the Township, provided steps are taken to ensure individual privacy and protect trade secrets.
10. 
The company will be required to have an identification plate on all of their electric scooters.
11. 
The company will disable and store away all electric scooters on days of inclement weather and for 48 hours following a snowfall of greater than five inches.
12. 
Electric scooters that are not in compliance with Section 7-41.7a12 will be subject to the regulations located within Chapter 3, Police Regulations, Section 5, Abandoned Motor Vehicles.
13. 
The Township and any shared electric scooter service company shall formalize by way of an agreement that provides the specifics of their services as it relates to this Section 7-41.7.
