A Police Department is hereby established in the Borough and
shall be known as the "Police Department of the Borough."

The Police Department may be comprised of a Chief of Police
or Director and such Lieutenants, Sergeants and patrol officers as
shall be deemed necessary by the Borough Council to properly preserve
peace and order in the Borough.

The Mayor shall nominate and, with the advice and consent of
the majority of the members of the Borough Council, shall appoint
all members of the Police Department.

a. The Mayor shall, with the advice and consent of the majority of the
members of the Borough Council, make all promotions within the Police
Department.
b. Each police officer promoted within the Police Department, including
but not limited to promotions made to the rank and office of Chief
of Police, shall first serve a probationary period within the promoted
rank for a period of eighteen (18) months from the date of his promotion.
During the probationary period, he shall be known as a "Probationary
Chief," "Probationary Lieutenant" or whatever rank he may be promoted
to. At the termination of the probationary period, the appointment
to a new rank shall become final upon the recommendation of the Mayor
and the confirmation of the Borough Council. If, at the expiration
of the probationary period, the conduct or capacity of the probationary
officer has not been satisfactory to the Mayor and Council, the probationary
officer shall be notified in writing that he will not receive permanent
appointment to higher rank.

Every member of the Police Department before entering upon the
performance of his duties shall take and subscribe to an oath or affirmation
to faithfully and impartially discharge the duties of his office and
shall file such oath or affirmation with the Borough Clerk.

The Chief of Police or Director shall be the Chief Executive
Officer of the Police Department and shall be responsible to the appropriate
authority for the efficient and routine day-to-day operations of the
Police Department. As used herein, and in accordance with N.J.S.A.
40A:14-118, the Borough Administrator is hereby designated as the
appropriate authority for the Police Department. The Chief or Director
shall, pursuant to policies established by the appropriate authority
with the advice and consent of the Mayor and Council:
a. Administer and enforce rules and regulations and special emergency
directives for the disposition and discipline of the force and its
officers and personnel;
b. Have, exercise, and discharge the functions, powers and duties of
the force;
c. Prescribe the duties and assignments of all subordinates and other
personnel;
d. Delegate such authority as he may deem necessary for the efficient
operation of the force to be exercised under his direction and supervision;
and
e. Report at least monthly to the Borough Administrator and the Mayor
and Council in such form as shall be prescribed by the Mayor and Council
on the operation of the force during the preceding month, and make
such other reports as may be requested by the Administrator or Mayor
and Council.
In the absence of the Chief of Police or Director, the duties
of office shall be assumed by the Senior Lieutenant, and in the absence
of the Senior Lieutenant, such duties shall be assumed by the next
ranking officer of the Police Department.

The members of the Police Department shall be held responsible
for the proper enforcement of all ordinances of the Borough and Statutes
of the State of New Jersey, and performance of all other duties normally
associated with a police force.

Every member of the Police Department shall conform and be guided
by the rules of conduct contained in the Rules and Regulations of
the Police Department of the Borough of Midland Park which are promulgated
and amended by the Administrator with the advice and consent of the
Mayor and Council.

The Chief of Police or Acting Chief, or such other member of
the Police Department designated for that purpose, shall keep record
of tours of duty of all personnel, all complaints registered with
the Department, all telephone and radio calls pertaining to fire and
police business, and a record of all arrests and all detentions. No
Department records shall be examined by any person except in accordance
with the public records access policy established by the Administrator
with the advice and consent of the Borough Council.

a. Every member of the Police Department shall be a citizen of the United
States and a resident of Bergen County in the State of New Jersey.
He shall be able to read and write the English language reasonably
well. He must be of good moral character and good health and shall
possess such other qualifications as may be prescribed by the Borough
Council. He must successfully pass any examination that may be required
by the Borough Council. In the event an applicant for a position on
the Police Department is a resident of the Borough and in all respects
has qualifications equal to another applicant residing outside of
the Borough, the resident applicant shall be given preference.
b. No person shall be appointed to a position on the Police Department
who is less than twenty-one (21) years of age or over thirty-five
(35) years of age at the time of his appointment; provided, however,
that in taking into account the age of an honorably discharged veteran
of the Armed Forces of the United States of America, who is over the
age of thirty-five (35) years, the number of years in which such veteran
was in service shall be deducted from his true age for determining
his eligibility.
c. Every member of the Police Department shall be a high school graduate
or the equivalent in education.
d. No person shall be appointed a member of the Police Department who
has been convicted of any crime constituting an indictable offense,
or who has been convicted of any crime or offense involving moral
turpitude.
e. Except as otherwise provided, no person shall be appointed to a position
on the Police Department without first serving a one (1) year probationary
period as a full-time police officer.

a. Causes for Removal from Office. Except as otherwise provided by law,
no permanent member or officer of the Police Department shall be removed
from office, employment or position for political reasons or for any
cause other than incapacity, misconduct, or disobedience of rules
and regulations established for the government of the Police Department
and force, nor shall such member or officer be suspended, removed,
fined or reduced in rank from or in office, employment, or position
therein, except for just cause as hereinbefore provided and then only
upon a written complaint setting forth the charge or charges against
such member or officer.
b. Complaints Against Police Officers.
1. The complaint shall be filed in the office of the Administrator and
a copy shall be served upon the member or officer so charged, with
notice of a designated hearing thereon by the Administrator, which
shall be not less than ten (10) nor more than thirty (30) days from
date of service of the complaint.
2. A complaint charging a violation of the internal rules and regulations
established for the conduct of the Police Department shall be filed
no later than the forty-fifth (45th) day after the date on which the
person filing the complaint obtained sufficient information to file
the matter upon which the complaint is based. The forty-five (45)
day time limit shall not apply if an investigation of a member of
the Police Department for a violation of the internal rules or regulations
is included directly or indirectly within a concurrent investigation
of that officer for a violation of the criminal laws of this State.
The forty-five (45) day limit shall begin on the day after the disposition
of the criminal investigation. The forty-five (45) day requirement
of this paragraph for the filing of a complaint against an officer
shall not apply to a filing of a complaint by a private individual.
3. A failure to comply with said provisions as to the service of the
complaint and the time within which a complaint is to be filed shall
require a dismissal of the complaint.
c. Hearing. Except as otherwise provided by law, the Administrator shall
conduct the hearing and shall have the power to subpoena witnesses
and documentary evidence. The Administrator may call upon the services
of the Borough Clerk and the Borough Attorney in conducting the hearing.
d. Member May Be Suspended from Duty. In the case when charges are preferred
against any member of the Police Department, the Chief of Police or
the Administrator may suspend such member from active duty pending
the trial or hearing of such charges by the Administrator.
e. Time Limit for Date of Hearing. If any member or officer of the Police
Department or force shall be suspended pending a hearing as a result
of charges made against him, such hearing, except as otherwise provided
by law, shall be commenced within thirty (30) days from the date of
the service of the copy of the complaint upon him, in default of which
the charges shall be dismissed and the member or officer may be returned
to duty.
f. Initial Decision and Final Decision.
1. The Administrator shall issue an initial decision which shall be
based exclusively on:
(a)
The testimony, documents and arguments accepted by the Administrator
for consideration in rendering a decision;
(c)
Matters officially noticed by him. In that initial decision,
the Administrator may recommend that the charges be dismissed or that
the member be dismissed from the Department, reduced in rank, suspended
from active duty without pay for a certain period, reprimanded or
may make such other disposition as the offense may warrant.
2. The initial decision shall be final in form and fully dispositive
of all issues and be promptly filed with the Borough Clerk on behalf
of the Mayor and Council. A copy of the initial decision shall promptly
be served upon all parties by the Borough Clerk.
3. Any party may file written exceptions within ten (10) days from receipt
of the Administrator's initial decision with the Mayor and Council.
A copy of the exception shall be served on all other parties. The
exceptions shall specify the findings of fact, conclusions of law
or dispositions to which exception is taken; set out specific findings
of fact, conclusions of law or dispositions proposed in lieu of or
in addition to those reached by the Administrator and set forth supporting
reasons. The exceptions to factual findings shall describe the witness'
testimony or documentary or other evidence relied upon. Exceptions
to conclusions of law shall set forth the authorities relied upon.
4. Within five (5) days from receipt of exceptions, any party may file
a reply with the Mayor and Council, serving a copy thereof on all
other parties. Such replies may include cross-exceptions or submissions
in support of the initial decision.
5. Within thirty (30) days after receipt of initial decision, or sooner
if an earlier time frame is mandated by Federal or State law, the
Mayor and Council may enter a final decision adopting, rejecting or
modifying the initial decision. The final decision shall be served
upon all parties by the Borough Clerk. If the Mayor and Council do
not reject or modify the initial decision within that thirty (30)
days, and unless the period is extended by consent of all parties,
the initial decision shall become a final decision and shall be promptly
implemented.

Compensation to all members of the Police Department shall be
established by ordinance. All members of the Department, with the
exception of Chief, shall be paid for such time as the member is on
active duty.

Working conditions of the Police Department personnel shall
be governed by the Personnel Policies and practices as adopted by
the Borough Council on June 18, 1959, and as amended since that date
and, to the extent required by law, by any collective bargaining agreement
entered into by the Borough and the duly authorized representations
of the members of the Police Department as determined pursuant to
the Public Employees Relations Act.

a. The Mayor, with the advice and consent of the Council, may appoint
pursuant to N.J.S.A. 40A:14-146.10 et seq., special law enforcement
officers who shall each be appointed for a term not to exceed one
(1) year. The Mayor and Council may cause such appointment to be revoked
for cause after an adequate hearing, unless the appointment is for
four (4) months or less, in which event the appointment may be revoked
without cause or hearing. Special law enforcement officers shall not
be members of the Police Department and their powers and duties shall
cease at the expiration of the term for which appointed.
b. No person shall be appointed a special law enforcement officer unless
that person possesses the qualifications set forth in N.J.S.A. 40A:14-146.10.
c. Special law enforcement officers shall not perform any duties, functions
or activities except those as permitted by and authorized in N.J.S.A.
14-146.11. There shall be two (2) classifications for Special Police
Officers.
1. Class One. Officers of this class shall be authorized to perform
routine traffic detail, spectator control and similar duties. Class
One officers shall have the power to issue summonses for disorderly
persons and petty disorderly persons offenses, violations of municipal
ordinances and violations of Title 39 of the Revised Statues. The
use of a firearm by an officer of this Class shall be strictly prohibited,
and no Class One officer shall be assigned any duties which may require
the carrying or use of a firearm.
2. Class Two. Officers of this Class shall be authorized to exercise
full powers and duties similar to those of a permanent, regularly
full-time appointed police officer. The use of a firearm by an officer
of this Class may be authorized only after the officer has been fully
certified as successfully completing training, as prescribed by the
Commission.
d. Each special law enforcement officer shall pay to the Borough a fee
equal to the amount expended by the Borough in obtaining the psychological
testing required by N.J.S.A. 40A:14-146.10, providing uniforms to
the special law enforcement officer as provided in N.J.S.A. 40A:14-146.12
and any other expenditure made by the Borough to qualify and/or equip
that special law enforcement officer.
e. Special law enforcement officers shall be under the supervision and
direction of the Chief of Police and shall comply with the rules and
regulations promulgated by the Mayor and Council for the conduct of
the permanent, regularly appointed Police officers of the Borough
as well as any rules and regulations applicable to the conduct and
decorum of special law enforcement officers. Special law enforcement
officers shall perform only such duties and shall only have such authority
as shall be authorized by the Special Law Enforcement Officers' Act.
f. A special law enforcement officer shall not be assigned duties by
the Chief of Police to perform private security duties for private
employers without the express prior consent of the Mayor and Council.

The term of appointment for all crossing guards in the Borough
of Midland Park shall be on a fiscal rather than calendar basis and
shall run from September 1 through June 30, of each year in order
to coincide with the school year.

The Fire Department shall consist of a Chief Engineer, Assistant
Chief Engineer, Captain, four (4) Lieutenants and not more than sixty
(60) nor less than twenty-five (25) members as the Council may, by
resolution, determine.

a. The Chief Engineer shall be appointed for a period of two (2) years.
b. The Assistant Chief Engineer shall be appointed for a period of two
(2) years.
c. The Captain and three (3) Lieutenants shall be appointed for a period
of two (2) years.
d. The Fire Department may submit for the consideration of the Mayor
and Council the name of one (1) member for each appointment to be
made.

In the event a vacancy occurs in any office, a new appointment
shall be made by the Mayor, with the advice and consent of the Council,
to fill such vacancy for the unexpired term. The Fire Department may
submit for the consideration of the Mayor and Council the name of
one (1) of its members for each such appointment to be made.

No member of the Fire Department shall be eligible for appointment
to any office who does not spend the majority of his time within the
limits of the Borough.

The officers of the Fire Department and a member of the Borough Council, appointed pursuant to Article
I of Chapter
2 of this Code, shall constitute and be known as the "Board of Fire Officers".

The Board of Fire Officers is authorized and hereby directed
to organize by the election of a President and Secretary and is empowered
and required to adopt a code of bylaws and rules for the control,
management and government of the Department and for the regulating
of the proceedings and business of the Board. All rules, regulations,
etc., after adoption by the Board, shall not become effective and
operative until presented to and approved by the Mayor and Council.

The Board of Fire Officers shall meet monthly or more frequently
for the transaction of all business of the Department. The Board of
Fire Officers shall have control over and management of the Department
and its government when such Department is not on active duty, subject
to the policies established by this Code, the Administrator, the Borough
Council and the code of bylaws, rules and regulations adopted by the
Board and approved by the Mayor and Council.

The Board of Fire Officers shall devise forms or methods of
keeping records of all alarms of fire, fire inspections, fire losses,
drills, attendance of members, condition of all apparatus and equipment
and such other data they may deem necessary.

The Board of Fire Officers shall appoint six (6) or more members
of the Department who have been properly licensed as drivers of the
automobile apparatus, who shall be thoroughly instructed in the operation
of all motor equipment of the Department. No unauthorized person shall
drive any of the automobile apparatus unless so directed by the officer
in charge, who may give such permission for training or emergency
purposes. Such permission may be revoked by the Board for cause.

The Board of Fire Officers shall maintain all fire equipment
in good repair; provided, however, that in case of major repairs the
consent of the Mayor and Council must first be obtained. All requisitions
for miscellaneous equipment and supplies shall be made by the Board
of Fire Officers to the Mayor and Council.

Any legal resident of the United States not less than eighteen
(18) years of age is eligible for membership in the Department, subject
to such rules and regulations governing membership as shall be provided
in the bylaws, rules and regulations adopted by the Board of Fire
Officers and approved by the Mayor and Council.

Applications for membership in the Fire Department shall be
made in writing to the Fire Department, who, upon receipt of the same,
shall number consecutively the applications and shall file them until
such times as a vacancy or vacancies may occur. In the selection of
applicants for membership, the Fire Department shall consider the
applications in the order in which they were received and shall cause
the applicant to submit to such examination as may be required by
the bylaws, rules and regulations. Upon satisfactory completion of
the examination and election by the Fire Department, the Fire Department
shall notify the Board of Fire Officers of the election of the applicant
and shall forward the name of the applicant to the Mayor and Council
for appointment and confirmation. Resignations of members of the Fire
Department shall be made in writing to the Fire Department, who shall
report such resignations to the Board of Fire Officers.

a. Complaints against Firefighters and Fire Officers for violations
of any provision of this section or the by-laws or rules and regulations
of the Fire Department shall be filed in the office of the Administrator
and a copy shall be served upon the Firefighter or Fire Officer so
charged by the Administrator with notice of a prompt designated hearing
thereon within thirty (30) days from the date of service of the complaint.
b. If the case charges are preferred against any Fire-fighter or Fire
Officer, the Fire Chief or the Borough Administrator may suspend such
member from active duty pending the hearing of such charges.

a. Except as otherwise provided by law, if charges are filed against
a Firefighter, the Board of Fire Officers shall conduct the hearing.
If charges are filed against a Fire Officer, the Administrator shall
conduct the hearing. The party or Board conducting the hearing is
called the Hearing Officer. The Hearing Officer shall have the power

The Chief Engineer shall have absolute control and general supervision
of the Department when on actual fire or drill duties, which supervision
shall be subject to and not conflict with the bylaws, rules and regulations
as adopted.

In all cases of fire, the Chief Engineer, or the officers hereinafter
provided, shall cause the necessary pieces of apparatus to respond
promptly to the alarm and worked in the most advantageous manner.
He shall promptly make report to the Board of Fire Officers of all
fires, false alarms or drills, damage to apparatus or equipment, and
such other information as may be required by the code of bylaws, rules
and regulations. He shall preserve order and discipline in the Department
at all times.

It shall be the duty of the Chief Engineer with the aid of the
Assistant Chief Engineer to cause the officers of the Department to
have all apparatus and equipment in good working order at all times.

It shall be the duty of the Assistant Chief Engineer to aid
the Chief Engineer in the performance of his duties and, in the absence
of the Chief Engineer, to perform all of the duties of the Chief Engineer.
It shall be the duty of the Captain to assist the Chief Engineer and
the Assistant Chief Engineer and, if both of these officers are absent,
to perform all of the duties of the officers.

It shall be the duty of the Lieutenants to aid the Chief Engineer
and Assistant Chief Engineer and the Captain in the performance of
their duties and, in the absence of the Chief Engineer, Assistant
Chief Engineer and the Captain, they shall act in the order of their
arrival at the firehouse and shall be in command of the Department
until the arrival of their superior officer.

It shall be the duty of the members of the Department to respond
promptly to their fire headquarters upon all alarms of fire. They
shall place themselves under the command of their respective officers
and shall proceed to carry out promptly all orders issued. In the
absence of an officer, an authorized driver may take the apparatus
to the scene of the fire and command same until the arrival of the
officer.

Officers proposing to absent themselves from the Borough for
a period of more than twenty-four (24) hours shall first inform the
proper officer of his intention; provided, however, that all officers
shall not be absent from the Borough at the same time.

a. A Length of Service Awards Program (LOSAP) is herewith created in
accordance with Chapter 388 of the Laws of 1997, to reward members
of the volunteer firefighters and ambulance corps members for their
loyal, diligent, and devoted services to the Borough of Midland Park.
b. The LOSAP shall provide for fixed annual contributions to a deferred
income account for each volunteer member that meets the criteria set
forth below; that such contributions shall be made in accordance with
a plan that shall be established by the Borough of Midland Park pursuant
to P.L. 1997 c. 388; and that such plan shall be administered in accordance
with the laws of the State of New Jersey, and U.S. Internal Revenue
Code and this section.
c. The LOSAP shall provide for annual contributions to each eligible
member that meets the criteria as follows:
1. One hundred (100) points are required to be met for a member of the
Volunteer Fire Department and one hundred (100) points are required
to be met for a member of the Volunteer Ambulance Corps to be eligible
for an annual contribution;

2. To be eligible volunteer must complete all requirements mandated
by law; and
3. Five (5) years of service are required for vesting.
d. Estimated cost.

1. The estimated cost of the program has been calculated as follows:
For regular annual services: $90,000 per year.
2. The yearly contribution shall be increased on an annual basis by
the same percentage increase as the Borough employees receive, provided
same is consistent with N.J.S.A. 40A:14-185f.
e. Each active volunteer member shall be credited with points for volunteer
services provided to the Volunteer Fire Company/Ambulance Corps in
accordance with the following schedule:
1. Midland Park Fire Department — Schedule A.
2. Midland Park Ambulance Corps — Schedule B.
f. This section shall not take effect unless it is approved by the voters
as a public question at the next general election.

SCHEDULE B

AMBULANCE CORPS POINT SYSTEM[Ord. #9-00; amended 10-10-2019 by Ord. No. 15-19]
|
A year of service shall be credited under LOSAP for each calendar
year in which an active MPAC volunteer member in good standing accumulated
at least 100 points. For the purposes of LOSAP, an "active member
in good standing" means a person who has been so designated by the
governing board of the Midland Park Ambulance Corps. Points shall
be granted in accordance with a system adopted by the Borough of Midland
Park Council.

On-duty hours.

a.
|
One point for each six hours of on-duty scheduled time for the
first 30 hours each month.
|
|
b.
|
One and one-half points for each six hours for all additional
hours of on-duty scheduled time in that month.
|
|
c.
|
Two points for each six hours of on-duty scheduled time on a
federal holiday.
|
2.
|
General calls.
|
|
a.
|
One point per call with or without transport to or from a medical
facility.
|
|
b.
|
Two points per call with or without transport to or from a medical
facility on a federal holiday.
|
3.
|
MPAC monthly business meetings.
|
|
a.
|
One and one-half points for each membership business meeting
attended.
|
4.
|
Training and drills - 20 points maximum.
|
|
a.
|
One and one-half points for off-site EMT-related training courses
offering a minimum of two CEUs.
|
|
b.
|
One and one-half points for on-site training courses and drills
at MPAC.
|
|
c.
|
One and one-half points per day for multiday courses and drills
held on site or off site.

|
Community and special events - 10 points maximum. Working at
community and special events such as parades, coin toss, fireworks,
sports events, festivals, etc., shall earn one point per event for
the first four hours and two points for an event lasting more than
four hours, with a maximum of 10 points.

Administrative and line officers and committee members.
|
|
a.
|
Three points for each officer position held for the entire year.
|
|
b.
|
One point for being on a committee for the entire year.
|
|
c.
|
No award will be made to any individual member who has not completed
the legal requirements established by either the State of New Jersey
or the Borough of Midland Park.

A Department of Public Works is hereby established in the Borough.

The Department of Public Works shall consist of a Superintendent
and such foremen, mechanics, laborers and other employees in such
number as the Mayor and Council from time to time may determine is
necessary.

The Mayor shall nominate and, with the advice and consent of
the Borough Council, shall appoint all members of the Department of
Public Works.

The respective positions in the Department of Public Works shall
receive such compensation as shall be set forth in the Borough's Salary
