A Municipal Court for the Township is established pursuant to Section 2A:8-1 of the Statutes of New Jersey.

The name of the municipal court shall be "Municipal Court of the Township of Montgomery."

The Municipal Court shall have a seal which shall bear the impress of the name of the Municipal Court.

There shall be a Municipal Judge of the Municipal Court. He shall be appointed by the Township Committee and serve for a term of three years from the date of his appointment and until his successor is appointed and qualified.

The Municipal Court and the Municipal Judge thereof shall have, possess and exercise all of the functions, powers, duties and jurisdiction conferred by the Laws of the State.

There shall be Clerk of the Municipal Court who shall be appointed by the Township Committee and shall serve for a term of three years from the date of his appointment and until his successor is appointed and qualified. The Clerk of the Municipal Court shall receive compensation as provided by the Township Committee. He shall perform such functions and duties as shall be prescribed by law, by rules applicable to the Municipal Court, by the Administrative Director of the Courts and by the Municipal Judge.

A person applying for representation by the Township Public Defender shall pay an application fee of $200. The Municipal Court may waive the fee, in whole or in part, if the Court determines, in its discretion, that the application fee represents an unreasonable burden on the person seeking representation. The Municipal Court may permit a person to pay the application fee over a specific period of time, not to exceed four months.
