[1982 Code § 165-1]
As used in this chapter:
Shall mean the Mayor and Council of the Borough of Little
Ferry.
Shall mean any corporation or association for a common purpose
in excess of ten (10) persons.
Shall mean all the real property situated in the Borough
of Little Ferry under the jurisdiction and care of the Borough, or
which may hereafter be acquired by the Borough or come under the jurisdiction
of the Borough.
Shall mean any written license issued by or under the Governing
Body, permitting the performance of a specified act or acts.
Shall mean any rule or regulation duly adopted by the Borough
of Little Ferry.

a.
All Parks. All parks (except Losen Slote Creek Park, which shall
be open to the public as provided in paragraph b.), whether dedicated
or not, shall be closed to the public between sunset and 7:00 a.m.
seven (7) days a week, including holidays.

Notwithstanding the other provisions of this section, the Mayor
and Borough Council may permit, by resolution, the use and occupancy
of any and all public parks, dedicated or not, playgrounds and other
areas of recreation by any group, individual or association, upon
request, for a designated time in connection with a specific event,
series of events or observance which has been authorized by the Governing
Body.

Any person who violates paragraph a above shall be subject,
upon conviction, to a minimum fine for the first offense of two hundred
($200.00) dollars and a maximum fine of five hundred ($500.00) dollars.
For a second or subsequent offense, a minimum fine of three hundred
($300.00) dollars and a maximum fine of eight hundred ($800.00) dollars
shall be imposed.

a.
It shall be unlawful in any park or playground for any person to:
1.
Consume, use, sell, deliver, possess, carry or hold any alcoholic
beverages unless a permit from the Governing Body or its designate
is obtained prior thereto.
2.
Use, possess or carry any glass containers or bottles.
3.
Play baseball, football, hockey or to conduct any other sports activities
except in areas and during the times expressly set aside for such
activities.
4.
Hit, putt or drive any golf balls.
5.
Sell, offer, expose for sale, solicit or give away any merchandise
unless a permit from the Governing Body or its designee is obtained
prior thereto.
6.
Allow any domestic animal, including but not limited to dogs, to be led or to run at large on or within any park or playground except in Willow Lake Park as set forth in Section 10-9.
7.
Use abusive, obscene, profane or indecent language or any disorderly
conduct disturbing or annoying to others.
8.
Make or kindle any fire except in a picnic grill.
9.
Give, produce or direct any entertainment or exhibition unless a
permit from the Mayor and Borough Council is obtained prior thereto.
10.
Climb, scale or jump over any fences, backstops, trees or other structures
not intended for such use.
11.
Cut, deface, injure, remove or disturb any tree, shrub, building,
fence, bench or other structure, apparatus, or property; or to pick,
cut or remove any shrub, bush or flowers or to mark or write upon
any building, fence, bench or other structure.
b.
In addition to the prohibitions in paragraph a above, it shall be
unlawful in Losen Slote Creek Park for any permit to:

No group or organization shall use any athletic facility in
any park or playground unless a permit for such use is obtained from
the Borough Clerk prior thereto; no other group, organization, person
or persons shall use such facilities during the time covered by such
permit, except with the permission of the Borough Clerk. In the event
of a conflict, the following groups shall be given priority:

a.
A person, group or organization seeking issuance of a permit hereunder
shall file an application 30 days in advance of the requested date
with the following:
b.
The application shall state:
1.
The name and address of the applicant.
2.
The name and address of the person, persons, group or organization
sponsoring the activity.
3.
The day and hours for which the permit is required.
4.
The park or playground or portion thereof for which such permit is
desired.
5.
An estimate of the anticipated attendance.
6.
Any other information which the governing body shall feel reasonably
necessary to a fair determination as to whether a permit shall be
issued.
c.
The resident permit fee is based on whether 75% of the group or team
are residents of the Borough, as evidenced by the submittal of a team
roster along with proof of address. Acceptable means of proof of address
shall be determined by the Recreation Committee Chairperson or his
or her designee. No such utilization of the parks and recreational
facilities of the Borough of Little Ferry shall be permitted without
a permit, which must be in the user's possession at the parks and
recreation facility at the time of use.
d.
An insurance waiver/release and insurance requirements form shall
be completed, and a certificate of insurance in compliance with same
shall be submitted for all Borough facility uses.
e.
Issuance of permit. The Department shall issue a permit hereunder
if it finds that:
1.
The proposed activity will not unreasonably interfere with or detract
from the general public enjoyment of the park or the promotion of
public health and welfare, safety and recreation. The Borough reserves
the right not to schedule activities so that the maintenance staff
can complete work.
2.
The facilities sought to be used are available at the day and time
specified in the application and the activity will not conflict with
any other scheduled activities.
3.
Past activities of the applicant under previous permits issued hereunder,
if any, have been conducted in accordance with all applicable ordinances,
regulations and the conditions of such permit(s).
f.
Cancellation of reservations.
1.
Picnic permit holders must provide two weeks' notice for cancellation.
The permit holder who cancels a picnic permit with less than two weeks'
notice is liable for the cost of the permit.
2.
Athletic field permit holders must provide four business days' notice
for cancellation. The permit holder who cancels an athletic field
permit with less than four business days' notice shall be liable for
the cost of the permit.
g.
Violation of permit. Strict compliance with permits is required.
Any violation of any terms and/or conditions thereof shall constitute
grounds for revocation of the permit by the Department. In case of
the revocation of any permit, permit fees shall be retained by the
Department. The permit forfeiture shall not in any manner relieve
such person from liability for the violation of the items listed under
disclaimers on the permit or for civil damages. Any violation of the
permit is grounds for denying any future permits.

A permit shall be issued if the following conditions are met:
a.
The proposed activity is for a public purpose or in the interests
of the community.
b.
The proposed activity or use of the park or playground will not create
undue traffic problems or unreasonably interfere with or detract from
the general public engagement of the park or playground.
c.
The proposed activity or use will not be detrimental to the public
health, safety, welfare and recreation.
d.
The proposed activity or use is not reasonably anticipated to incite
violence, crime or disorderly conduct.
e.
The proposed activity will not entail unusual, extraordinary or burdensome
public expense or police operation of the Borough.
f.
The facilities desired have not been previously reserved for other
use on the day and hour requested in the application.

The governing body may waive any and all of the within rules
and regulations upon request for special activities.

Except for authorized Borough employees and/or authorized public
officials, it shall be unlawful in any park or playground for any
person to drive a motor or horse-drawn vehicle, including but not
limited to automobiles, snowmobiles, motorbikes or mopeds, within
or upon a safety zone, walk or bridle path not designated or customarily
used for such purpose, except on paved roadways.

It shall be unlawful for a parent, guardian or custodian of
any person under the age of eighteen (18) years to permit or allow
such person to do any act prohibited by this chapter or any rules
and regulations adopted pursuant thereto.

Police Officers, public works employees and other Borough employees
or officials shall strictly enforce the provisions of this chapter
in accordance with their duties imposed by law.

a.
Properly licensed dogs shall be permitted to enter upon or remain
in Willow Lake Park subject to the following rules and regulations.
1.
Dogs shall only be allowed in Willow Lake Park between 7:00 a.m. until sunset in accordance with Section 10-2.
2.
Dogs are the only animals that handlers may bring to the park.
3.
Dogs must wear securely attached collars with valid dog licenses.
4.
Dogs must be leashed and under control at all times. Leashes shall
not have a lead in excess of twenty (20) feet.
5.
Dogs that become aggressive or uncontrollable must be immediately
taken from the park.
6.
Dogs shall be prohibited from the playground areas.
7.
Handlers must remain with their dogs at all times.
8.
Handlers must always clean up after their dogs.
9.
Handlers must immediately report all dog bites to the Little Ferry
Police Department.
10.
Dogs must be handled by an adult eighteen (18) years or older at
all times.
11.
Feeding a dog in the park is prohibited.
12.
Handlers are strictly liable for any incidents that occur at the
park.
13.
Dog owners are responsible and liable for the actions and behavior
of their dogs at all times.
14.
All dogs must have current rabies, distemper and parvo vaccinations.
It is recommended that dogs be on a flea and heartworm preventive
medication.
15.
Dogs that are ill are prohibited.
16.
All dogs must wear a valid license.
17.
Limit of three (3) dogs per adult.
18.
Dog owners who fail to comply with the above rules and regulations
may receive a summons.
19.
Any person violating the regulations set forth in this section, upon
conviction in a court of competent jurisdiction, shall be subject
to a penalty of not more than two hundred fifty ($250.00) dollars
for a first offense; five hundred ($500.00) dollars for a second offense;
and one thousand two hundred fifty ($1,250.00) dollars for a third
or subsequent offense or imprisonment for a term not exceeding ninety
(90) days; this penalty shall exclude any costs (dollar for dollar)
incurred by the municipality for cleanup of a park, playground or
recreation area as a result of the violator's actions.
