The following terms shall have the following meanings:
ADEQUATE FOODThe provision, at suitable intervals of not more than twelve (12) hours, unless the dietary requirements of the species requires a longer interval, of a quantity of wholesome foodstuff, suitable for the species and age, sufficient to maintain a reasonable level of nutrition in each animal, all of which foodstuff must be served in a safe receptacle, dish, or container.
ADEQUATE HOUSINGThe continuous provision of a sanitary facility, protection from the extremes of weather conditions, proper ventilation and appropriate space depending on the species of animal, as defined by regulations of the USDA, as revised.
ADEQUATE WATERThe provision either continuously or at intervals suitable to the species, which intervals shall not exceed eight (8) hours, of a supply of potable water in a safe receptacle, dish, or container.
ANIMALAny living vertebrate except a human being.
CATAny cat, male or female.
DANGEROUS ANIMALAny animal determined to have:
1. Inflicted severe injury or killed a human being or other animal in an unprovoked, aggressive attack; or
2. Repeatedly bit or attacked a human being or other animal in an unprovoked, aggressive manner.
DOGAny dog, male or female.
ENCLOSUREA fence or structure suitable to prevent the entry of young children and which is suitable to confine a dangerous or potentially dangerous animal, in conjunction with other measures, which may be taken by the owner or keeper of the animal. The enclosure shall be designed to prevent the animal from escaping.
IMPOUNDEDTaken into the custody of the Animal Control Department.
KENNELThe use of land or buildings for the purpose of selling, breeding, boarding or training dogs or cats or the combination thereof or the keeping of four (4) or more dogs or cats or the combination thereof over four (4) months of age.
LIVESTOCKShall be defined as meaning horses, mules, cows, sheep, goats, pigs, etc.
POTENTIALLY DANGEROUS ANIMALAny animal determined to have:
1. When provoked, on any occasion in the past, engaged in any behavior that required a defensive action by any reasonable person to prevent bodily injury, when the person and the animal are off the property of the owner or keeper of the animal; or
2. When unprovoked, on any occasion in the past, has killed, seriously bitten, inflicted substantial bodily injury, or caused substantial injury when attacking a domestic animal off the property of the owner or keeper of the animal; or
3. Engaged in animal-fighting activities as described in Section 578.025, RSMo.
SECURED PENA locked pen with sound sides, bottom and top to prevent the entry of young children and to prevent the animal from escaping by climbing, jumping or digging out. The pen must be within a reasonable distance of a conspicuous sign warning the presence of a dangerous or potentially dangerous animal in the pen. Nothing in this Article shall be interpreted as allowing a pen in areas where structures or pets are not authorized by zoning laws.
SEVERE INJURYAny physical injury to a human being that results in muscle tears, disfiguring lacerations or necessitates corrective cosmetic surgery.
