There is hereby established, pursuant to the provisions of N.J.S.A. 2A:8-1 et seq.,[1] as amended and supplemented, the Municipal Court of the City of Perth Amboy.

The Municipal Court of the City of Perth Amboy shall have a seal which shall bear the impress of the name of the Court.
There shall be a Judge of the Municipal Court, who shall be appointed by the Mayor with the advice and consent of the City Council for the term of three (3) years from the date of appointment and who shall serve until a successor is appointed and qualified. The Judge of the Municipal Court shall be designated by the Mayor as the Presiding Judge.
An additional Judge of the Municipal Court may be appointed by the Mayor with the advice and consent of the City Council for the term of three (3) years from the date of appointment and who shall serve until a successor is appointed and qualified.
The Judge of the Municipal Court and the additional Judge shall receive annual salaries to be paid in equal semimonthly installments and which shall be in lieu of all fees, costs and any other allowances whatsoever.
Said Municipal Court and Judges of the Municipal Court shall possess and exercise all the functions, powers, duties and jurisdiction conferred by the provisions of N.J.S.A. 2A:8-1 et seq.,[1] as amended and supplemented, or by any other law.

The governing body may provide for a Clerk, who shall be known and referred to as "Municipal Court Administrator," a Deputy Clerk or other necessary assistants for said Municipal Court and provide for their compensation.

The Municipal Prosecutor shall represent the State of New Jersey to the extent authorized by the proper state authorities, and the City of Perth Amboy on all matters before the Municipal Court of the City of Perth Amboy. The Municipal Prosecutor shall be assigned to the Department of Law and subject to general administrative procedures and requirements under the supervision of the Director.

In the event that the city employs a Municipal Public Defender, the Municipal Judge shall determine, based on the policy set by the presiding Municipal Judge, and any other proper authority, upon the application of a defendant, eligibility for said Public Defender services at no cost to the defendant. The application fee for Public Defender services shall be an amount not to exceed two hundred dollars ($200.), at the discretion of the presiding Municipal Judge, and may be waived at the Judge's discretion.
