The Township Committee hereby finds and declares that problems of traffic control occur when traffic must be moved through or around road or street construction, maintenance operations, and utility work, above or below ground which requires blocking the roadway and obstructing the normal flow of traffic, and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work forces performing these operations.
Therefore, the Township of Millburn hereby adopts the current Manual on Uniform Traffic Control Devices, 1978 edition, hereafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates construction, maintenance operations or utility work which may obstruct the normal flow of traffic. Any person, contractor, or utility who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility as required under N.J.A.C. 16:25-9.2, wishing to conduct work on, under or above the roadway to contact the traffic bureau of the Township Police Department in order to arrange a preconstruction meeting to develop plans for the safe movement of traffic during the construction period. The Millburn Township Chief of Police shall review, modify, approve or disapprove such plans. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Millburn Township Chief of Police is in violation of this section.

The person, contractor or utility shall, prior to the start of any work, provide the traffic bureau with at least two (2) emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site. If, for any reason, emergency contacts cannot be reached, or if the emergency contact person does not respond to a call from the Police Department to correct a hazardous condition, the Township may respond to correct such hazardous condition. The reasonable fees for such emergency services by the Township shall be charged to the person, contractor or utility responsible for such condition.

There shall be no construction, maintenance operations or utility work on any roadway in the Township before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the officer in charge of the traffic bureau of the Millburn Police Department, particularly in the case of urgent necessity in the interest of public health, safety and welfare, in which case work may be performed when necessary.

Road closings and/or traffic detours shall not be permitted unless approved by the Millburn Township Chief of Police or his designee.

Traffic directors shall be posted at all construction or maintenance sites when determined by the traffic bureau that they are necessary to provide for the safety and expeditious movement of traffic.

The traffic bureau of the Millburn Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, backfilling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard for any violation of this article.

The purpose of this section is to establish traffic and parking regulations at Millburn Education Properties.

As used in this section:
Shall mean the main parking lot located east of the Millburn High School and west of the Millburn Education Center.
Shall mean the parking lot located at the bottom of the west driveway of the Millburn High School Campus.
Shall mean the parking lot located on the eastern side of the Millburn High School Campus, north of the maintenance building and southwest of the Education Center.
Shall mean the parking lot located south of the maintenance yard and west of Rector Street, adjacent to the athletic fields.
Shall mean the parking lot located north of the Education Center and east of MBOE 10.
Shall mean the parking lot located south of the Education Center and adjacent to the private properties located on Blaine Street.
Shall mean the main roadway traveling through the Millburn High School Campus which begins on Millburn Avenue (west of the front of Millburn High School) and winds through the campus — east and then south terminating at the opening to Rector Street
Shall mean the western-most driveway off of Millburn Avenue that serves as egress and ingress to MBOE 2.
Shall mean the driveway that serves the backstage ingress and egress to the High School Auditorium and second floor of the Millburn High School, located between MBOE 7 and MBOE 8.
Shall mean the eastern-most driveway to the Millburn High School Campus, located north of the Education Center.
Shall mean the exit from the Millburn High School Campus, located off of MBOE 7 and west of MBOE 11.
Shall mean the driveway located to the west of MBOE 4 and proceeds behind the Field House.
Shall mean the loading dock is located off MBOE 8 on the western side of the Millburn High School.
Shall mean the small parking lot located east of the High School on MBOE 7.
Shall mean the Millburn Township Superintendent of Public Schools or the Millburn High School Principal.
Shall mean any and all lawns and unpaved surfaces owned by the Millburn Board of Education.
Shall mean parking permits or programs issued by the authorized representative and on file with the Township of Millburn Municipal Clerk, the Millburn Police Department Traffic Bureau and the Millburn Municipal Court.
Shall mean the sidewalks and other areas intended for pedestrian traffic and not motor vehicles.
Shall mean the Millburn Police Department Traffic Bureau.
Shall mean the parking lot located on the north side of Washington School (70 Spring Street).
Shall mean the driveway located on the south side of Washington School (70 Spring Street).

All municipal, County, State, Federal and Millburn Board of Education vehicles shall be exempt from the provisions of this Section 7-52. Nothing in this Section 7-52 shall prohibit the right of a sworn member of the Millburn Police Department, in concert with the authorized representative, from temporarily allowing the parking of vehicles in normally prohibited locations for special events, as long as the parking of those vehicles does not prevent emergency access into otherwise occupied buildings.

It shall be unlawful to park in the following locations on the Millburn High School Campus and the Millburn Board of Education Property:
a.
On the following roadways: MBOE 7, MBOE 8, MBOE 10, MBOE 11 and MBOE 12.
b.
On any grass or unpaved area, except for major events. The authorized representative will contact the Millburn Police Department prior to major events.
c.
On MBOE 9, except while actively loading and unloading and under no circumstances ever while the auditorium is occupied for an event.
d.
All vehicles shall be parked within lined spots in all lots.
e.
Only authorized vehicles as outlined in the New Jersey Motor Vehicle Code Title 39, may utilize handicap parking spots.
f.
Only Millburn Board of Education authorized vehicles may park in MBOE 13.
g.
On any sidewalk.
h.
Any place on the entire campus between the hours of 0230-0530 (2:30 a.m. and 5:30 a.m.) unless overnight permission is given by the authorized representative and this information is conveyed to the Millburn Police Department.
i.
To take up more than one (1) parking spot or not parking a vehicle between lines of spaces at any location on the Millburn High School Campus or Education Center Property.
j.
Parking Permit Program.

The Traffic Bureau, in consultation with the authorized representative, is hereby authorized to establish a written parking policy which will regulate the use of lined parking spaces on the Millburn High School Campus and the Millburn Education Center's property by designating where parking is permitted and by whom. Any vehicle not displaying a valid sticker or other evidence of an issued permit will be in violation of this Section 7-52.
3.
Announcement of the permit policy shall be made by publishing the procedures in the local newspaper, announcement by the Millburn Board of Education, and the Millburn Township Committee. Every attempt shall be made to have a copy of the procedures sent to every staff and student's household. In addition, proper signage shall be installed regulating the permit policy.
4.
Announcements, signage, and expense of the parking permit program shall be the responsibility of the Millburn Board of Education.

No left turns shall be permitted between the hours of 7:30 a.m. to 9:00 a.m. and 2:30 p.m. to 4:00 p.m. from the Washington School North Parking Lot and the Washington School South Driveway onto Spring Street, unless there is a police officer present.
A "No Left Turn" sign, Type R3-2 (24" by 24"), shall be installed with a permanent legend below it articulating the times and days of the turn prohibitions. The sign shall be mounted on the southwest corner of the Washington School North Parking Lot and Washington School South Driveway, facing westbound traffic exiting both locations. The sign shall be mounted in conjunction with a Stop Sign (Type R1-1).

The speed limit on the entire campus of the Millburn High School Campus and the Millburn Education Center shall be ten (10) miles per hour.

This entire section shall be enforced by the Millburn Police Department. Failure to obey any of the outlined provisions can result in a uniformed traffic summons being issued and will carry the same weight and force as violations of parking provisions governing municipal parking lots or as outlined in the New Jersey Motor Vehicle Code Title 39.
