As used in this Chapter:
COMMISSION
Shall mean the Board of Recreation Commissioners of the Township.
PARK
Shall mean any park, reservation, arboretum, playground,
athletic field, recreation center or any other area in the Township
owned or used by the Township, and devoted to active or passive recreation.
VEHICLE
Shall mean any wheeled contrivance, whether motor-powered,
animal-drawn or self-propelled. The term shall include any trailer.
Exception is made for baby carriages and vehicles in the service of
the Township parks.

No person shall, in any park:
a. Carry or use any golf club or hit golf balls.
b. Have been responsible for the entry of a dog or other domestic animal, except as described in Section
8-2.6.

c. Bring or have in their possession, or set off or otherwise cause
to explode or discharge or burn any firecracker, torpedo, rocket or
other fireworks or explosives of inflammable material, or discharge
them or throw them in any such area from land or highway adjacent
thereto.
It is prohibited for persons to bring or have in their possession
or set off or otherwise cause to ignite sparklers and other non-exploding,
non-aerial fireworks or novelties. Sparkling devices and novelties
include, but are not limited to: sparklers, snakes, glow works and
smoke devices.
Exception is made as to any regularly conducted display of fireworks
under and by virtue of the authority of the Commission or other municipal
authorities.
d. Have brought alcoholic beverages, nor shall any person drink alcoholic
beverages at any time in any park.
e. Be present in any park after closing time. All parks shall be closed
from 10:00 p.m. to sunrise except for Township sponsored activities
and except for access to and from private property through Old Short
Hills Park.
f. Expose or offer for sale any article or thing, or place any stand,
cart or vehicle for the transportation, sale or display of any article
or thing. Exception is here made as to any concessionaire acting under
and by virtue of authority of the Commission or other municipal authority.
g. Drive, ride or lead a horse, except upon an area designated for such
use, if any.
h. Shoot any arrow or use any bow and arrow, except when engaged in
an archery program under the supervision of the Commission.
i. Build or attempt to build a fire, except in such area and under such
regulations as may be designated by the Commission.
j. Have brought in, or shall dump, deposit or leave any bottles, broken
glass, ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or
refuse or other trash. No refuse, trash or waste material shall be
placed in any waters in or contiguous to any park or left anywhere
on the grounds thereof, and all waste materials shall be placed in
the proper receptacles where these are provided; where receptacles
are not so provided, all such rubbish or waste shall be carried away
from the park by the person responsible for its presence, and properly
disposed of elsewhere.

No person shall, in any park, willfully mark, deface, disfigure,
injure, destroy, tamper with, displace or remove any building, bridge,
bench, table, fireplace, paving or paving materials, water lines or
other public utilities or parts or appurtenances thereof, signs, notices
or placards, monuments, stakes, posts or other boundary markers, or
any structure, equipment, facility or park property or appurtenances,
either real or personal.

No person shall, in any park:
a. Damage, cut, break, trample, injure or destroy any hedge, shrub,
tree or plant.
b. Enter upon any flower bed or pick any flowers.
c. Dig in, damage, injure or otherwise disturb any lawn or grass area.
d. Climb any tree.
Exception is made as to duly authorized municipal employees
in the performance of duty.

No person shall, in any park, ride or coast on a motor vehicle
or similar vehicle.
No person shall, in any park, ride or coast on a bicycle except
upon the designated paved pathways of Taylor Park and Gero Park.

No person shall, in any park:
a. Operate any vehicle in any portion of a park, except upon the designated
parking areas and the driveways and approaches thereto.
b. Park any vehicle, except upon a designated parking area, and except
in accordance with the posted directions thereat and the instructions
of any park attendant who may be present.
c. Except that, in Taylor Park only, the operation of vehicles shall
be prohibited except for:
1. Authorized vehicles of the Shade Tree and Recreation Departments.
2. Vehicles using the designated driveways and approaches to the recreation
house to park momentarily and unload and pick up handicapped persons.
3. Commercial vehicles using the designated driveways and approaches
to Bauer Community Center to park, while unloading supplies and conducting
business.

Dogs will be permitted in Taylor Park only as designated and
described in this section. Dog owners are responsible and liable for
the actions and behavior of their dogs at all times. The following
provisions will also govern the allowance of dogs in Taylor Park.
a. Dogs must be securely confined and controlled by persons 13 years
of age or older.
b. Dogs must be leashed at all times, and said leash shall not be more
than six feet in length.
c. All dogs must have a current license and rabies vaccine record on
file with a municipal Health Department. A current license must be
worn by all dogs and must be legible upon inspection.
d. Dog walkers and owners must stay on designated paths as posted. A
designated path map will also be kept on file at the Millburn Recreation
Department.
e. Maximum of two dogs per person.
f. Dog walkers and owners must yield the path to any other user.
g. Dog walkers and owners must pick up and properly dispose of all dog waste per Section
5-8 of the Township's General Code.
Violations of Section 8-2.6 will be enforced under the Township's General Code.

No person shall bathe, wade or swim in Taylor Park Lake.

No person shall, in any park or other public place in the Township,
place, erect or leave any unattended structure (as defined in N.J.S.A.
40:55D-7), except for structures located in parks by the Township
relating to recreational activities, or upon the issuance by the Millburn
Business Administrator or his/her delegate of a permit to place a
structure which communicates lawful speech in the Short Hills Green
on the following terms and conditions:
a. The structure shall be structurally sound, not in excess of five
(5') feet in height, five (5') feet in width and five (5') feet in
depth and shall not impede access to and from the train station and
public thoroughfares.
b. The structure shall be placed only for a period of time not in excess
of five (5) days. Only one (1) structure at a time shall be allowed,
as determined by a random drawing in the event of a conflict. Applications
for any month shall be submitted during regular business hours to
the Business Administrator by the tenth (10th) day of the prior month.
In the event of any conflict as to subject or time, which cannot
otherwise be resolved, the permit shall be issued as determined by
a random drawing. The same or a similar structure shall not be placed
there again, and the same sponsor shall not place a structure there
again, within the same calendar year, but in no event more than once
within a ten (10) month period.
c. The name of the sponsor shall be placed on a sign of approximately
two (2) square feet on or near the structure and visible to the public.
d. The sponsor shall agree to restore the Short Hills Green to the condition
it was in prior to the placement of the structure.
e. The application for the permit shall contain the following information:
1. The name, address and telephone number of the responsible person(s)
to contact with respect to the structure.
2. The dates on which the structure will be displayed.
3. The title, a written description and sketch of the structure, including
all wording on the structure and on the sponsor sign.
4. The agreement of the sponsor to indemnify and hold the Township harmless
from any and all costs, damages, expenses, losses or liabilities,
including reasonable attorney's fees.
f. The sponsor shall deposit together with the permit application the
sum of five hundred dollars ($500.00) cash or cash equivalent as assurance
that the structure shall be removed at the end of five (5) days, which
sum shall be returned to the sponsor if the structure is removed,
or forfeited to the Township if the structure is not removed or if
the Short Hills Green is not returned to the condition it was in prior
to the display of the structure.
g. For the permit a fee shall be charged in the amount of twenty-five
dollars ($25.00).
