The conduct of any activity which requires issuance of a building permit pursuant to Chapter
22 and/or Chapter
23 of this Code shall be permissible only between the hours of 8:00 a.m. and 6:00 p.m. Mondays through Fridays and between the hours of 9:00 a.m. and 4:00 p.m. on Saturdays. Such activities shall not take place at all on Sundays or legal holidays unless an emergency situation prevails.
Any person committing an offense against any provision of this
article shall, upon conviction thereof, be guilty of a violation pursuant
to the Penal Law of the State of New York, punishable by a fine of
not less than $500 and not exceeding $1,500 or by imprisonment for
a term not exceeding 15 days, or by both such fine and imprisonment
for a first offense; a fine of not less than $1,000 and not exceeding
$1,500 or by imprisonment for a term not exceeding 15 days, or by
both such fine and imprisonment for a second offense; and a fine of
$1,500 or by imprisonment for a term not exceeding 15 days, or by
both such fine and imprisonment for each additional offense. The continuation
of an offense against the provisions of this article shall constitute,
for each day the offense is continued, a separate and distinct offense
hereunder.
