No owner, tenant, occupant, person or entity shall permit, divert or discharge groundwater or stormwater, directly or indirectly, onto or across any sidewalk, street, public property or other public right-of-way.
Every owner, tenant and/or occupant of any land or building in the Township of Elk shall mitigate any water diversion or discharge within the boundaries of their own property, unless an alternate mitigation plan has been approved by the Township Engineer.
A. 
Any person or persons violating any of the provisions of this article shall, upon conviction thereof, be punished by a fine not less than $100 and not exceeding $2,000, and/or required to perform up to 90 days' community service. A separate offense shall be deemed committed for each day during which a violation occurs or continues.
B. 
Any person who is convicted of violating this article within one year of the date of a previous violation of the same article and who was fined for the previous violation shall be sentenced by the Court to an additional fine as a repeat offender. The additional fine imposed by the Court upon a person for a repeated offense shall not be less than the minimum or exceed the maximum fine fixed for a violation of this article, but shall be calculated separately from the fine imposed for the violation of the article.
