c.
Municipal Court Discovery Fees.
1.
All requests for discovery in matters pending in the Fairview Municipal Court shall be submitted through the Municipal Prosecutor.
2.
The following fees shall be payable by the requestor to the Borough of Fairview for the discovery provided:
(a)
$0.75 per page for each of the first 10 pages photocopied.
(b)
$0.50 per page for each of the next 10 pages photocopied.
(c)
$0.25 per page for each of the pages photocopied thereafter.
(d)
Actual postage for any discovery sent by mail.
(e)
$0.25 for the envelope for any discovery sent by mail.
(f)
Photographs will be photocopied at the rates established herein. If requests are made for duplicate photographs, the actual cost of making the photographs shall be charged.
(g)
Duplication of videotapes constitutes an extraordinary duplication process and will be charged at the rate of $5 per videotape.
(h)
On any item that cannot be photocopied on the Borough copying machine or not otherwise provided for in this schedule, the actual cost incurred in making the copy shall be charged.
3.
Where the discovery must be obtained from an entity other than the Borough of Fairview, e.g., another police department, the actual costs paid to the other entity shall be paid by the requestor.
d.
Marriage and Civil Union Ceremonies.
1.
General Provisions.
(a)
Purpose. The purpose of this subsection is to establish policies and procedures for the collection of fees associated with the performance of marriage or civil union ceremonies by the Mayor.
2.
General Regulations.
(b)
An administrative fee of $20 shall be added to the above established fee.
(c)
The Mayor in his/her discretion may waive the fee for said ceremony.
(d)
Compensation and Reimbursement of Expenses Incurred Through the Performance of Marriage and Civil Union Ceremonies.
(1)
Receipt of Fees. The fee shall be paid by check, payable to the Borough of Fairview. Fees collected shall be deposited into the Borough's current fund.
(2)
Disbursement of Fees. Fees for service may be disbursed to the Mayor through the appropriate budget line item and with appropriate authorization.
(3)
Fees for reimbursement of appropriate expenses (travel, tuxedo rental, direct cost reimbursement) may be disbursed to the Mayor in accordance with the Borough of Fairview's established procedure for reimbursement, including vouchers with receipts documenting the expenses, duly authorized and with expenditure from the appropriate line item.
3.
Transportation Allowance. The Borough shall reimburse for vehicle-related expenses where the Mayor uses a personal vehicle in order to attend the marriage or civil union ceremony and only in such circumstances where the use of a personal vehicle is reasonable and appropriate. Said reimbursement shall be limited to automobile expenses based on and calculated as to the mileage to and from the ceremony at such rate per mile as allowable by the Borough of Fairview.
4.
Eligible Persons. The Borough shall reimburse only property and reasonable expenses incurred directly by and for the Mayor. Under no circumstances shall the Town reimburse expenses or expenditures on behalf of or because of any spouse, child, guest or other person.

Each department shall keep a permanent receipt book for the items herein under their jurisdiction.

All monies collected for the fees shall be deposited with the Chief Financial Officer within 48 hours of the receipt thereof.

a.
Authority. Pursuant to P.L. 1990, Chapter 69, there is hereby established a charge for duplicate copies of tax bills.
b.
Charge Established. Whenever a mortgagee, serving organization or property tax processing organization requests a duplicate copy of a tax bill, the Tax Collector shall issue a duplicate copy of the tax bill. The fee for the first duplicate copy requested shall be $5. The fee for the second and each subsequent duplicate copy of the same tax bill in the same tax year shall be $25. The Tax Collector shall require the payment be made prior to the issuance of the duplicate bill.

a.
Authority. Pursuant to P.L. 1990, Chapter 105, there is hereby established a service charge for checks or other written instruments tendered to the Borough which are returned for insufficient funds.
b.
Service Charge Established. Whenever payment on an account owing to the Borough is tendered by check or other written instrument which is returned for insufficient funds, there shall be a service charge of $20 collected and added to the amount due and owing on the account.
c.
Tax or Special Assessments. Whenever an account owing to the Borough is for a tax or special assessment, the service charge authorized by this subsection shall be included on the list of delinquent accounts prepared for the enforcement of the lien.
d.
Future Payments. Unless waived by the Chief Financial Officer, all future payments on the account owing to the Borough for which a check or other written instrument was returned due to insufficient funds shall be tendered in cash or by certified or cashier's check.

Payment procedures:
a.
It is the purpose of this subsection to implement procedures for the payment of property taxes due to the Borough through the use of the internet.
b.
Property taxes and sewer fees may be paid online through the use of credit cards, or by electronic check.
c.
A fee will be charged for the use of payment of credit cards and will be added to the tax payment and sewer payment. The fee for credit card payments shall be 2.90% of the overall fee.
d.
Each section, subsection, sentence, clause and phrase of this subsection is declared to be an independent section, subsection, sentence, clause and phrase, and the finding or holding of any such portion of this subsection to be unconstitutional, void, or ineffective for any cause, or reason, shall not affect any other portion of this subsection.

Any outside Police agency seeking to use the Police pistol range must submit a Certificate of Liability Insurance naming the outside Police agency and Borough of Fairview as an additional insured to the Police Department and Borough Clerk.

The outside Police agency must provide their own certified firearms/emergency personnel at the pistol range while using the pistol range. The certified firearms/emergency personnel must sign in and sign out at the Police Department.

Any outside Police agency seeking use of the pistol range must pay a fee of $10 per officer per qualification session.

All outside Police agencies who make use of the Police pistol range are responsible to provide their own equipment and supplies. Additionally, the outside Police agencies, upon their completion of their use of the Police pistol range, must clean up the range site and place the range in the condition it was in prior to their use.

Any Police Officer or agency exhibiting or found to have exhibited improper conduct with respect to the use of the Police pistol range or having failed to abide by the provisions of this section, will result in the denial of future use of the range by the Police Officer or outside Police agency.
