As used in this Article, the following terms shall have the
meanings indicated:
MOTORIZED BICYCLE
A pedal bicycle having a helper motor characterized in that
either the maximum piston displacement is less than fifty (50) cubic
centimeters or said motor is rated at no more than one and five-tenths
(1.5) brake horsepower, and said bicycle is capable of a maximum speed
of no more than twenty-five (25) miles per hour on a flat surface.
No person shall operate or ride upon a motorized bicycle within
the Borough of Somerville unless he wears a protective helmet of a
type approved by the Director of the Division of Motor Vehicles, State
of New Jersey. Such a helmet must be equipped with either a neck or
chin strap and be reflectorized on both sides thereof.
The Police Department is hereby authorized to have signs erected
at the Borough of Somerville territorial limits notifying the public
of this requirement.

Any person who shall violate any section of this Article shall,
upon conviction, pay a fine not to exceed one thousand dollars ($1,000)
or ninety (90) days in jail, or both.
