A cash bond in an amount to be set from time to time by resolution
of the city council shall be paid to and deposited with the director
of finance in connection with any application for sewer, water and
garbage service utilizing the city's services, to guarantee payment
of the charges for such services. No such services or any of them,
shall be authorized until such cash bond has been received.

Said cash bond referred to in section
35-44 shall be returned to the applicant after three year's continuous timely payment of all sewer, water and garbage charges charged the applicant, less any sums therefrom necessary to pay the applicant's sewer, water and garbage charges in full.

The director of finance shall have the authority to waive the cash bond requirement of section
35-44, where an applicant has previously used city utilities and has a history of timely payment of the city utility charges.
