This section shall be known as the "Police Ordinance of the
Township of Chatham."

Pursuant to N.J.S. 40A:14-118, et seq. there shall be a police
force under the name of "Police Department of the Township of Chatham,
Morris County, New Jersey." The Police Department as presently existing
shall continue to function under the provisions of this section and
all present members, officers, and personnel thereof shall retain
their respective positions, status, rights and emoluments.

The Chief of Police shall be the head of the Police Department
and shall be directly responsible to the appropriate authority for
the efficiency and routine day-to-day operations thereof, pursuant
to policies established by the appropriate authority in accordance
with N.J.S.A. 40A:14-118.

Subject to policies established by the appropriate authority,
the Chief of Police shall:
a. Administer and enforce rules and regulations and special emergency
directives for the disposition and discipline of the force and its
officers and personnel;
b. Have, exercise and discharge the functions, powers and duties of
the force;
c. Prescribe the duties and assignments of all subordinates and personnel;
d. Delegate such of his authority as he may deem necessary for the efficient
operation of the force to be exercised under his direction and supervision;
e. Report at least monthly to the appropriate authority, through the
Township Administrator, on the operation of the force during the preceding
month and make such other reports as may be requested by such authority.
As used in this section, "appropriate authority," means the
Public Safety subcommittee of the Township Committee.
Except as provided herein, the Township Committee and individual
members thereof shall act in all matters relating to the police function
of the Township as a body, or through the appropriate authority.

Under the command of the Chief of Police, there may be a Detective
Bureau, responsible for the investigation of crime, arrest, and prosecution
of the perpetrators, and the recovery of stolen property. The Chief
of Police is authorized to appoint the Head of the Detective Bureau,
and from time to time to assign to the Bureau, or to reassign to uniform
duty, other members of the Police Department. The Head of the Bureau
shall keep the Chief of Police informed at all times as to the activities
of the Bureau and shall submit to the Chief a written report of each
case processed by the Bureau.

In accordance with N.J.S.A. 40A:14-146.10 the Township Committee
may, as it deems necessary, appoint special law enforcement officers
sufficient to perform the duties and responsibilities authorized by
N.J.S.A. 40A:14-118. "Special law enforcement officer" means any person
appointed to temporarily or intermittently perform duties similar
to those performed regularly by members of the police force, or to
provide assistance to the police force during unusual or emergency
circumstances, or at individual times. Any person so appointed shall
meet the eligibility criteria as set forth in N.J.S.A. 40A:14-146.10.

The Police Department shall consist of a Chief of Police, up
to two Lieutenants, up to four Sergeants, or in the event that there
is only one Lieutenant, up to five Sergeants, and up to 14 Patrol
Officers. In addition, there may be clerical staff as shall be deemed
necessary from time to time by the Township Committee.

Each person appointed to the Police Department shall meet the
qualifications and requirements established by N.J.S. 40A:14-122 et
seq. and any other applicable laws of the State of New Jersey.

All appointments to and promotions within the Police Department
shall be made by the Township Committee upon the recommendation of
the Chief of Police and the Township Administrator. All promotions
shall be in accordance with applicable provisions of the laws of the
State of New Jersey.

Each person hereafter appointed to the Police Department shall
first serve a probationary term not exceeding one year and successfully
complete a police training course at an approved school pursuant to
N.J.S. 52:17B-66 et seq. before becoming eligible for appointment
as a regular member or officer by the Township Committee.

Before entering upon the duties of his or her office, and within
10 days after his or her appointment, each member and officer of the
Police Department shall take and subscribe an oath or affirmation
prescribed for members of Municipal Police Departments by the laws
of the State of New Jersey. Such oath or affirmation shall be taken
before and filed with the Township Clerk.

The appropriate authority shall, in consultation with the Chief
of Police, adopt rules and regulations for the governance and discipline
of the Police Department and its members. The rules and regulations
shall fix and provide for the enforcement of penalties for the violation
of such rules and regulations, and the members of the Police Department
shall be subject to such rules and regulations.

Every member and officer of the Police Department while on duty
shall devote his or her entire time and attention to the duties of
the Department.
No member of the Police Department shall engage in any activity
which is incompatible with this position as a member of the Department,
and the Chief of Police shall have authority to make a determination
that an activity or proposed activity is incompatible. In the case
of the Chief, such determination shall be made by the Township Committee.

The members and officers of the Police Department shall severally
hold their respective offices, and continue in their respective employment,
during good behavior and efficiency, and no member shall be removed
from office or employment in the Police Department for political reasons,
or for any other cause than incapacity, misconduct, or disobedience
of the rules and regulations established for the government and discipline
of the Police Department. Nothing in this section shall supersede
the right of the governing body, pursuant to N.J.S. 40A:14-143 et
seq., to decrease the size of the force for reasons of economy.

Except as otherwise provided by law, no permanent member or
officer of the Police Department shall be removed from his office,
employment or position for political reasons, or for any cause other
than incapacity, misconduct, or disobedience of rules and regulations
established for the government of the Police Department and force,
nor shall such member or officer be suspended, removed, fined or reduced
in rank from or in office, employment, or position therein, except
for just cause as hereinbefore provided and then only upon a written
complaint setting forth the charge or charges against such member
or officer.
All suspensions and removals of officers shall be in accordance
with N.J.S.A. 40A:14-147 et seq. as may be amended from time to time.
The Township Administrator is hereby designated to hear any
complaints brought against members of the force and shall have the
power to subpoena witnesses and documentary evidence. The Superior
Court shall have jurisdiction to enforce any such subpoena. The Township
Administrator may, with the approval of the Township Committee, appoint
a hearing officer to conduct any such hearing. The Township Administrator
or designated hearing officer shall issue a report to the Township
Committee of his findings along with a recommendation which may be
accepted, rejected or modified by the Township Committee.

All provisions of the present laws of the State of New Jersey
and all statutes hereafter enacted or amended which are applicable
to Township Police Departments and the members, officers and personnel
thereof shall be considered as controlling and shall be observed.

a. Position created. The position of Police Chaplain for the Township
of Chatham Police Department is hereby created in accordance with
statutory authority. The position(s) will be a volunteer position.
The position of Chaplain shall be under the supervision of the Chief
of Police.
b. Qualifications. Any person appointed as Chaplain shall be an ordained
clergyman in good standing in the religious body from which he/she
is selected. The chaplain shall have basic training and shall be a
certified Police Chaplain credentialed in accordance with the rules
and regulations of the Township of Chatham Police Department and shall
be qualified in accordance with statutory requirements.
c. Duties of Police Chaplain. The Duties of Police Chaplain shall include,
but not be limited to, assisting the Township of Chatham Police Department
in death notifications, station house adjustments, and any other duties
that may be assigned by the Chief of Police.
d. Rank and salary. Any person appointed as Chaplain shall serve in
that capacity without rank or salary.
e. Term of office. A person(s) appointed as Chaplain shall serve for
a period of one year from the date of appointment and shall continue
to serve in that capacity until he/she is either terminated or reappointed
with the recommendation of the Chief of Police regarding the appointment
of the Chaplain. The Mayor shall appoint the Chaplains in accordance
with this section with the advice and consent of the Township Committee.

The Green Village Volunteer Fire Department, a volunteer fire
company incorporated under Title 15 of the New Jersey Statutes Annotated,
and the Chatham Township Volunteer Fire Department, a volunteer fire
company incorporated under Title 15 of the New Jersey Statutes Annotated,
have for many years afforded fire protection for the Township of Chatham
within mutually agreed upon sections of the Township.
The aforesaid volunteer fire companies desire to be recognized
as the official fire companies for the Township, inasmuch as such
designation will facilitate their entry into the New Jersey State
Fireman's Association.
It is deemed appropriate that the aforesaid volunteer fire companies
be recognized as the official fire companies for the Township.

The Green Village Volunteer Fire Department and the Chatham
Township Volunteer Fire Department are hereby designated as the official
fire companies for the Township.

Membership in any official fire company shall be open to all
persons who are able to perform the duties of volunteer firemen, without
discrimination on the basis of the applicant's race, creed, color,
sex, age, national origin, ancestry, marital status or physical handicap.
Official fire companies shall comply with the membership procedures
set forth in N.J.A.C. 13:12-1.1 et seq., or as may be hereafter amended
or superseded. For purposes of membership in any local fireman's relief
association or the New Jersey Firemen's Association, no person shall
hereafter become eligible for such membership unless, at the time
of appointment to the official fire company, such person is above
the age of 18 years and of good moral character all in conformance
with the requirements of N.J.S. 43:17-1 et seq. He or she shall be
physically fit to perform the duties of a fireman evidenced by a certificate
to that effect by a practicing physician of the State of New Jersey.
This certificate shall be provided at either the member's own expense
or the expense of the official fire company to which the member belongs.

Each member of an official fire company shall, in each and every
year, perform at least 60% of fire duty, as defined by N.J.S. 40A:14-55
and 56. "Fire duty" is defined therein as active participation in
the usual duties of a fireman under the direction and supervision
of the official in charge of the Fire Department and force. "60% of
duty" is defined therein as actual recorded attendance and rendering
of fire service at not less than 60% of regular alarms of fire answerable
by the members during any calendar year. The total number of alarms
used in computing the percentage may include not more than 20 fire
drills called at the direction of the official in charge of the fire
company and force. A record shall be kept of such attendance and duty
by the Chief of each fire company and reported to the Township Committee
annually.

Each person seeking to join an official fire company shall make
application to the fire company and, upon acceptance, shall become
a member in good standing of said fire company, after approval of
his or her membership by the Chief of the fire company and confirmation
by the Township Committee. Each member's name shall be entered on
the role of firemen to be kept by the Township Clerk.

a. Introduction. The Township deems it appropriate and necessary to
act to ensure retention of existing members and to provide them incentives
for recruiting new volunteer members for the Chatham Township Volunteer
Fire Department (CTVFD), the Green Village Volunteer Fire Department
(GVVFD) and the Township has determined that the creation of a Length
of Service Awards Program (LOSAP) will enhance the ability of the
Township to retain and recruit volunteer CTVFD and GVVFD members.
b. Creation of LOSAP. LOSAP is created, in accordance with Chapter 388
of the Laws of 1997, to reward active volunteer members of the CTVFD
and GVVFD for their loyal, diligent and devoted services to the residents
of the Township.
c. Annual Contributions.
1. LOSAP shall provide for fixed, annual contributions to a deferred
income account for each active volunteer member of the CTVFD and GVVFD
who meets the criteria set forth below, or hereafter provided by amendment
to this subsection.
2. Such contributions shall be made in accordance with a plan established
by the Township and administered in accordance with the laws of the
State of New Jersey, the U.S. Internal Revenue Code, and this subsection.
d. Criteria for Eligibility. LOSAP shall provide for annual contributions
to each eligible, active volunteer member of the CTVFD or GVVFD who
meets the criteria as follows:
1. The number of points required for an active year of service for an
active volunteer CTVFD or GVVFD member is 50.
2. An active volunteer member of the CTVFD and GVVFD, shall not be eligible
if on probation or inactive status.
3. Nos. 1 and 2 are, as determined by the by-laws and/or other governing
documents of the CTVFD or GVVFD, as the case may be, and/or the officers
of each respective organization.
4. Any new, active volunteer member of the CTVFD or GVVFD shall not
become eligible to participate in LOSAP until the next calendar year,
after coming off probation or no longer on inactive status.
5. Current, active volunteer members, as of the date that the voters
approve LOSAP, shall become immediately eligible to participate in
LOSAP.
6. Any active, volunteer member of the CTVFD or GVVFD who obtains 50
points or more will receive $1,000 deferred contributions for his/her
active, volunteer status on the CTVFD or GVVFD, as the case may be.
7. No person who is an active, volunteer member of both the CTVFD or
GVVFD shall be permitted to receive deferred contribution for his/her
active status in said organizations for more than $1,000.
8. Any active, volunteer member of either the CTVFD or GVVFD, who is
receiving a public pension from or through the State of New Jersey,
shall be permitted to receive such deferred contribution unless otherwise
prohibited by law.
e. Prior Service.
1. LOSAP shall provide for contributions in the amount of $50 per year
for prior services up to 10 years by any active volunteer member of
the CTVFD or GVVFD.
2. To determine credit for prior services the standards set forth in Subsection
2-12.6d, Criteria for Eligibility, and, Subsection
2-12.6g, Credit Points, shall be used.
f. Costs.
1. The estimated costs of the program have been calculated as $45,000
per year.
2. The estimated one time cost of the program for prior service would
be $15,000.
g. Credit Points.
1. Each active, volunteer member shall be credited with points for volunteer
services provided to the CTVFD or GVVFD, in accordance with the attached
Schedule A.
h. Effective Date. This subsection shall not take effect unless, upon final
passage and publication as required by law, it is approved by the
voters of the Township as a public question at the next general election.

LOSAP POINT SYSTEM

A year of service shall be credited under LOSAP for
each calendar year after establishment of the program in which an
active CTVFD or GVVFD volunteer, accumulates at least 50 points. Points
shall be granted in accordance with a system adopted by the Township.
In considering the categories below, all of any portion of this list
can be used with additional flexibility in the point maximums. Such
system shall provide that points shall be granted for activities designated
by the Township, which activities shall be selected from the following:
1. Training
Courses - 20 Points Maximum.
(a) One point per two training hours, minimum two hour course.
2. Drills
- 32 Point Maximum.
(a) Two points for every two hours of drill attended.
3. Stand-By.
(a) Ten point maximum (weather or power emergencies).
(b) One point for each two hours of duty.
4. Attendance
at Meetings - Nine Points Maximum.
(a) Attendance at any official meetings of the CTVFD AND GVVFD - 1/2
point per meeting.
5. Participation
in Responses - Maximum of 50 Points, as outlined below:
(a) Minimum number of calls that active, volunteer firefighters must
respond to annually in order to receive 50 point credit 40%+
(b) Minimum number of calls that active, volunteer firefighters must
respond to annually in order to receive 40 point credit 30%-39%
(c) Minimum number of calls that active, volunteer firefighters must
respond to annually in order to receive 30 point credit 20%-29%
(d) Minimum number of calls that active, volunteer firefighters must
respond to annually in order to receive 20 point credit 10%-19%
6. Miscellaneous
Activities - 15 Point Maximum.
(a) Participation in other activities not otherwise listed, including
community service - one point per activity, two hour minimum.

There is hereby established the Department of Recreation of
the Township of Chatham.

There is created hereby the position of Recreation Director.
Such person shall direct the Department and shall be responsible for
the day to day operations of the Department, development and implementation
of programs, and supervision of other municipal employees assigned
to the Department. The Township Committee shall fix and determine
the Recreation Director's salary or compensation.

a. Establishment and Composition. There is hereby established in and
for the Borough of Chatham and in and for the Township of Chatham
a Joint Recreation Advisory Committee to be known as the "Joint Recreation
Advisory Committee of the Chathams." The Joint Recreation Advisory
Committee of the Chathams shall be composed of nine members, and two
alternates.
b. Appointment of Members; Terms of Office; Vacancies.
1.
(a)
Three members of the Recreation Advisory Committee who are residents
of Chatham Borough shall be appointed for a term of three years by
the Mayor of the Borough of Chatham upon the advice and consent of
the Borough Council. The terms of office of the first three appointed
members shall expire December 31, 2006, December 31, 2007 and December
31, 2008, respectively. In the event of a vacancy prior to the expiration
of a term, the term of appointment shall be only for the unexpired
term.
(b)
One member who is a resident of Chatham Borough shall be appointed
for a term of one year as an alternate member by the Mayor of the
Borough of Chatham upon the advice and consent of the Borough Council.
In the event of a vacancy, the term of appointment shall be only for
the unexpired term.
(c)
In the event that the Mayor fails to make a nomination at least
15 days prior to the date of the second regular public meeting of
the Council after a position becomes vacant or the Borough Council
fails to confirm a nomination, then the appointment shall be made
by the Borough Council by a vote of a majority of the members present
at the meeting, provided, that at least three affirmative votes shall
be required, with the Mayor to have no vote thereon except in case
of a tie.
2.
(a)
Three members of the Recreation Advisory Committee who are residents
of Chatham Township shall be appointed for a term of three years by
the Mayor of the Township of Chatham upon the advice and consent of
the Township Committee. The terms of office of the first three appointed
members shall expire December 31, 2006, December 31, 2007 and December
31, 2008, respectively. In the event of a vacancy prior to the expiration
of a term, the term of appointment shall be only for the unexpired
term.
(b)
One member who is a resident of Chatham Township shall be appointed
for a term of one year as an alternate member by the Mayor of the
Township of Chatham upon the advice and consent of the Township Committee.
In the event of a vacancy, the term of appointment shall be only for
the unexpired term.
(c)
In the event that the Mayor fails to make a nomination at least
15 days prior to the date of the second regular public meeting of
the Township Committee after a position becomes vacant or the Township
Committee fails to confirm a nomination, then the appointment shall
be made by the Township Committee by a vote of a majority of the members
present at the meeting, provided that at least three affirmative votes
shall be required.
3. One member of the Recreation Advisory Committee shall be a Council
member, appointed by the Borough Council, and the term of the appointment
of such member shall be one year. In the event of a vacancy by a Council
member, the term of appointment shall be only for the unexpired term.
4. One member of the Recreation Advisory Committee shall be a Township
Committee member, appointed by the Township Committee, and the term
of the appointment of such member shall be one year. In the event
of a vacancy by a Township member, the term of appointment shall be
only for the unexpired term.
5. One member of the Recreation Advisory Committee shall be appointed
by the School District of the Chathams (hereinafter called the "School
District"), and shall be an elected representative thereof. The term
of the appointment of such member shall be one year. In the event
of a vacancy by this member of the School District, the term of appointment
shall be only for the unexpired term.
c. Meetings; Quorum; Record of Proceedings; Annual Report. The Joint
Recreation Advisory Committee of the Chathams shall meet at such times
and places as it shall deem expedient but at least quarter annually.
A majority of the appointed membership of the Joint Recreation Advisory
Committee of the Chathams shall constitute a quorum thereof. The Committee
shall keep a record of its proceedings in a book suitable for that
purpose, which shall be the property of the governing body of the
Borough of Chatham and the governing body of the Township Committee.
The Joint Recreation Advisory Committee of the Chathams shall take
minutes of all proceedings and make an annual written report addressed
to the governing body of each municipality.
d. Powers and Duties.
1. The Joint Recreation Advisory Committee of the Chathams shall perform
such duties and have such powers as are delegated to it by this section
or by Interlocal Agreement or by companion resolutions of the governing
body of the Borough of Chatham, the governing body of the Township
of Chatham, and the School District.
2. The Joint Recreation Advisory Committee of the Chathams shall have
the power to develop policy manuals for recreation which shall then
be submitted to the governing body of the Borough of Chatham and to
the governing body of the Township of Chatham for approval.

There is hereby established the Colony Pool Advisory Committee,
with membership, duties and responsibilities as follows:
a. Duties and Responsibilities. The duties and responsibilities of the
Colony Pool Club ("CPC") Advisory Committee ("The Committee") shall
be to advise and assist the Department of Recreation and the CPC Manager
regarding the recreational and social activities associated with CPC.
b. Membership. The Committee shall have five members, appointed by the
Mayor, with advice and consent of the Township Committee. All members
shall be paying members of the Colony Pool Club. There may be a maximum
of two nonresident members appointed to the Committee. The members
shall be appointed for a term of one year.
c. Meetings. The Committee shall meet at a minimum quarterly or as deemed
needed by the Chair, for consideration of matters affecting programs,
social matters, and to identify, develop, review and make recommendations
through the appointed Township Committee liaison to CPC for the enhancement
and promotion of the Colony Pool Club. The Committee's power shall
be solely advisory.
d. Organization. At its reorganization meeting in the first quarter
of each year, the members of the Committee shall select a Chairman
and a Secretary from the membership of the Committee. The Chair shall
be a Township resident.

In December of each year, the Recreation Director shall submit
to the Township Committee a proposed budget for the following calendar
year showing in detail proposed expenditures and any existing or anticipated
sources of funds as well as the amount requested to be appropriated
by the Township Committee for the use of the Department during the
following calendar year. This budget shall include the Colony Pool
and Tennis Recreational Facility.

The Recreation Director shall submit monthly reports on the
activities of the Department to the Township Committee.

The Department of Recreation shall have the following powers
and duties:
a. Control over Recreation and Parks Facilities; Rules and Regulations.
The Department shall have full control over scheduled uses for all
lands, playgrounds, parks and other recreation facilities of the Township,
including without limitation Nash Field, Esternay Field, Shunpike
Field, Rotary Park, Mountainview Field, Mountainview Indoor Gym, and
the Colony Pool and Tennis Recreational Facility.
b. Expenditures. The Department may expend such sums as may be appropriated and made available by the Township Committee for the use of the Department, as well as such sums as may be collected by the Department as provided in Subsections
c and
d hereof. All disbursements of funds shall be made by the Treasurer of the Township in the same manner as the expenditures of other municipal funds.
c. Joint Programming of Recreation Activities. The Department shall
have the authority to participate in joint programming of Recreation
Activities with another municipality or municipalities where the Township
Committee determines the best interest of the Township participants
in the programs or activities it administers will be served. In such
event, the Department shall also have the authority to meet with the
appropriate representatives of the other municipalities as necessary.
d. Games and Exhibitions. In order to provide funds, in whole or in
part, necessary to improve, maintain and police the playgrounds and
recreation facilities for such purposes, the Department may, subject
to the approval of the Township Committee, charge and collect a reasonable
fee for each person entering such playground or recreation facility
as a spectator for such events, but the Department shall not use such
playground or recreation facility for such purpose for a greater period
than a ratio of one hour to every two hours in each day during which
the playground or recreation facility is utilized nor more than 16
hours in any one calendar week, and, when any playground or recreation
facility is used for such purpose, no admission shall be charged or
collected from children under 12 years of age. The Department may
also charge and collect a reasonable fee for each participant of activity
sponsored by the Department. All fees collected shall be paid over
to the Treasurer of the Township. Notwithstanding the above, if the
Department participates in joint programming of recreation activities
with another municipality, the Township Committee may authorize such
other municipality to collect any and all fees associated therewith,
to handle the administration of same and to account therefor to the
Township. In such event, all disbursements made from the fees collected
shall require the prior approval of both municipalities.
e. Service Charges for the Use of Certain Facilities. The Department
may, subject to the approval of the Township Committee, charge and
collect reasonable service charges from persons using, as participants,
special areas and facilities, which require special maintenance and
the use of which is restricted to relatively few people, in order
to assist in the meeting of the operating costs thereof in whole or
in part. All service charges collected shall be paid over to the Treasurer
of the Township.
f. Recommendations for Additional Recreation and Park Facilities. The
Recreation Director may from time to time recommend to the Township
Committee additional recreation and park facilities deemed necessary
or advisable. Such recommendations may include plans and estimated
costs for developing, preparing and equipping such proposed facilities.
g. Compensation, Reimbursement of Expenses. The members of the Recreation
Advisory Committee and the Colony Pool Advisory Committee shall serve
without compensation, provided that any member shall be entitled to
be reimbursed for expenses necessarily incurred in discharging duties
of his or her office.
