Pursuant to Title 26, Chapter
3 of the New Jersey Statutes Annotated there is hereby established a Board of Health of the Township of Chatham.

The Board of Health shall consist of five members appointed
by the Mayor with the confirmation of the Township Committee as follows:
A member of the Township Committee, to be appointed annually;
and
Four residents of the Township of Chatham.
All appointments except that of the member of the Township Committee
shall be for terms of three years. Any vacancy among the members of
the Board shall be filled in the same manner in which the original
appointment was made, but for the unexpired term only.

Members of the Board of Health shall serve without compensation
but any member shall be reimbursed for expenses necessarily incurred
in discharging the duties of his office.

The Board of Health shall elect a President and may create and
fill such other offices as the Board shall determine. The Board shall
have the power and authority to employ a physician and such other
personnel as it may deem necessary to perform its functions, to pay
for the services of such persons, and to make such other expenses
as may be necessary and proper, not exceeding the amount appropriated
by the Township Committee for the use of the Board.

The Board of Health shall have all the powers and duties conferred
upon Township Boards of Health by the law of the State of New Jersey
and the State Sanitary Code.

Pursuant to the provisions of Title 40, Chapter 56 of the Laws
of the State of New Jersey there is hereby created a general Board
for the assessment of benefits accruing from local improvements which
may from time to time be made within the Township. Such Board shall
be known as the Board of Assessment Commissioners and shall have all
the powers and duties conferred upon such boards by the aforesaid
Laws of the State of New Jersey.

The Board of Assessment Commissioners shall consist of three
residents of the Township appointed by the Township Committee. The
members of the Board shall hold office until January 1 next following
their appointment. Any vacancy among the members of the Board shall
be filled in the same manner as original appointments.

The Chairman of the Board of Assessment Commissioners shall
be compensated at the rate of $10 for each hour that he shall be necessarily
engaged in discharging the duties of Chairman. The two other members
of the Board of Assessment Commissioners shall serve without compensation.
Each member shall be entitled to be reimbursed for any expenses necessarily
incurred in discharging the duties of his office.

The Board of Assessment Commissioners shall elect a Chairman
and shall have the power and authority to create and fill such other
offices and to employ a secretary and such other persons as the Board
may deem necessary and appropriate to perform its functions, and the
Board may expend funds in the conduct of its work not exceeding the
amounts appropriated from time to time by the Township Committee for
the use of the Board.

A majority of the Board of Assessment Commissioners shall constitute
a quorum for the transaction of business and shall be sufficient to
make any assessment. One member shall have the power to adjourn any
hearing, and any hearing may be adjourned from time to time. The Board
shall have the power to examine witnesses under oath to be administered
by any member of the Board.

No member of the Board of Assessment Commissioners shall act
upon assessments for a local improvement which benefits real estate
in which he has any direct or indirect interest, provided, however,
that if a local improvement shall be of a general nature affecting
the greater part of the real estate in the Township no member shall
be disqualified from acting by reason of the fact that he may have
any direct or indirect interest in any real estate benefited by the
improvement.
In the event of disqualification of a member of the Board by
reason of interest, the Township Committee shall appoint another qualified
person to act temporarily in his place but only until the assessments
for the particular local improvement have been confirmed.

Pursuant to the provisions of N.J.S. 40:56A-1 to 40:56A-5, there
is hereby created a Commission for the protection, development or
use of all natural resources, including water resources, located within
the Township. Such Commission shall be known as the Environmental
Commission and shall have all the powers and duties conferred upon
such commission by the laws of the State of New Jersey.

a. The Environmental Commission shall be appointed by the Mayor and
shall consist of seven residents of the Township, one of whom shall
also be a member of the Township Planning Board. The terms of office
of the first Commissioners shall be for one, two or three years, to
be designated by the Mayor in making his appointments so that the
terms of approximately one-third of the members will expire each year,
and their successors shall be appointed for terms of three years and
until the appointment and qualification of their successors. A vacancy
occurring otherwise than by expiration of a term shall be filled for
the unexpired term in the same manner as an original appointment.
The Mayor shall designate one of the members to serve as Chairman
and presiding officer of the Commission. The Mayor or Township Committee
may remove any member of the Commission for cause, on written charges
served upon the member and after a hearing thereon at which the member
shall be entitled to be heard in person or by counsel.
b. Two alternate members shall be appointed by the Mayor and shall be
designated at the time of appointment as "Alternate No. 1" and "Alternate
No. 2." The terms of the alternate members shall be for two years,
except that the term of the alternate member first appointed shall
be two years for Alternate No. 1 and one year for Alternate No. 2
so that the term of not more than one alternate member shall expire
in any one year. A vacancy occurring otherwise than by expiration
of term shall be filled by the appointing authority for the unexpired
term only.
An alternate member shall not be permitted to act on any matter
in which he has either directly or indirectly any personal or financial
interest. An alternate member may, after public hearing if he requests
one, be removed by the governing body for cause.
An alternate member may participate in discussions of the proceedings
but may not vote except in the absence or disqualification of a regular
member. A vote shall not be delayed in order that a regular member
may vote instead of an alternate member. In the event that a choice
must be made as to which alternate member is to vote, Alternate No.
1 shall vote first.

The Environmental Commission shall have the power and authority
to create the office of Secretary and such other offices as it may
from time to time require and to employ a secretary and such other
persons as the Commission may deem necessary and appropriate to perform
its functions, and the Commission may expend funds in the conduct
of its work not exceeding the amounts appropriated from time to time
by the Township Committee for the use of the Commission.

A majority of the Environmental Commission shall constitute
a quorum for the transaction of business and shall be sufficient to
take any action within the Commission's power.

The Environmental Commission shall keep records of its meetings
and activities and shall make an annual report to the Township Committee.

The Environmental Commission shall have power to conduct research
into the use and possible use of the open land areas of the Township
and may coordinate the activities of unofficial bodies organized for
similar purposes, and may advertise, prepare, print and distribute
books, maps, charts, plans and pamphlets which in its judgment it
deems necessary for its purposes. It shall keep an index of all open
areas, publicly or privately owned, including open marshlands, swamps
and other wetlands, in order to obtain information on the proper use
of such areas, and may from time to time recommend to the Township
Planning Board plans and programs for inclusion in a Municipal Master
Plan and the development and use of such areas.

The Environmental Commission may, subject to the approval of
the Township Committee, acquire property, both real and personal,
in the name of the Township by gift, purchase, grant, bequest, devise
or lease for any of its purposes and shall administer the same for
such purposes subject to the terms of the conveyance or gift. Such
an acquisition may be to acquire the fee or any lesser interest, development
right, easement (including conservation easement), covenant or other
contractual right (including a conveyance on conditions or with limitations
or reversions), as may be necessary to acquire, maintain, improve,
protect, limit the future use of, or otherwise conserve and properly
utilize open spaces and other land and water areas in the Township.

Pursuant to the provisions of N.J.S. 40A:10-6 and following
there is hereby created the Insurance Fund of the Township of Chatham
for the following purposes:
a. To insure against any loss or damage however caused by any property,
motor vehicles, equipment or apparatus owned by the Township or owned
by or under the control of any of its departments, boards, agencies
or commissions;
b. To insure against liability resulting from the use or operation of
motor vehicles, equipment or apparatus owned by or controlled by the
Township or owned by or under the control of any of its departments,
boards, agencies or commissions; and
c. To insure against liability for its negligence and that of Township
officers, employees and servants, whether or not compensated or part-time,
who are authorized to perform any act or services, but not including
an independent contractor within the limitations of the New Jersey
Tort Claims Act, N.J.S. 59:1-1 and following.

The Township Committee shall from time to time make such appropriations
to the Municipal Insurance Fund as it deems necessary. The Township
Committee may designate the maximum or minimum amount of the Fund
and from time to time provide for the disposition of any excess over
and above the maximum amount fixed or of the interest or profits arising
therefrom when the Fund shall have reached the maximum limit.

The Mayor with the consent of the Township Committee, shall
appoint three officials of the Township, who may be members of the
Township Committee, to serve as Insurance Fund Commissioners and a
person to serve as Secretary of the Municipal Insurance Fund.
The Commissioners shall hold office for two years or for the
remainder of their respective terms of office as officials of the
Township, whichever shall be less, and until their successors have
been duly appointed and qualified. The Secretary shall serve at the
pleasure of the Insurance Fund Commissioners.
Vacancies in the office of Insurance Fund Commissioners caused
by any reason other than expiration of term of office as an official
of the Township shall be filled for the unexpired term. A vacancy
in the position of Secretary shall be filled in the manner of the
original appointment.
The Insurance Fund Commissioners shall serve without compensation.
The salary of the Secretary shall be that fixed by Township ordinance.

The Insurance Fund Commissioners shall annually elect from their
membership a Chairman who shall serve for the year.

The Insurance Fund Commissioners shall have the following powers
and authority.
a. Employ necessary clerical assistants, whose compensation shall be
fixed and paid by the Township Committee in the same manner as is
that of other employees of the Township;
b. Invest the fund and all addition and accretions thereto in such securities
as they shall deem best suited for carrying out the purposes of the
Municipal Insurance Fund;
c. Adopt rules and regulations for the control and investment of the
Fund;
d. Keep on hand at all times sufficient money, or have the same invested
in such securities as can be immediately sold for cash, for the payment
of losses to any buildings or property of the Township, or liability
resulting from the operation of publicly owned motor vehicles, equipment
or apparatus;
e. Fix reasonable rates of premium of all insurance carried by the Insurance
Fund, and effect all insurance in the Insurance Fund or with any insurance
company or companies authorized to do business in this State;
f. Premiums, for insurance, whether carried in the Insurance Fund, or
placed with insurance companies, shall be paid to the Commissioners
by the board, commission, department, committee or officer having
charge or control of the property insured; and
g. All insurance upon property owned or controlled by a local unit or
any of its departments, boards, agencies or commissions, shall be
placed and effected by the Commissioners;
h. If provided by the rules and regulations of the Commissioners, the
Secretary of the Fund shall be entrusted with the daily operation
of the Fund and shall submit a report to the Commissioners at least
once a month.

There is established an Open Space Advisory Committee whose
purpose it is to review and recommend parcels of land to be included
in an Open Space Plan for acquisition and preservation of lands within
the Township of Chatham.

a. The Open Space Advisory Committee shall consist of nine members to
be appointed, each for a term of one year, by the Township Committee,
with the Chairman to be appointed by the Mayor.
b. The membership of the Open Space Advisory Committee shall include:
1. A member of the Township Committee;
2. A member of the Planning Board;
3. A member of the Environmental Commission;
4. Six residents of the Township of Chatham.
c. Two Township of Chatham residents shall be appointed by the Township
Committee as alternate members and shall be designated at the time
of appointment as "Alternate No. 1" and "Alternate No. 2". The terms
of the alternate members shall be for one year. A vacancy occurring
in the alternate members shall be for the unexpired term and shall
be filled by appointment of the Township Committee. An alternate member
may participate in discussions but may not vote except in the absence
or disqualification of a regular member. A vote shall not be delayed
in order that a regular member may vote instead of an alternate member.
In the event that a choice must be made as to which alternate member
is to vote, Alternate No. 1 shall vote first.
d. The following personnel shall serve as advisors to the Open Space
Advisory Committee:
1. Chief of Police or his designee;
3. Public Works Director or his designee;

a. The Open Space Advisory Committee shall prepare and submit to the
Township Committee an Open Space Plan for the Township of Chatham
consisting of identification of undeveloped, private land parcels.
b. The Open Space Advisory Committee shall annually recommend a particular
parcel or parcels for acquisition by the Township.
c. The Open Space Advisory Committee shall update the Plan on an annual
basis.
d. The Open Space Advisory Committee shall include the following criteria
when selecting parcels for preservation:
1. Lands that connect existing public land;
2. Lands that include environmentally sensitive areas, streams, wetlands,
floodplains, steep slopes, aquifer recharge areas;
3. Lands that provide recreational use;
4. Lands that preserve scenic vistas.
e. The Open Space Advisory Committee is authorized to monitor and to
conduct inspections of properties acquired by the Township for open
space and to report its findings to the Township Committee.

The Open Space Advisory Committee shall advise the Township
Committee regarding the availability of funds for acquisition of land
and shall aid the Township in applying for such funds.
