Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a. 
The Chief of Police or, in his/her absence, disability or inability to act, the Mayor is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police and in accordance with paragraph a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

All former traffic ordinances of the Township of Fairfield are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive, provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police, or in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
Upon the declaration of an emergency, by the Essex County Sheriff's Department, Office of Emergency Management, there shall be no parking on the following Essex County roads or sections of said roads where "EMERGENCY NO PARKING WHEN EMERGENCY DECLARED" signs are displayed:

d.

Whenever snow has fallen and the accumulation is such that it covers the street or highway, an emergency shall exist and no vehicles shall be parked on the following streets or highways or portions thereof listed below.
The parking prohibitions listed below shall remain in effect after the snow has ceased, until the streets have been plowed significantly, and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.

The Governing Body hereby finds and declares that problems of traffic control occur and traffic must be moved through or around street construction, maintenance operations, and utility work, above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
The Township of Fairfield, in the County of Essex, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations of utility work obstructs the normal flow of traffic. Any person, contractor, or utility, who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility agreement, wishing to conduct work on, under or above the roadway to contact the Police Department in order to arrange a pre-construction meeting in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Police Department is in violation of this section.

The person, contractor, or utility shall provide the Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the Township may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Township shall be charged to the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility work on any roadway in the Township before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the officer in charge of the Police Department. If it is determined by the officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

Road closing and/or traffic detours shall not be permitted unless approved by the Police Department.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Police Department that same is necessary to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored materials within the street right-of-way, backfilling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights, devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the County jail for a term not exceeding 90 days. For a second offense, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

All ordinances or parts of ordinances which are inconsistent with the provisions of this section are hereby repealed to the extent of any such inconsistency.

This section shall take effect after approval by the Commissioner of Transportation 20 days after passage and publication as prescribed by law.

In accordance with and pursuant to the authority of P.L. 1999 Ch. 185 the following is a list of school crossings which have been so designated by the Township of Fairfield:

The DWI-Free Zones Map produced on or about April 2006 by Lawrence Gonnello, P.E., the Township Engineer, is hereby approved and adopted as an official finding and record of the location and areas within the municipality of property which is used for school purposes and which is owned by or leased to any elementary or secondary school on school land and of the areas on or within 1,000 feet of such school property.

The DWI-Free Zones Map approved and adopted pursuant to subsection 7-9.2 of this section shall continue to constitute an official finding and record as to the location and boundaries of areas on or within 1,000 feet of property owned by or leased to any elementary or secondary school or school board which is used for school purposes until such time, if any, that this section shall be amended to reflect any additions or deletions with respect to the location and boundaries of school property and drunk-driving-free school zones. The list of school crossings designated above by the Governing Body shall continue to constitute an official finding and record of the location of school crossing zones within the Township of Fairfield until such time, if any, that this section shall be amended to reflect any additions or deletions with respect to school crossing zones in the Township.

The school board, or the chief administrative officer in the case of any private or parochial school, is hereby directed and shall have the continuing obligation to promptly notify the office of the Township Engineer and the Township Attorney of any changes or contemplated changes in the location and boundaries of any property owned by or leased to any elementary or secondary school or school board and which is used for school purposes or of any additions or deletions to school crossings.

The Township Clerk is hereby directed to receive and to keep on file the original of the map approved and adopted pursuant to subsection 7-9.2 of this section and the list of school crossings and to provide at a reasonable cost a true copy thereof to any person, agency or court which may from time to time request such a copy, along with a certification that such copy is a true copy of the map approved and adopted herein and kept on file. It is hereby further directed that a true copy of such map and list and of this section shall be provided without cost to the Essex County Clerk and to the office of the Essex County Prosecutor.

The following additional matters are hereby determined, declared, recited and stated:
It is understood that the map and list approved and adopted pursuant to this section was prepared and is intended to be used as evidence in prosecutions arising under the criminal and traffic laws of this State and that, pursuant to State law, such map and list shall constitute prima facie evidence of the following:
a. 
The location of elementary and secondary schools within the municipality.
b. 
The boundaries of the real property which is owned by or leased to such schools or a school board.
c. 
That such school property is and continues to be used for school purposes.
d. 
The location and boundaries of areas which are on or within 1,000 feet of such school property.
e. 
The location of all school crossings in the Township of Fairfield.

a. 
Prohibited Vehicles. No vehicle, whether passenger or commercial, over a registered gross weight of four tons shall be permitted to use any of the Township streets, roads or public rights-of-way, except as may be required to transport materials, goods or services directly to or from a particular location with the Township, or in order to travel directly to or from a location within the Township wherein the parking or storage of the vehicle is a permitted use.
b. 
Violations and Penalties. Any person who shall drive or permit, through an agent, to be driven a vehicle over a registered gross weight of four tons on any of the streets, roads or public rights-of-way of the Township, on conviction thereof, shall be subject to a fine of not less than $100, nor more than $500 and for each and every subsequent violation, each of which shall constitute a separate offense.
c. 
Notice. Proper notices of the above regulations are to be posted on such Township streets, roads and public rights-of-way of the Township as required by law.

The following locations on roads of the County of Essex are hereby designated as bus stops within the Township of Fairfield upon which Culver Amherst, L.L.C., shall install and maintain bus shelters pursuant to the terms of its agreement with the Township dated October 27, 1998:
1. 
Fairfield Road, eastbound approximately 200 feet east of Appet Court;

Fairfield Road, eastbound approximately 167 feet east of Kulick Road;
3.

The Mayor and other officials of the Township be and are hereby authorized and directed to execute an indemnification agreement with the County of Essex regarding the aforesaid bus shelters and their use.
Note: Below are minimum standards for bus stop length which are based on recommendations of the Institute of Transportation Engineers and Studies conducted by the Bureau of Traffic Engineering and Safety programs. These standards include minimum lengths required for Bus Stops in order that buses may leave moving traffic lanes safely. Keeping in mind that buses alongside the curb within six inches thereof as provided by State law pursuant to N.J.S.A. 39:4-135. These minimums are as follows:
NEAR SIDE - 90 feet plus the distance from the curbline to the end of the curb return, property line or crosswalk approximately 105 inches to 120 feet. Minimum acceptable length is one 105 feet.
FAR SIDE - Eighty-five inches plus the distance from the curbline to the end of the curb return, property line or crosswalk approximately 105 feet to 120 feet. Minimum acceptable length is 105 feet.
MID-BLOCK - No intersection on either side of roadside minimum acceptable length is 135 feet.
FAR-SIDE - (AFTER BUS MAKES RIGHT TURN) - Minimum acceptable length is 150 feet. An additional 45 feet of length should be provided for each additional bus expected to stop simultaneously.

The purpose of this section is to control and regulate recreational motor-driven vehicles within the Township of Fairfield in order to preserve the public peace and order and protect the health and welfare of the general public of the Township.

RECREATIONAL MOTOR-DRIVEN VEHICLES
Shall include, but are not limited to, mini-bikes, electric bicycles, motorized bicycles, hybrid bicycles, motorized scooters, motorized skateboards, motor cross bikes, go-carts, mopeds, snowmobiles, ATVs (all-terrain vehicles) or other similar types of motor-driven vehicles used for recreational purposes.

It shall be unlawful for any person to operate or permit and suffer to be operated a motor-driven vehicle, as defined herein, within the Township under the following circumstances:
a. 
On private property of another without the express, prior, written consent of the owner and the occupant of the property.
b. 
On any public grounds or property.
c. 
In such manner as to create loud, unnecessary or unusual noise so as to disturb or interfere with the peace and quiet of other persons.
d. 
In a careless, reckless or negligent manner so as to endanger or be likely to endanger the safety or property of any person.

Every person convicted of a violation of a provision of this section shall be liable to a penalty of not more than $100 and shall serve a minimum of two days of community service or be liable to imprisonment for a term not exceeding 15 days.

In order to provide safe pedestrian access to the Fairfield Recreation Complex to the main park entrance along Hollywood Avenue, the following area is hereby designated as a pedestrian walkway:

In any space on public or private property appropriately marked for vehicles for the physically handicapped pursuant to P.L. 1977 c202 (C.39:4-197.5), P.L. 1975 c217 (C.52:27D-119 et seq.) or any other applicable law unless the vehicle is authorized by law to be parked therein and a handicapped person is either the driver or a passenger in that vehicle. State, County or municipal law enforcement officers shall enforce the parking restrictions on spaces appropriately marked for vehicles for the physically handicapped on both public and private property. (chgd. by L1989, c201(1), eff. 6/1/90).
No person shall move a vehicle not lawfully under his control into any such prohibited area or away from a curb such distance as is unlawful.
Pursuant to P.L. 2003, Chapter 161, the penalties for violations hereof must be $250 for the first offense and for a subsequent offense must be a fine of at least $250 and up to 90 days community service on such terms and in such form as the court shall deem appropriate, or any combination thereof.

The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township of Fairfield. The owner shall be responsible for the repair and restoration or replacement of same.

Any person parking a motor vehicle in a designated restricted parking space without a special vehicle identification card shall be fined $250 for the first offense and, for subsequent offenses, a fine of at least $250 and up to 90 days community service on such terms and in such form as the Court shall deem appropriate, or any combination thereof.

Speed limits shall be established as follows: Regulatory and warning signs, conforming to the current Manual on Uniform Traffic Control Devices for Streets and Highways, shall be erected and maintained to effect the designated speed limit(s), as required by the Commissioner of Transportation of the State of New Jersey and as specified and authorized in writing from the Bureau of Traffic Engineering of the Department of Transportation.

In accordance with the provisions of N.J.S.A. 39:4-197, the following Municipal and Board of Education Property shall have the movement of traffic controlled by the type of regulation indicated. No person shall operate, or park a vehicle in violation of the regulations indicated.
a. 
Parking in Fairfield Recreation Complex.
Regulations. The following traffic regulations shall apply to the Fairfield Recreation Complex:
No person shall park, stop or allow to stand any vehicle on the entrance roadway of the complex.
Handicapped Parking Spaces.
Two spaces shall be designated in Parking Lot No. 1 as handicapped parking spaces.
No person shall stop or stand a vehicle except in stalls provided.
All vehicles are to be parked at a 90° angle.
All vehicles are to be parked between the painted white lines.
Speed Limits.
The speed limit shall be 10 miles per hour throughout the parking area.
No vehicle shall park, stop or stand in the Recreation Complex after closing time.
Violators to Be Towed. Vehicles parking in violation of the above regulations shall be subject to summons and shall be towed away at the owner's expense.
Sign Standards. All signing shall conform to the Manual of Uniform Traffic Control Devices for Streets and Highways.
b. 
Parking at Fairfield Firehouse Regulations.
The following traffic regulations shall apply to the Fairfield Firehouses on Plymouth Street and Fairfield Road:
No person shall park, stop or allow to stand any vehicle on the entrance roadway or aprons of the firehouses.
No vehicle shall be parked in any space designated "No Parking-Fireman Only."
No person shall stop or stand a vehicle except in stalls provided.
Speed limit. The speed limit shall be 10 miles per hour throughout the parking areas.
Violators to Be towed. Vehicles parking in violation of the above regulations may be subject to summons and towed away at the owner's expense.

Property Occupied for Business (Commercial and Industrial) Use
a. 
No trucks or delivery vehicles may enter onto and park on property occupied for business (commercial and industrial) use:
1. 
Unless the truck or delivery vehicle has a business purpose (loading or unloading goods), or
2. 
When the vehicles have a business purpose but the business on the property is closed for regularly scheduled deliveries, or
3. 
When the vehicles have a business purpose but enter upon a property that is located adjacent to a residential zone between the hours of 10:00 p.m. to 6:00 a.m.
b. 
The hours of delivery must be conspicuously posted at each place of business by the owner or operator of each business.
Violations and Penalties. Unless another penalty is expressly provided by New Jersey Statute, conviction of a violation under this subsection or any supplement thereto shall be liable to a penalty of not more than $250, except that for a violation of a section of N.J.S.A. Title 39, Subtitle 1, Chapter 4, Article 11 (N.J.S.A. 39:4-80 et seq.), Article 13 (N.J.S.A. 39:4-105 et seq.), Article 14 (N.J.S.A. 39:4-123 et seq.) or Article 17 (N.J.S.A. 39:4-140 et seq.) or any supplement thereto for which no specific penalty is provided, the offender shall be liable to a penalty of no more than $500 per violation.
Exemptions. Properties occupied for business (commercial and industrial) use are exempted from the above regulation if activities of deliveries and parking are conducted at a distance greater than 750 feet from the boundary of any adjoining residential zone.
Effect of Regulations. If any part of this subsection is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of the subsection.
Enforcement. This subsection shall be enforced by the Township of Fairfield Police Department. Any member of the Fairfield Police Department, charged with enforcement of this subsection, after displaying proper identification, may inspect any matter, thing, premises, or place as may be necessary for the proper enforcement thereof.

In accordance with the provisions of N.J.S.A. 39:5A-1 the regulations of Subtitle 1 of Title 39 are hereby made applicable to the properties listed below.
a. 
Stepping Ridge Condominium. The provisions of Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey be and are hereby made applicable to the private roadways and parking lots at the above referenced property located within the Township. Said statutes and the regulations which follow shall be enforceable upon this property.
b. 
Private Property on Lots 3, 4 and 6, Block 2901, in the Township of Fairfield, Essex County, along Route 46 Eastbound, being the parking lot of the property formerly known as "The American Way Mall" and currently occupied by "The Target Store". The provisions of Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey be and are hereby made applicable to the private roadways and parking lots of the above referenced property located within the Township. Said statutes and the regulations which follow shall be enforceable upon this property.
c. 
Sterling Green. The provisions of Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey be and are hereby made applicable to the private roadways and parking areas of the above-referenced property located within the Township. Said statutes and the regulations which follow shall be enforceable upon this property.
d. 
Adlai Stevenson School. The provisions of Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey be and are hereby made applicable to the private roadways and parking areas of the above-referenced property located within the Township. Said statutes and the regulations which follow shall be enforceable upon this property. The regulation which will be enforceable upon this property is the addition of a stop sign at the right-of-way at the end of Knoll Road prior to entering the school property.
e. 
The following regulations shall be enforceable as to the properties referenced in paragraphs a, b, c and d.
1. 
General Parking.
(a) 
Stepping Ridge Condominium. Said area is set forth with reasonable accuracy on a certain plan entitled "Final Site Plan, Stepping Ridge Condominiums", dated June 11, 1999 which said plan is on file in the Office of the Chief of Police of the Township of Fairfield and in the Office of the Township Clerk. The plan indicates areas in which parking is regulated. All vehicles must park in designated areas and between the lines provided.
(b) 
The Target Store. Said area is set forth with reasonable accuracy on a certain plan entitled "Target" dated February 8, 2000, which said plan is on file in the Office of the Chief of Police of the Township of Fairfield and in the Office of the Township Clerk. The plan indicates areas in which parking is regulated. All vehicles must park in designated areas and between the lines provided.
(c) 
Sterling Green. Said area is set forth with reasonable accuracy on a certain plan entitled Sterling Green Layout and Dimension Plan dated June 24, 1999 which plan is on file in the Office of the Chief of Police of the Township of Fairfield and in the Office of the Township Clerk. The plan indicates areas in which parking is regulated. All vehicles must park in designated areas and between the lines provided.
2. 
Through Streets and Stop Intersections. The plans set forth above herein indicate areas in which stopping is regulated and also designate areas for one-way traffic, entrances and exits from said sites. The owners of said properties shall ensure that all required markings and sign designations applying Subtitile 1 of Title 39 to said property are posted prominently and in accordance with all applicable laws and regulations.
3. 
Speed Limits.
(a) 
The speed limit for travel on all roadways shall be 25 miles per hour.
(b) 
Regulatory and warning signs shall be erected and maintained by the owners of said properties to effect the above designated speed limits authorized by the New Jersey Department of Transportation.
4. 
Tow Away. Any vehicle parked or standing as to obstruct or impede normal flow of traffic, block entrances or exit ways, any grassy area, pedestrian walkway or present in any way a safety or traffic hazard may be removed by towing the vehicle at the vehicle owner's or operator's expense.
5. 
Signing. All signs, posts or other necessary materials shall be installed pursuant to the plan specified in paragraphs a and b above and shall be paid for by the property owners. All signing shall conform to the current Manual on Uniform Traffic Control Devices pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27.
6. 
Violations and Penalties. Unless another penalty is expressly provided by New Jersey Statute, conviction of a violation under this subsection or any supplement thereto shall be liable to a penalty of not more than $100 or imprisonment of a term not exceeding 15 days or both.
7. 
Effect of Regulations. If any part of this section is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this section.
f. 
76 Little Falls Road. Title 39, Motor Vehicle and Traffic Regulations, shall be enforced at the property located at 76 Little Falls Road.

The owners of the premises referred to in this section shall provide and install signs and pavement markings as required, which signage and markings shall be in accordance with the Manual of Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of the property. The owner shall, subsequent to the initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township. The owner shall be responsible for the repair and restoration or replacement of same.

a. 
Township of Fairfield hereby determines to install and utilize a traffic control signal monitoring system ("System") at various intersections within the Township of Fairfield as approved by the Commissioner of Transportation pursuant to the Act.[1]

b. 
The System to be installed shall be approved by the Governing Body by resolution.
c. 
The Township shall have the authority to enter into a contract, following a lawful procurement process, for the installation of the System. Any contract that shall contain provisions contrary to the Act shall not be deemed invalid but rather reformed to conform to the Act.
d. 
The signs notifying drivers that a System is being utilized shall be approved by the Municipal Engineer, and shall be placed on each street converging into the affected intersection as required by the Act.
e. 
The Municipal Engineer shall inspect and certify the System at least once every six months from the date of its installation.

The Police Department of the Township of Fairfield shall review the recorded images produced by the System, to determine whether sufficient evidence exists demonstrating that a traffic control signal violation has occurred and shall issue a summons when appropriate in accordance with the rules of the Court.

a. 
Except as otherwise provided in this section, the recorded images produced by the System shall be available for the exclusive use of the Police Department for the purpose of discharging his or her duties under P.L. 2007, Ch. 384.
b. 
Any recorded image or information produced in connection with the System shall not be deemed a public record under N.J.S.A. 47:1A-1 et seq., or common law. The recorded images shall not be: (i) discoverable as a public record by any person, entity, or governmental agency, except upon a subpoena issued by a grand jury or a court order in a criminal matter, or (ii) offered as evidence in any civil or administrative proceeding not directly related to a traffic control signal violation.
c. 
Any recorded image or information collected in connection with a traffic control signal violation shall not be retained after 60 business days following the collection of any fine or penalty.
d. 
If a summons is not issued within 30 business days following the traffic control signal violation, all recorded images and any information collected with respect to the traffic control signal violation shall be removed by the Police Department within two business days.
e. 
The Township of Fairfield shall certify compliance of this section by filing a report to with the Commissioner of Transportation in accordance with the Act.

The liability of the owner and operator of a motor vehicle for a traffic control signal violation summons pursuant to the System shall be joint subject to provisions of the Act.

Any person liable for a traffic control signal violation, pursuant to the section and the Act, utilizing the System shall be subject to fines as determined by the Administrative Office of the Court and/or the Municipal Court of the Township of Fairfield.
