a. 
There is hereby established in the Township of Fairfield a State Uniform Construction Code Enforcing Agency entitled "Building Department," consisting of a Construction Official, Building, Electrical, Fire Protection and Plumbing Subcode Officials and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency.
b. 
Each official position created in paragraph a shall be filled by a person qualified for such position pursuant to P.L. 1975, c.217, as amended, and N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that the person is qualified pursuant to P.L. 1975, c.217, and N.J.A.C. 5:23 to hold each such position.
c. 
The public shall have the right to do business with the enforcing agency at one office location except for emergencies and unforeseen or unavoidable circumstances.
d. 
The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Mayor and Council, biannually, a report recommending a fee schedule based on the operating expenses of the agency and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act.[1]

e. 
Surcharge Fee.
1. 
In order to provide for the training, certification and technical support programs required by the Uniform Construction Code Act and the regulations, the enforcing agency shall collect, as listed in the fees in subsection 10-1.3, a surcharge fee per cubic foot of volume of new construction. The surcharge fee shall be remitted to the Bureau of Housing Inspection, Department of Community Affairs, on a quarterly basis for the fiscal quarters ending September 30, December 31, March 31 and June 30, and not later than one month next succeeding the end of the quarter for which it is due.
2. 
The enforcing agency shall report annually, at the end of each fiscal year, to the Bureau of Housing Inspection, and not later than July 31, the total amount of the surcharge fee collected in the fiscal year.

a. 
The fee for a construction permit shall be the sum of the subcode fees listed below hereof and shall be paid before the permit is issued.
1. 
Building Subcode Fees: The Building Subcode Fees shall be:
(a) 
Fees for new construction shall be based upon the volume of the structure. Volume shall be computed in accordance with the N.J.A.C. 5:23-2.28. The new construction fee shall be in the amount of $0.50 per cubic foot of volume for buildings and structures of all use groups and types of construction as classified and defined in article 3 and 4 of the building subcode;
(b) 
Fees for Rehabilitation (renovations, alterations and repairs) shall be based upon the estimated cost of the work. The fee shall be in the amount of $30 per $1,000 from $50,001 to and including $100,000; and an additional fee in the amount of $19 per $1,000 estimated cost above $100,000. For the purpose of determining estimated cost, the applicant shall submit to the Department such cost data as may be available produced by the architect or engineer of record or by a recognized estimating firm or by the contractor. A bona fide contractor's bid, if available, shall be submitted. The Department shall make the final decision regarding estimated cost.
(c) 
Fees for additions shall be computed on the same basis as for new construction for the added portion.
(d) 
Fees for combination renovations and additions shall be computed as the sum of the fees computed separately in accordance with items (b) and (c) above.
(e) 
Minimum Fee: The minimum fee shall be $58.
(f) 
Fee for single-family roofing and siding shall be a flat fee of $100.
2. 
Plumbing Subcode Fee: The Plumbing Subcode Fees shall be (the Uniform Construction Code Fee Schedule).
(a) 
Fixtures and Stacks: The fee for each fixture or stack including but not limited to all sinks, urinals, water closets, bathtubs, shower stalls, laundry tubs, floor drains, drinking fountains, dishwashers, garbage disposals, clothes washers, hot water heaters, sump pumps or similar devices shall be $13 each.
(b) 
Special Devices: The fee for each special device, including but not limited to grease traps, oil separators, water-cooled air conditioning units, refrigeration units, utility service connections, back flow preventers, steam boilers, hot water boilers (excluding those for domestic water heating), gas piping, gas service entrances, active solar systems, sewer pumps, interceptors and fuel oil piping shall be $82 each.
(c) 
Minimum Fee: The minimum fee shall be $58.
3. 
Electrical Subcode Fee: The Electrical Subcode Fees shall be: The State Fee Schedule.

(d) through (g): For the purpose of calculating the following electrical fees, all motors except those in plug-in appliances shall be counted including control equipment, generators, transformers and all heating, cooking or other devices consuming or generating electrical current.
(d) 
Each motor or electrical device greater than one hp and less than or equal to 10 hp; and for transformers and generators greater than one kW and less than or equal to 10 kW, horns, exit lights, one 15 kva transformer: $13.
(e) 
Each motor or electrical device greater than 10 hp and less than or equal to 50 hp; for each service panel, service entrance or sub panel less than or equal to 200 amperes; and for all transformers and generators greater than 10 kW and less than or equal to 45 kW: $58.
(f) 
Each motor or electrical device greater than 50 hp or equal to 100 hp; for each service panel, service entrance or sub panel greater than 200 amperes and less than or equal to 1,000 amperes; and for transformers and generators greater than 45 kW and less than or equal to point 112.5 kW: $116.
(g) 
Each motor or electrical device greater than 100 hp; for each service panel, service entrance or sub panel greater than 1,000 amperes, and for each transformer or generator greater than 112.5 km: $576.
(h) 
Signs: $58.
(i) 
Elevators: $58.
(j) 
Low voltage wiring fire alarm system, burglar alarm system, commercial low voltage: $58.
(k) 
Modular homes: Same as (a) through (e).
(l) 
Pole lights: $576 plus $13 for each additional pole.
(m) 
Modular office panels: $13.
(n) 
Special and overtime inspections: $150 per hour, minimum $500.
(o) 
Pools:
(1) 
Motor (pumps, jacuzzi, etc.): $13.
(2) 
Outlets: $58.
(3) 
Panels or disconnects: $58.

4. 
Mechanical Systems and Equipment: The fees for mechanical systems and equipment shall be as follows:
(a) 
Residential one and two family structures under 10,000 square feet: There shall be a fee for mechanical system and equipment installed in residential one and two family structures of less than 10,000 square feet, as follows:
(1) 
For heating and cooling units including forced hot air furnaces, hot water boilers, stream boilers or any solar heating devices: $58.
(2) 
For heating and cooling unit replacement: $58.
5. 
Elevator Fees: The fee for elevators shall be:
(a) 
The basic fees for elevator devices in structures, except Use Group R-3 or R-4 shall be as follows:
(1) 
Traction and winding drum elevators: one to 10 floors: $306.
(2) 
Hydraulic elevators: $272.
(3) 
Roped hydraulic elevators: $306.
(4) 
Escalators, moving walks: $436.
(5) 
Dumbwaiters: $68.
(6) 
Stairway chairlifts, inclined and vertical wheelchair lifts and manlifts: $164.
(b) 
Additional charges for devices equipped with the following features shall be as follows:
(1) 
Oil buffers (charge per oil buffer): $54.
(2) 
Counterweight governor and safeties: $136.
(3) 
Auxiliary power generator: $102.
(c) 
The fee for elevator devices in structures in Use Groups R-3 and R-4 shall be $150.
(d) 
The fee for witnessing acceptance tests of and performing inspections of alterations shall be $58.
(e) 
Routine and periodic tests and inspection fees: The fees for routine and periodic tests and inspections for elevator devices in structures not in Use Group R-3 or R-4 shall be as follows:
The fee for six-month routine inspection of electric devices shall be as follows;
(1) 
Traction and winding drum elevators, one to 10 floors $190.
(2) 
Over 10 floors: $244.
(3) 
Hydraulic elevators: $136.
(4) 
Roped hydraulic elevators: $190.
(5) 
Escalators, moving walks: $190.
(f) 
The fee for the one year periodic inspection and witnessing of tests of elevator devices, which shall include a six-month routine inspection, shall be:
(1) 
Traction and winding drum elevators, one to 10 floors: $272.
(2) 
Over 10 floors: $326.
(3) 
Hydraulic elevators: $204.
(4) 
Roped hydraulic elevators: $272.
(5) 
Escalators, moving walks: $436.
(6) 
Dumbwaiters: $108.
(7) 
Manlifts, stairway, chairlifts, inclined and vertical wheelchair lifts: $164.
(g) 
Additional yearly period inspection charges for elevator devices equipped with the following features shall be as follows:
(1) 
Oil buffers (charge per oil buffer) : $54.
(2)

(h) 
The fee for the three year or five year inspection of elevator devices shall be as follows:
(1)

Three year inspection: $340.

6. 
Fire Subcode Fees: The fee for fire protection and other hazardous equipment: sprinklers, standpipes, detectors (smoke and heat) pre-engineered suppression systems, gas and oil fired appliances not connected to the plumbing system, kitchen exhaust systems, incinerators and crematoriums shall be:
(a) 
Sprinklers and Detectors:
20 or fewer heads: $82.
Relocate sprinkler minimum fee: $58.
21 to and including 100 heads or detectors: $151.
101 to and including 200 heads or detectors: $289.
201 to and including 400 heads or detectors: $748.
401 to and including 1,000 heads or detectors: $1,036.
Over 1,000 heads or detectors: $1,323.
(b) 
In computing fees for heads and detectors, the number of each shall be counted separately and two fees, one for heads and one for detectors shall be charged.
(c) 
Each standpipe: $289.
(d) 
Each independent pre-engineered system: $58.
(e) 
Each gas or oil fired appliance not connected to the plumbing system: $58.
(f) 
Each kitchen exhaust system: $58.
(g) 
Each incinerator: $338.
(h) 
Each crematorium: $338.
7. 
Sign Fees: The fee for a permit to construct a sign shall be $2.50 per square foot of the surface of the sign, whether single or double faced, provided that the minimum fee shall be $58.
8. 
Renovations, alterations, repair and minor work fees: The fee for renovations, alterations, repairs and minor work shall be $30 per $1,000 of costs or any fraction thereof.
9. 
Demolition Permit Fee: The fee for a permit for demolition of a building or structure shall be:
(a) 
Residential building: $82.
(b) 
Nonresidential building: $151.
10. 
Heating and Cooling Units: For the installation of heating and cooling units, residential $58 per unit. The fee for the permit and inspection of an oil tank or oil burner shall be $58 each. The installation of heating and cooling units in nonresidential structures shall be $22 per $1,000 of the installation costs.
11. 
Fees for Certificate of Occupancy shall be:
(a) 
New Construction: The Certificate of Occupancy fee for new construction shall be 10% of the new construction permit fee, provided that the minimum fee shall be $111.
(b) 
Exceptions: Certain one and two family residences - The minimum fee for one and two family residences less than 5,000 square feet in area and less than 30 feet in height shall be $111.
(c) 
Temporary Certificate of Occupancy: The fee shall be $35.
(d) 
Certificate of Continued Occupancy: The fee for Certificates of Continued Occupancy shall be $151, except that the fee for a Certificate of Continued Occupancy for one and two family residences less than 5,000 square feet in area and less than 30 feet in height shall be $151.
(e) 
Certificate for Change of Use: The fee for a Certificate of Occupancy granted for a change of use shall be $151.
(f) 
Certificate of Approval: The fee for Certificates of Approval shall be $58.
(g) 
Certificate of Compliance: The fee for Certificates of Compliance shall be $58.
12. 
Variations from Code: The fees shall be:
(a) 
Class I Structures: $550.
(b) 
Class II and III Structures: $111.
13. 
Resubmission of Application for Variations: The fees shall be:
(a) 
Class I Structures: $212.
(b) 
Class II and III Structures: $60.
14. 
Building Plan Review. The fee for building plan review shall be 20% of the amount to be charged for the construction permit and shall be paid before the plans are reviewed. The amount paid for this fee shall be credited toward the amount of the fee to be charged for the construction permit, but shall not be refundable in the event a construction permit is not issued.
15. 
Fees for inspection of equipment requested by applicant. If any inspections are required by any equipment encompassed by this act, by an application, such inspections fees, in their entirety, shall be assessed to the applicant.
16. 
Notwithstanding the above schedule of fees, a Third Party Agency fees, any fees herein omitted from the above schedule, and any new or upgraded fees adopted pursuant to P.L. 1975 c. 217, the UCC Act (N.J.S.A. 52:27D-119 et seq.); and promulgated by the Commissioner of the Department of Community Affairs shall be adjusted to conform to the fee schedule of the Department of Community Affairs. Whenever the Township of Fairfield shall contract with private on-site inspection and plan review agencies to administer a subcode(s) a surcharge of 15% shall be added to the relevant subcode(s) permit fee(s). The surcharge shall apply only to subcode areas for which the municipality has a contract with the on-site agency.

The elevation of the finished garage floor shall be a minimum of one foot six inches above the center line of the street unless otherwise approved by the Construction Official. See also Chapter 42, subsection 42-5.1.

A foundation location survey, prepared by a licensed New Jersey Land Surveyor, must be submitted to and approved by the Construction Official before any framing can be started. The difference in elevation between a finished garage floor and the center line of the street immediately in front of the garage shall be certified by the surveyor on the survey.

All licensed retail food establishments must install and properly maintain grease traps. Said devices shall operate to separate, capture and contain all rendered animal fat, all oily matters and all thick lubricants from wastewater discharging from any of the aforementioned food establishments and flowing into the sewer system.
In addition to routine inspections by the Engineering, Construction, Water or Health Departments, all establishments required to maintain a grease trap must employ, at their own expense, a licensed plumber to conduct an inspection of their grease traps and connecting wastewater lines to ensure that waste oil and grease are being adequately removed from wastewater being discharged into the sewer system. Said inspector will be required to provide a formal inspection report to the Building and Health Departments certifying the proper operation and efficacy of the grease trap. Said report shall be provided on a quarterly basis for those establishments employing double fryers or more than one single fryer unit. Said reports shall be filed on an annual basis for those establishments employing a single fryer unit.

a. 
String lights and flashing lights may not be installed, affixed to, or placed on the exterior of any structure, nor affixed to the interior of any uncovered window so that it is visible from the exterior of the structure.
b. 
Exemptions to Outdoor Lighting Prohibition. The following lighting fixtures are exempt from the lighting prohibition set forth in this section:
1. 
Lighting fixtures that must conform with federal or state regulations, such as airport runway lights, TV and radio transmission towers, telecommunication towers and railroad lights.
2. 
Holiday lights and decorations in place during the period between November 15 and January 15, except such lights shall not cause excessive glare that creates a public safety hazard.
3. 
String lights may be installed in a rear deck or patio area at the rear of the structure so long as the lights are not visible from the street.
