This chapter is enacted to regulate and control hotel and motel
rentals. Fairfield Township has a duty to the community, and other
overnight guests, and an interest to protect the members of the public,
from hotel and motel guests who are unwilling to act responsibly,
and so the Township Council has deemed it appropriate to enact these
regulations limiting the use of hotel and motel rooms and requiring
certain registration requirements.

SPECIAL HOTEL PROGRAM
Shall mean any program a guest is a member of through a participating
hotel chain or hotel service provider, provided law enforcement can
identify the guest and occupants from the records provided to enforce
this law.
SUITE
Shall mean hotel or motel room that is more than double the
size of a hotel's or motel's standard room size.

It shall be unlawful for an operator of a motel/hotel to fail
to require identification of the guest registrant as required above;
or to refuse to provide such information to a Police Officer; provided,
however, that any duty required under this section terminates on and
after the sixty-day following the date the guest registrant vacates
the motel/hotel.

Registration shall be limited to 14 consecutive days. Upon the
expiration of the 14th day, in order for the guest registrant to extend
his/her stay, the operator must obtain a new registration; or if the
stay is less than 14 days, but there is a break of a day or more in
between the next registration.

The operator of the hotel/motel shall not permit guest registrants,
guests or visitors to adversely interfere with the peace and quiet
of the hotel/motel or other guests of the hotel/motel.

No person shall indulge in and/or utter loud, offensive, or
indecent language in and about a hotel/motel in such a manner or such
a degree of loudness as to be injurious to public health or to interfere
with, or prevent the sleep or repose of any other guests or visitors
to the hotel/motel or to disturb the peace and quiet of the hotel/motel
or any of its other guests.

The operator of a motel/hotel shall be responsible for the control
of the guest registrant, other guests and visitors to ensure against
excessive noise, music, singing and/or entertainment occurring in
any room rented by the guest registrant, other guests or visitors
for that lodging unit or room. Accordingly, if such guest registrant,
other guests or visitors of a room shall act inappropriately in regard
to excessive noise, music, singing and/or entertainment, and having
been advised that their noise, singing, music or entertainment is
excessive, the guest registrant, other guests or visitors shall continue
to make noise, sing, play music or have entertainment that is excessive
as to the level of noise made such that neighbors of the hotel/motel
or third party guests of the hotel/motel complain of the noise, singing,
music or entertainment, then the operator shall be required to seek
Police Officer intervention to remove the subject guest registrant
and his/her other guests and visitors from the rented room to ensure
the peace and tranquility of the motel/hotel. Failure to do so may
result in a violation of this chapter, which carries a fine of $1,250.

If the Police respond to any complaint regarding excessive noise,
music, singing or entertainment occurring in any room of the hotel/motel
with or without hotel/motel operator contact having been previously
provided, the Police in their sole discretion may remove such guest
registrant, guests or visitors from the premises based on the Police
observations of the circumstances then existing.

No person shall loiter in or upon any street, sidewalk, or public
place or in or about any hotel/motel so as to interfere with the free
and unobstructed access, presence or egress thereof by the public,
nor utter or make any loud, indecent, abusive or offensive language
or noise thereon; nor engage in any game of chance for money or other
valuable thing in such hotel/motel.

No person shall enter, without legitimate and reasonable business,
or for an unlawful purpose or any other purpose upon any hotel/motel
without having previously obtained permission of the owner or person
in lawful control and possession of the place to use the furniture,
showers, toilets, or any other facilities, or loiter or roam about
the premises.

Any violation of any provision not specifically referencing
a fine is subject to a fine of $1,250. Each and every violation of
any portion of the chapter shall be considered a separate violation
of this chapter.
