The regulations set forth in this Article or set forth elsewhere in Part 3 of this chapter and referred to in this Article are the district regulations in the R-4 Garden Apartment District.

A building or premises shall be used only for the following purposes:
A. 
Garden apartments.
B. 
Townhouses.
C. 
Areas for parking private automobiles for which no fee is charged in connection with a building or structure on the same lot or on a bordering lot, provided that such building or structure is used as permitted in this Article.
D. 
Temporary signs, as defined in § 40-601 shall be permitted in this district.
E. 
Family day-care homes.
F. 
Group homes for the developmentally disabled.

Except as hereinafter provided, no building shall be erected to a height in excess of two and one-half (2 1/2) stories or thirty-five (35) feet.

A. 
Front Yard. There shall be a front yard having a setback from the street line a distance at least equal to the average of the setbacks of all street walls within one hundred (100) feet on either side of the street wall in question and within the same street and block frontage, provided that in no case shall a setback of more than twenty (20) feet from the street line be required as a front yard, and provided further that a projection in the form of a one-story vestibule, hood or storm enclosure on the front of the building shall be exempt from the above front yard setback requirement if the projection does not extend at any point more than four (4) feet six (6) inches beyond the required setback line, and provided that the street wall of the projection shall not exceed in length the greater of the following: forty (40%) percent of the street wall of the building or twenty (20) feet.
B. 
Side Yard. Except as hereinafter provided in this Article, on each side of a building there shall be a side yard having a width of not less than ten (10%) percent of the average width of the lot; provided, however, that the side yard on both sides of the building shall be not less than ten (10) feet in width, but no such side yard need be of a greater width than thirty (30) feet.
C. 
Rear Yard. Except as hereinafter provided, there shall be a rear yard having a depth of not less than twenty-five (25) feet.
D. 
Lot Area.
1. 
There shall be a lot area of not less than twenty thousand (20,000) square feet, and all lots shall have a frontage on a public street of not less than one hundred (100) feet.
2. 
Maximum Density. Maximum density shall not exceed the following standards: garden apartments, twenty (20) units per acre; townhouses, twelve (12) units per acre.
E. 
Building Coverage. The building area shall not exceed thirty-five (35%) percent of the area of the lot for any use permitted in this district.
F. 
Minimum Area Requirements. The minimum required area for each unit shall be as follows:

G. 
Off-Street Parking Requirements.
1. 
At least two (2) off-street parking spaces shall be provided for each apartment. Such parking may be provided in garages, open space under structures or in outdoor parking areas.
2. 
Each outdoor parking area shall be appropriately lighted. Such lighting shall be directed toward the interior of the site and designed so as not to adversely impact on the adjoining residential properties or districts.
3. 
Each parking area shall be completely paved with bituminous concrete paving. Construction specifications shall be in accordance with the recommendations of the Borough Engineer.
4. 
No parking area shall be located closer than ten (10) feet from the principal building and five (5) feet from accessory buildings.
5. 
Each parking area shall be set back at least five (5) feet from any property line and at least ten (10) feet from property lines abutting other residential districts.
6. 
No parking area shall be located in any front yard.
7. 
Each parking area shall be appropriately landscaped in accordance with site plan recommendations of the Planning Board or Board of Adjustment.

Garden apartments shall be designed in accordance with the following requirements: Garden apartments shall be designed in accordance with all standards set forth in Parts 2 and 3 of this chapter. The design standards for townhouses shall be the same as for garden apartments, with the exception of the maximum density standard applicable to such use as contained in § 40-2004D2.
