Pursuant to N.J.S.A. 39:4-197 et seq. and N.J.S.A. 40:48-2.46, there hereby is established in the Township of West Caldwell restricted parking spaces for use by handicapped persons when using a motor vehicle on which is displayed a certificate for which a special vehicle identification card has been issued by the New Jersey Motor Vehicle Commission in accordance with the provisions of N.J.S.A. 39:4-204 et seq.

A restricted parking space shall be established by one of the following:
a. 
There has been adopted an ordinance, resolution or regulation creating such restricted parking space.
b. 
An approval has been granted by the appropriate land use agency of the Township of a development application, the plans for which designate particular space(s) as being restricted for use by handicapped persons.
c. 
An ordinance has been adopted establishing a restricted parking zone in front of a residence occupied by handicapped person(s) pursuant to N.J.S.A. 39:4-197.6.
d. 
A property owner has authorized enforcement of Title 39 on private property not open to the public pursuant to the provisions of N.J.S.A. 39:5A-1.
In accordance with the provisions of N.J.S.A. 39:4-197.6 and 197.7, the following on-street locations are designated as restricted parking zones. Such zones are for use by persons who have been issued special identification cards or plates or placards by the New Jersey Motor Vehicle Commission or a temporary placard issued by the Chief of Police. No other person shall be permitted to park in these parking zones.

Areas or spaces hereinafter designated as restricted parking spaces or zones shall be so marked by signs indicating said parking spaces in conformance with the Manual on Uniform Traffic Control Devices for Streets and Highways. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the property owner.

No person shall park, stop or stand a motor vehicle at any time in a restricted parking space or zone without possessing the necessary vehicle identification cards or plates or placards or without displaying on such vehicle the requisite identification card or plates or placards.

a. 
The terms and provisions of this section shall be enforced by the Township Police Department Zoning Officer, and such other persons as the Township may designate to enforce this section by resolution.
b. 
Any person convicted of a violation of this section shall be liable to a penalty of not less than $250, and for a second or subsequent offense shall be liable for a penalty of not less than $250, and imposition of up to 90 days' community service, or both.
c. 
Any motor vehicle improperly parked in a restricted handicapped parking space or zone may be towed therefrom by order of the Township Police Department pursuant to N.J.S.A. 39:4-207.7. The owner of such vehicle shall be responsible for all towing costs and storage fees in connection with the removal of the vehicle.

Pursuant to N.J.S.A. 39:5A-1, the provisions of Title 39 of the Revised Statutes of New Jersey are hereby made applicable to the semi-public roads, streets, driveways and parking lots on the following properties:
