There shall be a Municipal Clerk appointed by the Mayor and
Council. The qualifications, term and duties of the Clerk shall be
as per N.J.S.A. 40A:9-133 et seq. The Municipal Clerk shall hold a
Registered Municipal Clerk Certificate as required by law.

The Municipal Clerk shall:
a. Act as secretary of the municipal corporation and custodian of the
municipal seal and of all minutes, books, deeds, bonds, contracts,
and archival records of the municipal corporation. The Governing Body
may, however, provide by ordinance that any other specific officer
shall have custody of any specific other class of record;
b. Act as secretary to the Governing Body, prepare meeting agendas at
the discretion of the Governing Body, be present at all meetings of
the Governing Body, keep a journal of the proceedings of every meeting,
retain the original copies of all ordinances and resolutions, and
record the minutes of every meeting;
c. Serve as the chief administrative officer in all elections held in
the Borough, subject to the requirements of Title 19 of the Revised
Statutes;
d. Serve as chief registrar of voters in the Borough, subject to the
requirements of Title 19 of the Revised Statutes;
e. Serve as the administrative officer responsible for the acceptance
of applications for licenses and permits and the issuance of licenses
and permits, except where statute or municipal ordinance has delegated
that responsibility to some other municipal officer;
f. Serve as coordinator and records manager responsible for implementing
local archives and records retention programs as mandated pursuant
to Title 47 of the Revised Statutes;
g. Perform such other duties as are now or hereafter imposed by statute,
regulation or by municipal ordinance or regulation.

Pursuant to N.J.S.A. 40A:9-135 there is created the office of
Deputy Municipal Clerk, who may be appointed by the Mayor and Council
for a term of one calendar year or the unexpired portion thereof at
a compensation fixed by the Borough Council. The duties of the Deputy
Municipal Clerk shall be to aid and assist the Municipal Clerk under
the direction and supervision of the Municipal Clerk, and to perform
such duties as may be assigned by the Municipal Clerk, the Mayor and
Council, or the chairperson of any committee of the Borough Council,
and to have all of the powers and perform all the duties of the Municipal
Clerk for such times and for such specific periods as the Municipal
Clerk shall be absent.

The Mayor may nominate and with the advice and consent of the
Borough Council appoint a Borough Administrator. The Administrator
shall be appointed and removed subject to N.J.S.A. 40A:9-137 and 138.
During the absence or disability of the Administrator, the Mayor and
Council may designate an officer of the Borough to perform the duties
of the Administrator during such absence or disability.

The duties of the Business Administrator of the Borough shall
be to coordinate and maintain liaison among the various offices and
departments of the Borough and in connection therewith and under the
direction and supervision of the Mayor and Council to exercise general
supervision over the offices and departments except where his exercise
of such supervision would conflict with the laws of the State of New
Jersey. The Administrator may also serve as the Borough Clerk.

There is hereby created the office of Assistant Borough Administrator,
who may be appointed by the Mayor and Council for a term of one calendar
year or the unexpired portion thereof at a compensation fixed by the
Borough Council. The duties of the Assistant Borough Administrator
shall be to aid and assist the Borough Administrator under the direction
and supervision of the Borough Administrator, and to perform such
duties as may be assigned by the Borough Administrator, the Mayor
and Council, and to have all of the powers and perform all the duties
of the Borough Administrator for such times and for such specific
periods as the Borough Administrator shall be absent. The term of
the Assistant Borough Administrator may be terminated by Council with
60 days' notice.

There is hereby created the position of Municipal Attorney.

The Municipal Attorney shall be appointed by the Mayor, with
the advice and consent of the Borough Council, and shall serve a term
of office of one year commencing on January 1 of the year of appointment
and ending on December 31, or until a successor shall be appointed
and qualified.

The Municipal Attorney shall be a duly licensed Attorney-At-Law
of the State of New Jersey.

The duties of the Municipal Attorney shall be as follows:
a. The Municipal Attorney shall represent the Borough in all legal matters
and shall advise and assist the Mayor, the Council, and various department
and division directors as may be required. The Municipal Attorney
shall attend meetings of the Council, draft ordinances and resolutions
and give opinions and rulings on questions of law which may arise
at Council meetings. The Municipal Attorney shall prepare or approve
all legal instruments relating to the business of the Borough and
shall represent the Borough in any litigation and conduct trials,
appeals and other proceedings in which the Borough is interested as
the attorney may, in his or her discretion, determine to be necessary
or desirable, or as directed by the Mayor or Council;
b. The Municipal Attorney shall have the power to enter into any agreement,
compromise or settlement of any litigation in which the Borough is
involved, subject to the approval of Council;
c. Wherever he or she deems the interest of the Borough so to require,
the Municipal Attorney may, with the approval of the Mayor and within
the limits of available appropriations, appoint special counsel to
assist the Municipal Attorney in the handling of any legal matter.
If the Municipal Attorney should be disqualified with respect to any
matter, the Mayor may, with the approval of the Council, appoint special
legal counsel to represent the Borough for and with respect to such
matter;
d. The Municipal Attorney may designate another Attorney from their
office, who shall be a duly licensed Attorney-At-Law of the State
of New Jersey, to assist the Municipal Attorney in the handling of
the aforementioned duties at the Municipal Attorney's request, or
whenever the Municipal Attorney is temporarily unable to fulfill their
role.

There is hereby established the position of Prosecutor for the
Borough, which position shall be filled by the appointment of the
Mayor, with the advice and consent of the Council, to perform the
duties and functions as per N.J.S.A. 2B:25-1 et seq. The term of office
of the Prosecutor shall be one year, commencing January 1st of the
calendar year and concluding December 31st of the same year.

There shall be a Chief Financial Officer appointed by the Governing
Body. The term of office shall be four years, which shall run from
January 1 in the year in which the Chief Financial Officer is appointed.
The compensation for the Chief Financial Officer shall be separately
set forth in a municipal salary ordinance.

No person shall be appointed or reappointed as a Chief Financial
Officer unless he holds a Municipal Finance Officer Certificate issued
pursuant to the provisions of N.J.S.A. 40A:9-140.1 et seq.

There shall be an Assistant Chief Financial Officer appointed
by the Governing Body. The compensation for the Assistant Chief Financial
Officer shall be separately set forth in the municipal salary ordinance.
The Assistant Chief Financial Officer shall perform his duties
under the direction of the Chief Financial Officer and shall perform
the duties of the Chief Financial Officer in his absence.

There is created and established the office of Municipal Tax
Assessor in the Borough, pursuant to the provisions of N.J.S.A. 40A:9-146
et seq., who shall be appointed by the Mayor and Council and who shall
hold office for the term provided in said law. The Municipal Tax Assessor
shall hold a Tax Assessor Certificate as required by N.J.S.A. 40A:9-148.1.
The compensation for the Municipal Tax Assessor shall be separately
set forth in the salary ordinance.

There is created and established the office of Municipal Tax
Collector in the Borough, pursuant to the provisions of N.J.S.A. 40A:9-141
et seq., who shall be appointed by the Mayor and Council and who shall
hold office for the term provided in said law. The compensation for
the Municipal Tax Collector shall be separately set forth in the salary
ordinance.

There is hereby created the position of Municipal Engineer.
The executive responsibilities for the Municipal Engineering Department
will be filled by a Director of Engineering. There may also be an
Assistant Municipal Engineer. Both the Director of Engineering and
Assistant Municipal Engineer will comply with the provisions of this
section.

The Municipal Engineer shall be appointed by the Mayor, with
the advice and consent of the Borough Council, and shall serve a term
of office of three years commencing on January 1 of the year of appointment
and ending on December 31, or until a successor shall be appointed
and qualified.

The Municipal Engineer shall be a duly licensed professional
engineer of the State of New Jersey.

The Municipal Engineer shall have full charge of matters pertaining
to engineering in relation to any public improvement or other public
work. In addition, the Municipal Engineer shall perform all duties
required by statute or ordinance of the Municipal Engineer and shall
perform such engineering assignments and other services, including
attendance at meetings of the Borough Council, as may be required
by the Mayor and Council.

There shall be appointed an Emergency Management Coordinator.
The Emergency Management Coordinator shall serve for a term of three
years and be a resident of the Borough. As a condition of his appointment
and his right to continue for the full term of his appointment, each
Municipal Emergency Management Coordinator shall have successfully
completed at the time of his appointment or within one year immediately
following his appointment or the effective date of this act, whichever
is later, the current approved Home Study Course and the basic Emergency
Management workshop.

There is created and established the office of Municipal Code
Enforcement Officer, who shall be charged with enforcing all ordinances
within the Borough of Fair Haven and has the responsibility of ensuring
that all local, County and State ordinance regulations, and statutes
are observed and adhered to. The Code Enforcement Officer shall also
enforce the provisions outlined in the Fair Haven Borough Code, encompassing
such areas as building, zoning, property maintenance, required permits
and the like.

The salary of the Municipal Code Enforcement Officer shall be
as set forth in the salary ordinance of the Borough.

There shall be a Public Works Manager, who may be referred to
as the Director of Public Works, as required by State Statute and
he shall hold the appropriate Certificate as required by N.J.S.A.
40A:9-154.6a et seq. He shall be appointed by the Mayor and Council,
in accordance with N.J.S.A. 40A:9-154.6g. There may also be an Assistant
Director of Public Works who will serve under the Public Works Manager
and who will not be required to hold the aforementioned Certificate.

The Mayor and Council may appoint an intern or interns whose
position is hereby created. The intern(s) position shall be without
compensation and shall be to perform the duties as designated and
directed by the director or department head of the department to which
the intern is assigned. The intern shall be a student in an undergraduate
or graduate program at the time of appointment.
