The Borough of Watchung shall charge hourly rates and cost of disposables and testing or sampling used in response to an inspection, investigation, emergency response or for overseeing of clean-ups required as a follow up of a violation of any statute, rule, regulation, management plan or ordinance. This action may be initiated for any violation of the Solid Waste Management Act (N.J.S.A. 13:1E et seq., N.J.A.C. 7:26-5.1 et seq.) and for any act that violates the health and environmental laws regulating solid waste, medical waste, water pollution prevention and safe drinking water standards. Rates for such charges shall be set annually by resolution of the Governing Body.

Any person who violates any provision of, or order promulgated under this chapter shall, upon conviction thereof, be liable for a penalty of not less than $150 nor more than $500 for each violation. Each day a particular violation shall exist or continue shall constitute a separate offense. These penalties shall be in addition to the right of the Board of Health to refuse to issue a permit or license, and the right to revoke or suspend a permit or license for failure to pay the fee required therefor.
