As used in this section:
Shall mean all vehicles parking in a parking meter space shall face the parking meter controlling such space.
Shall mean an off-street parking lot designated for parking of vehicles of Township employees and officials.
Shall mean a person having his/her residence some place other than in the Township.
Shall mean a person who is employed in the Township and who resides elsewhere.
Shall mean any mechanical device or meter placed or erected for the regulation of traffic by authority of this section. Each parking meter installed shall indicate by proper legend the legal parking time established by the Township, and when operated, shall at all times indicate the balance of legal parking time, and at the expiration of such period, shall indicate illegal or overtime parking.
Shall mean any space within a parking meter zone in an off-street parking lot, adjacent to a parking meter, and which is duly designated for the parking of a single vehicle by lines painted or otherwise durably marked on the surface of the parking meter zone.
Shall mean a permit issued by the Township which shall entitle the owner or operator of the vehicle in connection with which the permit is issued to park the same in any municipal off-street parking lot, subject to the provisions of this section.
Shall mean an off-street parking lot or portion thereof which is restricted to the parking of vehicles for which a parking permit has been issued and is in effect and on which the insignia is displayed in accordance with the provisions of this section.
Shall mean a person having residence in the Township.

It is hereby determined that the areas hereinafter designated as municipal off-street parking lots are necessary for the orderly control of traffic in the Township.
The Township has two railroad stations on the Erie-Lackawanna Railroad that serve commuters from a broad area to Newark and New York. These stations are also contiguous to active shopping centers. Each of these uses requires parking facilities to accommodate customers with different demands for time for parking to suit their needs. Generally speaking, shopper parking is of short-time duration, so such spaces accommodate several customers in a business day. Commuter parking, however, usually accommodates only one customer per space per day.
The objective to be accomplished by this section is the separation of these two facilities of different requirements so one does not infringe on the use of the other, and to do this with a minimum cost of service to the Township.
It has been the policy of the Township to issue permits at a reasonable cost for commuters from and to our community. From a service cost standpoint, permits are the most economical to administer. Therefore, the provisions of this section will favor the use of permit parking for commuters and will require that the usual fee be deposited in a meter if a permit designated vehicle occupies a metered space in either a commuter or shopping area.

It is hereby determined and stated that the parking of vehicles in the municipal off-street parking lots provided and maintained by the Township shall be limited and regulated by the imposition of fees for the privilege of parking thereon, to be determined by the length of time for which a vehicle may be parked, except as otherwise herein provided. Such parking fees shall be payable in advance, except as otherwise provided in this article. Such fees are to be collected through the parking meters or other devices installed or to be installed in such parking lots or by the purchase of parking permits as provided in this section.

The area available for the parking of vehicles in every municipal off-street parking lot maintained by the Township shall be suitably subdivided by pavement markings, or otherwise, into single-vehicle spaces, wholly within one of which spaces, called a parking space, if available, each vehicle using such lot shall be parked, either headed into or backed into unless otherwise indicated by signs posted in such parking lot.

Except in a period of emergency determined by an officer of the Police Department or in compliance with the directions of a police officer or traffic control sign or signal or except as otherwise herein provided, when any vehicle shall be parked in any metered parking space controlled by a parking meter, the operator of such vehicle shall, upon entering the parking meter space, immediately deposit or cause to be deposited in such meter such proper coin of the United States of America, as is required for such parking meter and as is designated by the directions of the meter and by this article, and after the deposit of the proper coin, shall also set in operation the timing mechanism on such meter in accordance with the directions thereon. The failure to deposit such coin and to set the timing mechanism in operation when so required shall constitute a violation of this section. Upon the deposit of such coin and the setting of the timing mechanism in operation, the parking space may be lawfully occupied by such vehicle for the period of time prescribed for such metered parking space for the payment made by such person. Should any person place a vehicle in a metered parking space controlled by a meter which indicates that unused time has been left in the meter by the previous occupant of the space, such person shall not be required to deposit a coin as long as his/her occupancy of such space does not exceed the indicated unused parking time. If any vehicle shall remain in any parking space beyond the unused time limit left in such meter or the time paid for and such meter shall indicate such illegal parking then the person who parked the vehicle in that location or the registered owner thereof shall be deemed to have violated the provisions of this article.
No motor vehicle shall occupy the same delineated parking space for more than one period of time for which parking is permitted in such space, and any motor vehicle that shall be parked for more than one period for which parking is permitted in such space shall be in violation of this section even though the required parking fee for the additional period or periods has been deposited in the meter controlling the parking space in which the motor vehicle is parked.
When any vehicle remains parked in any parking space beyond the parking time limit prescribed for such space, each such period of time that the vehicle remains in such parking space after the expiration of the initial period of time shall constitute a separate violation irrespective of whether or not a coin or coins have been deposited in the meter for the additional period or periods of time.

a.
Time limitations for permit parking spaces shall be either from 6:00 a.m. to 6:00 p.m. or for 24 hours, and for metered parking spaces from 9:00 a.m. to 6:00 p.m. No vehicle shall be parked on any off-street parking lot, including the off-street parking lot at the Millburn High School off Millburn Avenue, between the hours of 2:30 a.m. and 5:30 a.m.; except that twenty-four-hour parking shall be allowed by permit only solely at designated spaces in Lots Number 2, 6 and 14 for vehicles displaying proper Township permit(s).
b.
Lot Number 6 shall be signed for no more than 21 twenty-four-hour permits, which shall be issued to Township residents only.
c.
Lots Number 2, 6 and 14 shall be signed to provide for twenty-four-hour permits, which shall be issued to Township residents only, on an as-needed basis.

No parking in off-street parking lots in the Township shall be permitted except by: (1) valid permit issued by the Township; (2) depositing the correct payment in the meter controlling the parking space; (3) a vehicle having a special handicapped person's license plate parked in a space specifically designated as parking for such vehicles; or (4) as otherwise provided for in this subsection.
b.
Lot Number 2 (402 spaces), located at Essex Street and Lackawanna Place, shall have:

c.
Short Hills Train Station parking area - eastbound, with parking spaces located at 20 Chatham Road, 99 Baltusrol Way and spaces located to the east and west of the eastbound train station, shall, except for the designated meter parking spaces, be a permit parking only area restricted to vehicles which display a valid commuter permit or for those whose full-time business or employment is in the Township and have a valid business permit to park where designated. The requirements of this section shall not be in effect on Saturdays, Sundays and legal holidays. No overnight parking will be permitted. This combination of lots will have the following space allocation:
1.
273 commuter permit parking spaces or twelve-hour paid parking spaces to be located and designated pursuant to Subsection 7-35.8 and proper signage to be used by vehicles bearing valid Township resident parking deals on weekdays;

2.
11 business (only) permit parking spaces;
3.
Two parking spaces restricted for the use of the employees of the railroad station;
4.
Eight handicapped parking spaces.
g.
Lot Number 7 (307 spaces), abutting the concrete platform adjoining the westbound tracks of New Jersey Transit, at the Millburn Station, shall have:

1.
277 permit parking spaces;
2.
Nine three-hour meter parking spaces;
3.
Eight spaces reserved for the Millburn-Short Hills Volunteer First Aid Squad;
4.
Four handicapped parking spaces;
5.
Eight reserved spaces; and
6.
One space reserved for the ticket agent.
Overnight parking will not be permitted in Lot 7 without a valid commuter permit and permission from the Millburn Police Department. The requirements of this section shall not be in effect on Saturdays, Sundays and legal holidays. Overnight parking is prohibited on Fridays and Saturdays unless the vehicle has a valid resident sticker. |
h.
Lot Number 9 (112 spaces), located at the intersection of Glen Avenue and Lackawanna Place, shall have:

1.
92 twelve-hour paid parking spaces to be located and designated pursuant to Subsection 7-35.8 to be used by vehicles bearing valid Township resident parking decals on weekdays or used by vehicles with a valid commuter permit as indicated by proper signage.
2.
16 parking spaces are hereby designated as "library patronage parking lot" spaces and shall be restricted solely for the use of library patrons, with parking time limited to three hours.
3.
Four parking spaces designated for handicapped use.
The requirements of this section shall not be in effect for Lot Number 9 on Saturdays, Sundays and legal holidays. Parking shall be allowed only in Lot Number 9 for vehicles displaying a valid permit. |
i.
Lot Number 10 (nine spaces), located on the northerly side of Chatham Road some 357 feet, more or less, from the intersection of the easterly side line of Forest Drive, shall be a permit-parking-only area restricted to vehicles which display a valid "resident's permit" or a valid "nonresident's, whose full-time business or employment is in the Township, permit." The requirements of this section shall not be in effect for Lot Number 10 on Saturdays, Sundays and legal holidays.
j.
Lot Number 12 (15 spaces), located at 326 Millburn Avenue, shall have 14 30-minute meter parking spaces with a 30-minute time limit 9:00 a.m. -6:00 p.m. Monday-Saturday, no parking 2:30 a.m. - 5:30 a.m. and one handicapped parking space. No vehicle idling permitted.

k.
Lot Number 13 (40 spaces), adjoining the Millburn Public Library, is hereby designated as the "library patronage parking lot" and shall have 39 spaces restricted solely for the use of library patrons, with parking time limited to three hours, and one handicapped parking space.

Lot Number 14 (98 spaces), located at Short Hills Avenue and Jarvis Lane, shall have:

Lot Number 16 (27 spaces), located on the westerly side of Main Street directly across Main Street from Block 701, Lot 2, shall have 27 permit parking spaces.
n.
Lot Number 17 (24 spaces), located on Essex Street westerly of the Public Works Building, shall have 24 parking spaces restricted for use by Township employees' vehicles which display a Township employee parking permit.
o.
Lot Number 19 (72 spaces), located on Spring Street, between Millburn Avenue and Essex Street, shall have 55 business permit spaces, 5 shopper parking spaces with a 2-hour time limit 9:00 a.m. - 6:00 p.m. Monday-Saturday, except legal holidays and 12 municipal employee spaces.

The Chief of Police, with the approval of the Township Committee, shall locate and designate the metered parking spaces in the off-street parking lots, and the meters controlling such parking spaces shall bear a legend indicating the type of parking permitted and the fees prescribed therefor.

The municipal parking lot designated as Lot Number 6 shall not be metered, and none of the time limitations and parking meter fee requirements of this section shall apply to such lot. Parking shall be permitted on such lot by municipal officials and employees and the motor vehicles of the Township only. There shall be issued to all municipal officials and employees an insignia to be placed on the lower left corner of the rear window of such officials' and employees' vehicles, which shall entitle such vehicles to be parked in such lot. Any person parking a vehicle in such lot not so authorized shall be in violation of this section.

Any vehicle parked on any municipal parking lot for a period in excess of one hour succeeding the expiration of the period permitted for the fee deposited in the parking meter controlling the space in which such vehicle is parked, or, if such vehicle is parked during the period when the parking meter fee requirements are not applicable, and parking in such lot is prohibited, if such vehicle is parked for a period in excess of one hour, or if a vehicle is parked without a permit in a lot or space restricted to permit parking, such vehicle may be towed, under the direction of the officer in charge of the Police Department, to a location designated by the Chief of Police and there impounded, subject to redemption by the owner upon payment of the cost of towing and a storage charge consistent with § 4-39, Vehicle Towing and Storage Services, during which such vehicle remains in such location, in addition to any fine imposed for the violation of this section.

The Chief of Police of this Township is authorized to designate, with the approval of the Township Committee, areas on any municipal parking lot for the parking of vehicles used for municipal purposes or municipally sponsored or approved purposes, or for taxis and vehicles carrying United States mail, which vehicles shall not be required to comply with the requirements of this section. The areas designated in pursuance with this subsection shall be appropriately marked to indicate such designations.
The Chief of Police of the Township is authorized to designate, with the approval of the Township committee, the following:
a.
An area on Lot Number 5 which shall be unmetered and where parking shall be limited to persons having lawful business in the Township Hall during the time when they transact such business.
b.
Areas on Lot Number 7 which shall be unmetered and which shall be reserved exclusively for use by taxis and United States mail trucks.
c.
Seven parking spaces at Gero Park for the exclusive use by vehicles of employees of the Millburn Fire Department which vehicles display proof that the vehicle is owned by a Fire Department employee.
Any other vehicle parked in the spaces so designated shall be in violation of this section. |

Any Township employee designated by the Business Administrator shall be authorized to issue the permits prescribed by this section and to accept the fees herein prescribed. The following types of permits and schedule of fees are hereby established:
b.
Business whose full-time business or employment is in this Township.
c.
Resident's twenty-four-hour permit.
3.
Twenty-four-hour permits will be issued only to tenants that reside in the B-4 Commercial District as zoned or those residents that reside in the B-3 Commercial District as zoned along Millburn Avenue between Short Hills Avenue and Morris Turnpike.
4.
Permits will be limited to two per apartment unit.
5.
A copy of a current rental lease must be provided with the application in order for a twenty-four-hour permit to be issued.
6.
All other rules and requirements established by the permit application shall be adhered to by the permit holder.

e.
Resident shopper parking permit.
1.
Annual permit fee:
(a)
$60 to $90 for the first two vehicles of a household, as established by resolution.
2.
Use will be permitted in all business districts where there is paid shopper parking for both on-street and in designated shopper parking lots where a fee is charged and collected through a meter or paystation.
3.
Time limits and all parking rules and regulations will apply to the use of this permit.
4.
Shopper permits will be restricted to Township residents where proof of residency is provided as required by the permit application.
5.
No business, business owners or employees of businesses will be permitted to apply or receive a resident shopper permit.
6.
No residents located in a business district and otherwise eligible for a twenty-four-hour or overnight parking permit will be permitted to purchase a resident shopper permit
7.
All other rules and requirements established by the permit application shall be adhered to by the permit holder
g.
Resident's summer intern permit (May 1 to September 1).
1.
Summer intern permit (use restricted to Lots 14, 16 and 19): $75.
h.
EV charging station fee: total cost of energy used based on rate of two times the per-kilowatt-hour rate the Township pays for electricity through its current supplier, not to exceed $0.20 per killowatt hour.

All parking permit fees are payable in full in advance and shall be collected by the employee or official designated by the Business Administrator who shall account therefor and shall pay the same over to the Township Chief Financial Officer/Treasurer, as required by law. Every such permit shall be valid only for the period and vehicle for which issued. No refund may be had of all or any part of the fee paid for any permit unless, in the discretion of the Business Administrator, extenuating circumstances and good cause are clearly demonstrated. A vehicle for which a permit and insignia have been issued when parked at a parking meter must pay the parking meter fee. No portion of any off-street parking lot shall be deemed reserved for the parking of any vehicle for which a permit has been issued unless it is designated as a "permit-parking-only area." However, nothing herein contained shall be construed to assure the holder of a permit of the availability of a parking space for the parking of any vehicle for which a permit has been issued.

Applications for permits under this section will be furnished by the Township. Applications may be submitted to a Township employee, or officer designated by the Business Administrator, by mail on the printed form supplied by the Township. Every application shall be signed by the owner of the vehicle for which the permit is desired. Every application shall designate the type of permit desired, and the fee for such permit shall be paid with the filing of the application. The permit and the insignia may be mailed by the Township designee to the applicant.

Annual parking permits shall be for a calendar year only. Semiannual permits shall be for the period of six calendar months, starting on the first of the month for the six-month period for which the permit shall be issued. Prorated parking permits shall be permitted for a three-month period beginning October 1 and ending December 31 for each calendar year.

The insignia issued with a permit pursuant to this section shall be placed on the lower left corner of the rear window of the vehicle in connection with which the permit is issued; provided that if such vehicle has no rear window, or the rear window can be removed, the insignia shall be placed on the vehicle at the place designated in the instructions issued with the permit. The insignia issued shall designate the type of permit and period of time for which it shall be in effect.
To be eligible for the parking privileges afforded by any permit under this section, a vehicle shall display the insignia issued while parked in any municipal parking lot.
The owner of any vehicle upon which there is an insignia indicating that a parking permit has been issued for such vehicle, shall, upon the expiration of the period for which such permit was issued, remove such insignia from such vehicle.

An unexpired permit issued pursuant to this section may be transferred from the vehicle for which it was issued to another vehicle owned by the licensee, provided that the licensee shall submit an application for such transfer and a fee of $5 to cover the cost of effecting the same. The owner of the vehicle shall either surrender the insignia placed upon the rear window of such vehicle in a defaced condition to the Township designee or submit such vehicle to the Township designee so that the insignia may be removed. The permit shall also be submitted, together with the vehicle to which the permit is to be transferred, in order that the necessary changes may be made in such permit and a new insignia placed upon the vehicle to which the permit is transferred.

The following provisions relate to the operation of a vehicle while in and on municipal off-street parking lots and appurtenances thereto:
a.
All through traffic is prohibited in the Township's municipal parking lots, and no vehicle shall be operated in, on or over such lots except for the purpose of ingress to and egress from such lots in connection with the use thereof in parking such vehicle.
b.
No vehicle entering Main Street from the exit thereon from Lot Number 1 shall turn left into Main Street.
c.
The driveway from Millburn Avenue to Lot Number 4 shall be used for one-way traffic only in a southerly direction from Millburn Avenue to Lot Number 4.
d.
The driveway into Lot Number 13 from Glen Avenue shall be the only entrance to Lot 13 (entrance only) and shall be for one-way traffic only in a southerly direction from Glen Avenue to the connecting driveway to Lot Number 9.
e.
The connecting driveway from Lot Number 13 to adjoining Lot Number 9 shall be the only exit from Lot Number 13 (exit only) and shall be for one-way traffic only in an easterly direction.
f.
No vehicle shall enter Lot 2, Millburn Parking Deck, from the Lackawanna Place Drive.

The easterly driveway to the Township Law Enforcement Building situated on Essex Street shall be for entering only, and the westerly driveway shall be for an exit only. Parking along the easterly driveway for a distance of 145 feet from its intersection with Essex Street is prohibited.

Stopping or standing is prohibited at all times on certain municipal property. No person shall stop or stand at any time on any municipally-owned property described below:
Library Patronage Parking Lot [Lot Number 13]: on either side of the driveway to Lot Number 13.
Old Short Hills Park and Gero Park driveways and roads. In Old Short Hills Park and Gero Park driveways and roads, stopping and standing is prohibited.
Public school driveways and roads. In all public school driveways and roads, stopping or standing is prohibited.
Driveways and roads, as used in this ordinance, include all areas and egress routes, which are not marked by appropriate signage or roadway paint as parking, loading, drop off or pick-up zones.

No truck exceeding four tons' registered gross weight shall be parked in any municipal off-street parking lot.
