Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383) the New Jersey Uniform Fire Code shall be locally enforced in the Township of Lakewood.

The local enforcing agency shall be the Ocean County Bureau of Fire Safety under the supervision of the Ocean County Fire Marshal.

The Ocean County Bureau of Fire Safety shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of the Township of Lakewood other than owner-occupied one and two family dwellings, and shall comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

The Ocean County Bureau of Fire Safety shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code.

The local enforcing agency, established by subsection 17-1.2, shall be the Office of the Fire Marshal, Ocean County, and shall be under the direct supervision and control of the Fire Marshal of Ocean County, who shall serve as the Fire Official; and the Department shall consist of the Fire Official, and such other inspectors and employees as may be necessary to enforce the Code, being appointed by the Board of Chosen Freeholders, pursuant to the procedures set forth herein below. Additionally, any and all reports submitted by the Fire Official shall also be submitted to the Lakewood Board of Fire Commissioners, upon reasonable request.

a. 
Fire Official. The local enforcing agency shall be under the supervision of the Fire Marshal who shall be appointed by the Ocean County Board of Freeholders, pursuant to Title 11, Civil Service, of the New Jersey Statutes.
b. 
Inspectors and Employees. Such inspectors and other employees as may be necessary for the local enforcing agency to properly carry out its responsibilities shall be appointed by the Ocean County Board of Freeholders, pursuant to Title 11, Civil Service, of the New Jersey Statutes.

Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act, any person aggrieved by a ruling, action, notice or order of the Ocean County Bureau of Fire Safety shall have the right to appeal to the Construction Board of Appeals of the County of Ocean.

Required Inspections:
All additional uses as listed hereinabove shall be inspected for compliance with the provisions of the Uniform Fire Safety Act and the regulations adopted thereunder periodically, but not less than once every 12 months.

A-22: No Fee
Where more than one additional use exists under one ownership at a given location, the highest use shall be registered at full fee and the subsequent use at 1/2 the scheduled fee. In multi-tenant structures, each tenant shall be registered at full fee.

a. 
All health care facilities shall be inspected in accordance with guidelines established by the Uniform Fire Safety Code and shall also meet the requirements of the latest edition of the N.F.P.A. 101 Code for Safety to Life from Fire in Buildings and Structures.
b. 
Key Boxes. The Fire Marshal shall have the authority to require a key box to be installed in an accessible location where access to or within a structure or area is difficult because of security. The key box shall be a type approved by the Fire Marshal and shall contain keys necessary for the Fire Department to gain access as required by the Fire Marshal. The operator of the premises shall immediately notify the Fire Marshal and provide new key(s) any time a lock is changed or re-keyed and a key(s) to that lock is contained in the key box.
c. 
Fire Zones and Fire Lanes. The Fire Marshal shall have the power and it shall be his duty to provide for the designation of fire lanes and fire zones on public or private property when he deems such lanes to be needed for the protection of life and property.
d. 
Upon finding that such action is necessary for the public safety, the Fire Marshal may require the owner or owners of any shopping center, commercial structure, place of public assembly, multiple dwelling, industrial park, office building, hotel or motel, educational facility, health care facility, day care facility or marina to designate "Fire Zones" at entrances, means of egress, loading doors or access ways to said premises and "Fire Lanes" in driveways and/or parking lots leading from the street to the "Fire Zone."
e. 
The size of the "Fire Zone" and/or "Fire Lane" shall be set at the discretion of the Fire Marshal based upon the size and use of the property, the recommendation of the Board of Fire Commissioners and such other facts that he may deem relevant. "Fire Zones" shall be outlined in yellow on the paved surface and shall contain within said outline the phrase "Fire Zone" in yellow lettering and shall be striped with diagonal lines also in yellow. "Fire Lanes" shall be outlined in yellow with the phrase "Fire Lane" in yellow lettering on the paved surface. Marking of the paved surface shall be provided for and maintained by the owner or operator of the property. A diagram and specifications demonstrating the proper manner of painting and lettering "Fire Zones" and "Fire Lanes" on paved surfaces shall be made available by the Fire Marshal and the Lakewood municipal offices during normal business hours for public inspection. A metal "Fire Zone" or "Fire Lane" sign shall be provided, erected and maintained by the owner or operator of the property and shall be placed as directed by the Fire Marshal. The sign shall indicate the term "Fire Zone" or "Fire Lane," shall be of a design and quality and lettered according to the provisions of the State Code, and shall be approved by the Fire Marshal. A diagram and specifications of a "Fire Zone" or "Fire Lane" sign shall be made available by the Fire Marshal and the Lakewood municipal offices during normal business hours for public inspection. In instances where pavement is not provided for marking, the property owner shall submit for approval to the Fire Marshal, a site plan indicating the location and dimensions of the "Fire Zone" and/or "Fire Lane" and the placement of said signs in lieu of pavement marking.
f. 
The parking of motor vehicles or otherwise obstructing a "Fire Zone" or "Fire Lane" shall be prohibited at all times.
g. 
Blocked Fire Hydrants and Fire Department Connections. It shall be unlawful to obscure from view, damage, deface, obstruct or restrict the access to any fire hydrant or any Fire Department connection for the pressurization of fire suppression systems, including fire hydrants and Fire Department connections located on public or private streets and access lanes or on private property.
h. 
The parking of a motor vehicle within 10 feet of a fire hydrant or otherwise obstructing a fire hydrant or Fire Department connection shall be prohibited at all times. The above Fire Department Connections shall be designated a "Fire Zone."
i. 
The Lakewood Township Police Department and the Ocean County Fire Marshal shall have concurrent jurisdiction to enforce the provisions of this chapter relating to "fire lanes," "fire zones" and "blocked fire hydrants and Fire Department connections. The Township Police Department is authorized to tow motor vehicles and remove all obstructions from any "fire lane," "fire zone" or "blocked fire hydrant." All motor vehicles and other obstructions removed pursuant to this section may be stored in a storage area approved by the Township Police Department. The cost of removal and storage shall be charged to the owner of the vehicle or other obstruction.

Unless another penalty is expressly provided for by New Jersey Statute, every person convicted of a violation of a provision of this section or any supplement thereto shall be liable to a penalty as stated in Chapter 1, Section 1-5.

All penalties under the New Jersey Uniform Fire Code (N.J.A.C. 5:18-1 et seq.) are hereby adopted for the purpose of enforcing this section against any person or persons, firm, partnership or corporation, violating any of the provisions of this section.

The County of Ocean shall retain 100% of all revenues collected under the Uniform Fire Safety Code as well as under subsections 17-1.8 and 17-1.9 above.

The Township Committee is concerned with the occurrence of fires in industrial plants, warehouses and commercial facilities within the Township of Lakewood, where the fire hazards of materials stored therein may not be readily apparent. In order to safeguard the lives of our firefighters and citizens, and to promote the public safety and welfare, it has become necessary to adopt a system of readily recognizable and easily understood markings. These will provide our firefighters at a glance a general idea of the inherent hazards of any material, and the order of severity of these hazards as they relate to fire prevention, exposure and control. A material identification system is necessary in order to give basic information to fire fighting personnel so as to enable them to decide whether to evacuate the area or to fight the fire, and will guide them in the solution of fire fighting techniques and protective measures.

There is hereby adopted by the Township of Lakewood, by reference, the "Fire Protection Guide on Hazardous Materials," the most recent edition, prepared by the National Fire Protection Association, Batterymarch Park, Quincy, Massachusetts, which includes the Standard System for the Identification of the Fire Hazard of Material (NFPA 704), Hazardous Chemicals Data (NFPA 49), and Manual of Hazardous Chemical Reactions (NFPA 491M), copies of which shall be on file in the Office of the Ocean County Fire Marshal and the Inspection Department for public reference.

This section shall govern the identification of material within any structure classified as a life hazard use as defined by N.J.A.C. 5:18-2.4 and/or as a use requiring a permit, as described by N.J.A.C. 5:18-2.7 of the Uniform Fire Code of the State of New Jersey or any location as required by the Fire Official.

Where there are present any quantities of materials as defined by subsection 17-2.2 of this chapter, at any location within the Township of Lakewood, as defined by subsection 17-2.3 of this chapter, said materials shall be identified by the system defined in subsection 17-1.4 of this chapter, as required by the Fire Official.

a. 
NFPA 704 - Standard System for the Identification of the Fire Hazards of Materials provides a simple system of readily recognizable and easily understood markings, which will give at a glance a general idea of the inherent hazards of any material, and the order of severity of these hazards as they relate to fire prevention, exposure and control. Its objectives are to provide an appropriate signal or alert, and on-the-spot information to safeguard the lives of both public and private firefighter personnel during emergencies.
The system identifies the hazards of a material in terms of three principal categories, namely — "HEALTH", "FLAMMABILITY" and "REACTIVITY (Instability)", and indicates the order of severity numerically by five divisions, ranging from "four," indicating a severe hazard, to "zero", indicating no special hazard. This information is presented by a spatial system of a figure with a "diamond" shape, with "Health" always being to the left; "Flammability" at the top; and "Reactivity (Instability)" on the right. Examples of spatial arrangement are shown in Appendix A, Page 9 of NFPA-704. Supplementing the spatial arrangements, colored backgrounds or numbers are used for the three categories — Blue for "Health" hazard; Red for "Flammability"; and Yellow for "Reactivity (Instability)". The fourth space in the diagram shall be used to indicate unusual reactivity with water, radioactivity, proper fire extinguishing agent, or protective equipment required in case of fire or other emergency.
b. 
The Lock-Box - Material Safety Data Sheet System - The Lock-Box is a "key vault" which is mounted on the structure and is accessible by a master key retained by the Fire Department. The Lock-Box style denominated as "key-vault storage container" is capable of retaining a floor plan of the structure, indicating the location of hazardous materials, location of fire sprinkler service valves, location of utilities, fire alarm annunciator panel, emergency phone numbers, Material Safety Data Sheets (MSDS), and any other information as required by the Fire Official.
The Material Safety Data Sheet (MSDS), required to be made available by the supplier of materials by the U.S. Department of Labor, Occupational Safety and Health Administration, contains the following information: Identification of the material; physical data; fire and explosion hazard data; reactivity data; spill, leak and disposal procedures; health hazard data; First Aid procedures and physician's notes; special handling information; special precautions, and additional information; and hazardous ingredients.
Where the Lock-Box-MSDS System is required by the Fire Official, the person(s) responsible shall install a Key-Vault Storage Container, in the interior of the structure; in the alternative, a Key-Vault Storage Container shall be installed in a weatherproof housing on the exterior of the structure.
All installation locations shall be approved by the Fire Official. The Key-Vault Storage Container shall be accessible to the person(s) responsible for updating the information enclosed within. The contents of the storage container shall be approved by the Fire Official.

Any person, partnership, corporation or agent or manager thereof, owning, possessing, controlling, responsible for or in charge of the use, manufacture, storage or presence, within the Township of Lakewood, of any materials defined in subsection 17-2.3 of this chapter, shall identify and label said materials pursuant to the provisions of this chapter and the National Fire Protection Association standards adopted by reference herein within 24 hours of the presence of materials in the Township.

Failure to comply with any of the provisions of this section shall subject the violator(s) to a penalty as stated in Chapter 1, Section 1-5, enforceable by the Office of the Fire Marshal, County of Ocean, State of New Jersey.

This section shall not be construed so as to permit within the Township, or any zone thereof, the presence of any materials prohibited by any other ordinances of the Township.
