Whenever any words and phrases are used in this chapter, the
meaning respectively ascribed to them in Subtitle 1 of Title 39 of
the New Jersey Statutes shall be deemed to apply to such words and
phrases used herein.

Whenever certain hours are named in this chapter, they shall
mean either Eastern Standard Time or Eastern Daylight Savings Time
as may be in current use.

a.
The Chief of Police or, in his absence, disability or inability to
act, the ranking Police Officer, is hereby authorized to provide by
regulation for the closing of any street or portion thereof to motor
vehicle traffic on any day or days during specified hours on any day
or days whenever he finds that such closing is necessary for the preservation
of the public safety, health or welfare.
b.
Any regulations promulgated by the Chief of Police and in accordance with Subsection a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c.
Any violation of this regulation promulgated thereunder shall be
punished by a fine not to exceed $50.
d.
Any regulation adopted that mandates the closing of any street for
a period greater than 48 consecutive hours shall not become effective
unless and until it has been submitted to and approved by the Commissioner
of the Department of Transportation.

The following shall apply:
a.
Resolutions and Ordinances. The Township Committee, as the chief
executive authority, is hereby authorized to enact resolutions to
provide for the closing of any street or portion thereof to motor
vehicle traffic in any day or days or during specified hours on any
day or days whenever it finds that such closing is necessary for the
preservation of the public safety, health, or welfare, and such closing
shall be for a period of 90 days or less. Ordinances enacted for the
aforestated purposes shall remain in effect for an indefinite period
of time.
b.
Pursuant to the foregoing, the following closure is hereby authorized:

Signs. The resolution for street closing shall provide for the posting
of proper warning signs by the Township Police Department in any street
or any portion thereof during the time the street is closed.
d.
Penalties. Any person violating this section or any resolution or
regulation promulgated pursuant hereunto shall be fined not less than
$25 nor more than $500 or imprisoned for a term of not more than 15
days or both.

Any vehicle parking in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any peace officer may provide for the removal of such vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute
or in this chapter, every person convicted of a violation of a provision
of this chapter or any supplement thereto shall be liable to a penalty
of not more than $50 or imprisonment for a term not exceeding 15 days
or both.

If any part or parts of this chapter are, for any reason, held
to be invalid, such decision shall not affect the validity of the
remaining portions of this chapter.

All former traffic ordinances of the Township of Lakewood are
hereby repealed, and all ordinances or parts of ordinances in conflict
with or inconsistent with the provisions of this chapter are hereby
repealed, except that this repeal shall not affect or prevent the
prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.

The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other, more restrictive
provisions prohibiting or limiting the stopping or standing or parking
of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey
Statute or as hereinafter provided.

a.
Upon the declaration of an emergency, there shall be no parking upon
streets or sections of streets where temporary EMERGENCY NO PARKING
signs are displayed. The Chief of Police or, in his absence, the ranking
Police Officer, is authorized to declare an emergency and to direct
the posting of EMERGENCY NO PARKING signs when weather conditions,
accidents, road construction, fire or public celebrations dictate
or require avoidance of hazards or other conditions which interfere
with the free flow of traffic. Notification that EMERGENCY NO PARKING
signs are being or will be posted shall be given to the operator or
owner of any vehicle which has been parked prior to the posting of
the signs.
b.
The effectiveness of this subsection is contingent upon the signs
being erected as required by law.

a.
Whenever snow has fallen and the accumulation is such that it covers
the streets or highways, an emergency shall exist and no vehicle shall
be parked on the streets or highways or portions thereof listed below.
The parking prohibitions listed below shall remain in effect
after the snow has ceased, until the streets have been plowed sufficiently,
and to the extent that parking will not interfere with the normal
flow of traffic.
b.
Any unoccupied vehicle parked or standing in violation shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic
and any Police Officer may provide for the removal of such vehicle.
The owner shall pay the reasonable costs of the removal and storage
which may result from such removal before regaining possession of
the vehicle.
c.

d.

The Mayor and/or the Chief of Police, or in the Chief's absence,
the ranking Police Officer, are authorized to suspend for such period
of time as they may deem necessary, the enforcement of any parking
regulations or prohibitions imposed by this chapter.

The Governing Body hereby finds and declares that problems of
traffic control occur when traffic must be moved through or around
street construction, maintenance operations, and utility work, above
and below ground which requires blocking the roadway and obstructing
the normal flow of traffic; and that such obstructions are or can
become dangerous when not properly controlled. In order to better
promote the public health, safety, peace and welfare, it is necessary
to establish controls and regulations directed to the safe and expeditious
movement of traffic through construction and maintenance zones and
to provide safety for the work force performing these operations.
The Township of Lakewood, in the County of Ocean, State of New
Jersey, does hereby adopt the current Manual on Uniform Traffic Control
Devices hereafter known as M.U.T.C.D., except as hereby supplemented
and amended, as it controls and regulates whenever construction maintenance
operations of utility work obstructs the normal flow of traffic. Any
person, contractor, or utility who fails to comply with the provisions
of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or
in the case of a public utility agreement the public utility wishing
to conduct work on, under or above the roadway, to contact the Police
Department in order to arrange a pre-construction meeting in order
to submit plans for the safe movement of traffic during such period
of construction or work. Any person, contractor or utility who fails
to comply with this section prior to the start of such work or whose
plans are not approved by the Police Department is in violation of
this section.

The person, contractor, or utility shall provide the Police
Department with at least two emergency contact phone numbers to be
called in case of emergency problems at the construction or maintenance
site prior to the start of any work. If for any reason emergency contact
cannot be reached, or if the emergency contact person does not respond
to the call from the Police Department to correct a hazardous condition,
the Township may respond to correct such hazardous condition. The
reasonable fees for such emergency service by the Township shall be
charged to the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility
work on any roadway in the Township before the hour of 10:00 a.m.
or after 3:00 p.m. This time limit may be adjusted to permit work
prior to 10:00 a.m. or after 3:00 p.m. by the Chief of Police or the
Chief's designee. If it is determined by the Chief of Police or the
Chief's designee that the construction or maintenance operations prior
to 10:00 a.m. or after 3:00 p.m. would substantially delay traffic
or cause a safety or health hazard, the work shall then be permitted
only between 10:00 a.m. and 3:00 p.m.

Road closing and/or traffic detours shall not be permitted unless
approved by the Police Department.

Traffic directors shall be posted at all construction or maintenance
sites when determined by the Police Department that same is necessary
to provide for the safe and expeditious movement of traffic.

The Police Department shall have the authority to stop work,
including the removal of equipment and vehicles, stored material within
the street right-of-way, backfilling of open excavations and/or other
related work, in order to abate any nuisance and/or safety hazard
or for any violation of this section.

It is to be expressly understood that no materials, vehicle
or equipment are to be placed in the roadway or sidewalk or until
all construction, signs, light devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of
this section shall, upon conviction thereof for a first offense, pay
a fine of not less than $100 nor more than $500 and/or be imprisoned
in the County Jail for a term not exceeding 90 days. For a second
offense, the person, contractor or utility shall, upon conviction
thereof, pay a fine of not less than $250 and/or be imprisoned in
the County Jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during
or on which a violation occurs or continues.

All ordinances or parts of ordinances which are inconsistent
with the provisions of this section are hereby repealed to the extent
of any such inconsistency.

This section shall take effect after approval by the Commissioner
of Transportation 20 days after passage and publication as prescribed
by law.

In accordance with the provisions of N.J.S.A. 40:48-2.46, the
following off-street parking spaces are designated as handicapped
parking areas. Such spaces are for use by persons who have been issued
special identification cards, plates or placards by the \Motor Vehicle
Commission, or a temporary placard issued by the Chief of Police.
No other person shall be permitted to park in these spaces.

feet wide.

In any space on public or private property appropriately marked
for vehicles for the physically handicapped pursuant to N.J.S.A. 39:4-197.5,
N.J.S.A. 52:27D-119 et seq., or any other applicable law unless the
vehicle is authorized by law to be parked therein and a handicapped
person is either the driver or a passenger in that vehicle, State,
county, municipal law enforcement officers or parking enforcement
officers shall enforce the parking restrictions on spaces appropriately
marked for vehicles for the physically handicapped on both public
and private property.
No person shall move a vehicle not lawfully under his control
into any such prohibited area or away from a curb such distance as
is unlawful.

In accordance with the provisions of N.J.S.A. 39:5A-1; the following
off-street parking locations are designated as handicapped parking.
Such spaces are for use by persons who have been issued special identification
cards, plates or placards by the Motor Vehicle Commission, or a temporary
placard issued by the Chief of Police. No other person shall be permitted
to park in these spaces.

John F. Kennedy Apartment Complex. All stalls shall be twelve (12')
feet wide as shown on the site plan and signed with R7-8 and R7-8(P)
(Reserved Parking sign and penalty plate), in the designated parking
areas for persons who have been issued the handicapped parking permits
by the Motor Vehicle Commission as shown on the site plan on file
in the Township Clerk's office.
b.
Peter Ward Development. All stalls shall be twelve (12') feet wide
as shown on the site plan and signed with R7-8 and R7-8(P) (Reserved
Parking sign and penalty plate), in the designated parking areas for
persons who have been issued the handicapped parking permits by the
Motor Vehicle Commission as shown on the site plan on file in the
Township Clerk's office.
c.
John Curry Apartments. All stalls shall be twelve (12') feet wide
as shown on the site plan and signed with R7-8 and R7-8(P) (Reserved
Parking sign and penalty plate), in the designated areas for persons
who have been issued the handicapped parking permits by the Motor
Vehicle Commission as shown on the site plan on file in the Township
Clerk's office.
d.
Lulu Duffy Apartments. All stalls shall be twelve (12') feet wide
as shown on the site plan and signed with R7-8 and R7-8(P) (Reserved
Parking sign and penalty plate), in the designated areas for persons
who have been issued the handicapped parking permits by the Motor
Vehicle Commission as shown on the site plan on file in the Township
Clerk's office.

Four Seasons Development.
1.
Handicapped Parking. All stalls shall be twelve (12') feet wide as
shown on the site plan entitled "Amended Composite Development Plan
Section Thirteen" on file in the Traffic and Safety Division of the
Lakewood Police Department, and signed with R7-8 and R7-8(P) (Reserved
Parking sign and penalty plate), in the designated parking areas for
persons who have been issued the handicapped parking permits by the
Motor Vehicle Commission.
2.
Club House Parking Lot. Stalls 1 and 2 south end, west side, shall
be designated as "handicapped," as per the site plan referenced above.
f.
Highpoint Condo Complex. On the southerly side of High Point Condo
Complex, beginning at a point 423 feet east of the prolongation of
the easterly curbline of Massachusetts Avenue on the south side of
the parking lot and extending nine feet thereof for handicapped placard
permit #442083 labeled spot #29.

The owners of the premises referred to in Subsections 7-35.3
and 7-35.4 shall provide and install signs and pavement markings for
each parking space reserved for the use of handicapped persons, which
signs and markings shall be in accordance with the manual on Uniform
Traffic Control Devices. The cost of procurement and installation
of the signs and pavement markings shall be the responsibility of
the owner of said property. The owner shall subsequent to initial
procurement and installation, maintain such signs and pavement markings
in good condition at no cost or expense to the Township of Lakewood.
The owner shall be responsible for the repair and restoration or replacement
of same.

The following locations are hereby established as restricted
parking zones for handicapped individuals in front of their residence
pursuant to N.J.S.A. 39:4-197.6. No person shall be permitted to use
the restricted parking area who does not possess a windshield placard
or wheelchair symbol license plate with the permit number issued by
the Motor Vehicle Commission for the vehicle owned by the handicapped
person residing in the residence, or owned by another occupant of
the residence who is a member of the immediate family of the handicapped
person.

Any person parking a motor vehicle in a restricted parking space
without a special vehicle identification card shall be liable to a
fine of $250 for the first offense and for subsequent offenses a fine
of at least $250 and up to 90 days community service on such terms
and in such form as the court shall deem appropriate, or any combination
thereof.

In accordance with the provisions of N.J.S.A. 39:4-197, the
following Municipal and Board of Education property shall have the
movement of traffic controlled by the type of regulation indicated.
No person shall operate, or park a vehicle in violation of the regulations
indicated.
It shall be unlawful for any vehicle to be parked on the Township-owned
property that is designated as a no parking zone.
Any person who parks a motor vehicle or permits a motor vehicle
to be parked in such a designated area is in violation of the provisions
of this subsection.
Each designated area will be marked by a sign that indicates
that it is a tow away zone.
Any vehicle found in violation of this subsection shall be towed
at the vehicle owner's expense.
All violators of this subsection shall be subject to a penalty
of $20 for each violation.
Part 1.
Municipal Parking Lots
a.
Regulation of Municipal Parking Lots.
1.
General Regulations.
(a)
It shall be unlawful to park any vehicle in any
position or area in a public parking lot except within the painted
lines or pavement markings.
(b)
It shall be unlawful to enter or exit from public
parking lots except by using proper roadway designated by sign and
as defined for each lot in this section.
(c)
No person shall park any truck having a gross weight
of over two and a half (2 1/2) tons in weight load on any public
parking lot.
(d)
It shall be unlawful to use municipal parking lots
and municipal planted areas in designated parking lots for play or
recreation purposes, except in the event of a specifically approved
activity by the Township Committee of the Township of Lakewood.
2.
Clifton Avenue and Fourth Street. Entrances and exits to Clifton
Avenue and Fourth Street parking lots are as follows:
(a)
Third Street side entrance is so designated and
curb opening for entrance only is situated on the Third Street side
of the municipal parking lot.
(b)
Two entrances/exits on the Fourth Street side are
so designated and the curb openings are situated at the westernmost
and the easternmost portions of the parking lot on Fourth Street.
(c)
(Reserved)
(d)
Parking for Police Department Vehicles, Inspection
Department and Municipal Manager's office.
(1)
The numbered parking stalls located at the easternmost
portion of the municipal parking lot, and the numbered parking stalls
abutting the Inspection Building, as shown on the map prepared by
French & Parrello Associates, P.A., dated June 14, 1990, and updated
on June 1, 1995, annexed hereto and made a part hereof by reference,
shall be utilized for the parking of police vehicles only.
(2)
The parking stalls located at the northwest corner,
northernmost portion and northeast corner of, respectively, the sections
of the municipal parking lot abutting the Inspection Building, facing
Fourth Street and facing Lexington Avenue, and numbered R1 through
R13, inclusive thereof, as shown on the map prepared by French &
Parrello Associates, P.A., dated June 14, 1990, and updated on June
1, 1995, annexed hereto and made a part hereof by reference, shall
be designated as "Reserved Parking" for employees of the Inspection
Department and Municipal Manager's Office only.
(3)
The 10 parking stalls located between the areas
described pursuant to Subsections (1) and (2) hereinabove, and numbered
PD1 through PD10, inclusive hereof, and the remaining parking stalls
located at the northeast corner of the municipal parking lot facing
Lexington Avenue, and numbered PD11 through PD18, inclusive thereof,
as shown on the map prepared by French & Parrello Associates,
P.A., dated June 14, 1990, and updated on June 1, 1995, annexed hereto
and made a part hereof by reference, shall be utilized for the parking
of vehicles belonging to civilian employees of the Police Department,
Police vehicles and vehicles confiscated by the Police Department
or other law enforcement agencies only.
(e)
Parking for Inspection Department. Four parking
stalls on the westernmost portion of the parking lot on Fourth Street
are designated as, and reserved for, public use for Inspection Services
with an accompanying 30 minute time limit, as designated on the map
prepared by French & Parrello Associates, P.A., dated June 14,
1990, which is annexed hereto and made a part hereof by reference.
3.
Second Street Parking Facility.
(a)
Attached hereto and made a part hereof is a map
entitled "Reference Area G and Reference Area J" pursuant to the Lakewood
Downtown Public Improvement Project, prepared by Beyer, Blinder, &
Belle, dated August 31, 1984 and amended September 6, 1984, revised
September 12, 1985; and more specifically a map entitled "Second Street
Parking Facility" dated April 21, 1986 prepared by Lt. Bernard Gindoff,
copies of which are on file with the Township Clerk's office.
(b)
It shall be unlawful to enter or exit from the
parking lot except as follows:
(1)
The driveway into said parking lot from Second
Street lot be an entrance and exit.
(2)
The easterly driveway on Third Street, aka Parking
Lot No. 1 (as set forth on referenced maps) is hereby designated as
an entrance and exit.
(3)
The westerly driveway on Third Street, aka Parking
Lot No. 2 (as set forth on referenced maps), about to be constructed,
is hereby designated as an entrance and an exit from the parking lot
onto Third Street.
(c)
Exits and entrances as above set forth shall have
standard signs placed appropriately indicating same. The direction
of travel within the parking lots shall be two-way in all areas, which
shall be indicated by directional arrows painted on the pavement.
No person shall drive a motor vehicle in the roadway portion of the
parking lot except in the directions indicated by the arrows.
(d)
No motor vehicle shall park in the parking lot
except within the area between the white lines for parking areas and
the motor vehicle shall not be parked so as to extend over any rear
of the parking area and if no line designates the rear of said parking
area, no motor vehicle shall be parked so as to extend past the rear
end of the parallel line between which said motor vehicle is parked.
(e)
The time limit for parking motor vehicles within
the confines of the parking lot shall be as follows:
(1)
The designated parking stalls hereinafter set forth
shall be used for the designated hours of parking between the hours
of 8:00 a.m. and 8:00 p.m., except for taxicab stalls.
(2)
The stalls shall be those shown on the map prepared
by Sgt. Richard G. Smith, Badge No. 027, Traffic and Safety Officer,
in accordance with a report dated May 1, 1990 regarding the Second
Street Parking Facility, made part of said map by reference herein.

(f)
There shall be no automobile repair on any motor
vehicle while situated in any parking lot stall or within the parking
lot proper, except as in emergency situations.
(g)
Any motor vehicle parked in the parking lot for
a period in excess of the designated time limit for parking or parked
in an unlawful manner shall be in violation of this section. Any vehicle
unlawfully parked may be towed from the parking lot at the reasonable
expense of the owner of the motor vehicle, and placed in a garage
or place for storage of motor vehicles at the direction of the Chief
of Police or any police officer in charge of the duty shift at the
time the violations are brought to the attention of the Police Department.
(h)
No motor vehicle shall be parked in the parking
lot when the parking lot is covered with snow. Any motor vehicle left
parked in the parking lot when the parking lot is covered with snow
may be towed from the parking lot at the reasonable expense of the
owner of the motor vehicle or placed in a garage or place for storage
of motor vehicles as otherwise provided above. In addition, a summons
shall be issued to any person found to be the operator or owner of
a motor vehicle parked or operated in violation of any of the provisions
of this section.
4.
Second Street and Lexington Avenue. Entrance and exit to Second
Street and Lexington Avenue parking lot are as follows:

Main Street. Entrance and exit to Main Street parking lot are
at opening on Main Street. Both entrance and exit are so designated
which shall be separated by a concrete island.
6.
Steckler Street. Entrance and exit to Steckler Street parking
lot is through common driveway which is designated.
7.
East Fourth Street and East Fifth Street. Entrance and exit
to East Fourth Street and East Fifth Street are as follows:
(a)
Entrance to East Fourth Street and East Fifth Street
parking lot is so designated and curb opening is situated on East
Fifth Street.

Fifth Street. Entrance and exit to the Fifth Street parking
lot is as follows:

First Street and Lexington Avenue Parking Lot. Parking lot entrances
and exits are as follows:
(a)
There shall be two driveway openings onto First
Street from the parking lot which shall be used for both entrances
and exits to and from the parking lot.
(b)
The driveway openings onto Lexington Avenue of
the parking lot which opening is also known as Division Street shall
be used for both entrance and exit to and from the parking lot, and
the Division Street opening into the parking lot on the easterly side
of the parking lot to Railroad Plaza shall also be used as an entrance
and exit to and from the parking lot.
10.
Second Street Parking Lot on the South Side Approximately
200 feet East of Clifton Avenue. Entrance and exit to this Second
Street parking lot are at driveway east of Hurlburt's Stationery Store
property so designated.
(a)
The municipal parking lot between Third Street
and Second Street (west of Clifton Avenue) shall have 2 hour parking
in the 23 spaces closest to Second Street (including 13 parking spaces
on the east side of the parking lot and the first 10 parking spaces
after the 2 existing handicap spaces on the west side of the parking
lot).

11.
Parking Lot West of Library Building on Second
Street.
(a)
There is hereby created in the Township an additional
new parking lot to be known as the Parking Lot West of Library Building
on Second Street, which parking lot shall be situated immediately
adjacent to the west side wall of the Lakewood Public Library on Second
Street and have provisions for parking of 18 automobiles as laid out
on plans on file in the Township Clerk's office entitled "Plan of
Parking Lot West of Library Building on Second Street" dated April
27, 1978, prepared by Daniel A. DeSessa, Township Engineer. The entrance
and exit for the parking lot shall be from Second Street and the exit
area onto Second Street is designated as a stop intersection and a
stop sign shall be erected north of the sidewalk at the exit onto
Second Street.
(b)
Parking Time Limits. It is further ordained that
parking stalls 1 through and including number 13 be designated as
one-hour parking and parking stalls number 15 through and including
number 18 be designated as two-hour parking.
During the hours of 8:00 a.m. to 6:00 p.m. parking stalls number
1 through 18 shall be designated as parking stalls for employees of
Kimball Neighborhood Health Center. Parking stall 14 shall remain
as a handicapped parking stall for the use of employees during the
hours of 8:00 a.m. to 6:00 p.m.

12.
Inspection and Welfare Department Parking Lot on
Fourth Street. There is hereby created in the Township a parking lot
to be known as the Inspection and Welfare Department Parking Lot on
Fourth Street, which parking lot shall be situated immediately adjacent
to the west wall of the Inspection and Welfare Department Building,
on Fourth Street, (also known as Annex Building) and have provisions
for the parking of 13 automobiles as laid out on plans on file in
the Township Clerk's office entitled "Site Plan Municipal Building
Lots 2-4, 6-7, 10-15, Block 119, Scale 1" = 20', dated August 1977,
prepared by Robert B. Powers, PE & LS 9463.
(a)
Restricted Parking. Parking of automobiles in said
stalls, number 1 through and including number 13 shall be restricted
to "personnel or visitors of the Inspection and Welfare Departments"
from 8:00 a.m. until 4:30 p.m. daily except Saturday, Sunday and holidays.
All vehicles must park in designated areas. Vehicles permitted to
park must be properly identified.
13.
Lakewood Library.
(a)
All vehicles must park in designated areas and
between the lines provided.
(b)
No person shall stop or stand a vehicle upon any
of the streets or parts of streets described below:

(c)
Tow Away Zones. Any vehicle parked or standing
as to obstruct or impede a normal flow of traffic, block entrances
or exit ways, loading zones, oil fills, any grassy area, pedestrian
walkway, or present in any way a safety or traffic hazard may be removed
by towing the vehicle at the owner's expense.
(d)
Loading Zone(s). The locations described are hereby
designated as Loading Zones. No person shall park a vehicle in said
location at all times other than for the loading and unloading of
goods and materials.

(e)
All signs, posts or other necessary materials be
installed and paid for by the applicant. All signing shall conform
to the current Manual on Uniform Traffic Control Devices, pursuant

14.
Parking Regulations - Engine Company No. 1. The
following parking regulations shall apply to the parking lot located
at Engine Company No. 1, Monmouth Avenue and First Street:
(a)
All vehicles must park only in designated areas
and between the lines provided.
(b)
(Reserved)
(c)
All signs, posts or other necessary materials shall
be installed and paid for by the applicant. Work shall be checked
by the Police Department to insure that installations meet State and
Federal specifications, and all signs shall conform to the current
Manual on Uniform Traffic Control Devices.
15.
First Street Municipal Parking Lot.
(a)
Attached hereto and made a part hereof is a color
coded map prepared by William T. Birdsall, P.E., dated February 8,
2001, a copy of which is on file in the Township Clerk's Office.
(b)
No vehicles shall stop or stand in the areas (outlined
in red) as indicated on the attached site plan above referenced in
Subsection (a) above.
(d)
All vehicles must park within the painted lines
for designated parking stalls only.
(e)
There shall be two handicapped spaces herewith
designated (as shown in blue) which are numbered 1 and 2, as indicated
on the site plan referenced in Subsection (a) above. The handicapped
spaces shall be located in the northeast corner and marked for handicapped
persons with proper identification, only in the Municipal Lot.
(f)
Parking stalls numbered 3 through and including
number 27 are designated as two-hour parking.

(g)
No left turns shall be permitted when exiting the
parking lot onto Clifton Avenue.
(h)
There shall be no motor vehicle repairs on any
vehicle while situated in any parking stall or within the parking
lot.
(i)
No person shall park any truck having a gross weight
of over two and one-half (2 1/2) tons in weight on any portion
of the parking lot, unless it is unloading with a maximum time limit
of 30 minutes.

The following parking spaces are intended on having
a two hour time limit for parking:

18.
Fifth Street Municipal Parking Lot.
(a)
West side of lot, there shall be 12 parking stalls
designated as long term permit parking for tenants of 418 Clinton
Ave., LLC. Permits may be obtained from the office of the Lakewood
Development Corp. Violators will be subject to towing at the owner's
expense.
(b)
West side of lot shall have one parking stall designated,
which is free with no limit.
(c)
Center aisle of lot, there shall be 21 parking
stalls designated, which are free with no limit.
(d)
East side of lot there shall be eight parking stalls
designated for two hour parking. Violators shall be subject to towing
at the owner's expense.
(e)
On the east side of the lot, two parking stalls
shall be designated for handicap parking stalls.

24 hour parking shall be allowed, except as is
hereinafter designated, but continuous parking in excess of 24 hours
at any one time in the parking lot is prohibited. Those parking spaces
referenced by the aforementioned map and designated as northerly angular
parking stalls, during the hours of 9:00 a.m. to 6:00 p.m. except
legal holidays and Sundays, be limited to two hours.
Those parking spaces referenced by the aforementioned map and
designated as easterly right angular parking stalls, during the hours
of 8:00 a.m. to 5:00 p.m. except legal holidays, Saturday and Sunday
be reserved for Lakewood Township municipal employees.

signage and markings shall be in accordance with the Manual of Uniform
Traffic Control Devices. The cost of procurement and installation
of the signs and pavement markings shall be the responsibility of
the owner of the property. The owner shall, subsequent to the initial
procurement and installation, maintain such signs and pavement markings
in good condition at no cost or expense to the Township. The owner
shall be responsible for the repair and restoration or replacement
of same.

For a violation of the provision of this § 11-37 or any supplement thereto for which no specific penalty is provided, the offender shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days, or both; except that for a violation of a section of N.J.S.A. 39:4-80 et seq., N.J.S.A. 39:4-105 et seq., N.J.S.A. 39:123 et seq. or N.J.S.A. 39:4-140 et seq., or any supplement thereto for which no specific penalty is provided, the offender shall be liable to a penalty of not less than $50 or more than $200 or imprisonment for a term not exceeding 15 days, or both.

a.
The improved parking facility operated and maintained by the Lakewood
Industrial Commission located on Block 1606, Lot 9.02 is hereinafter
designated or referred to as the "Lakewood Industrial Commission Park
and Ride Lot."
b.
It shall be unlawful to park any vehicle in any position or area
in this parking lot except within the designated areas.
c.
It shall be unlawful to enter or exit from this parking lot except
by using proper roadway designated by sign and as defined for each
lot in this section.
d.
No person shall park any truck having a gross weight of over 2 1/2
tons in weight load in the Lakewood Industrial Commission Park and
Ride Lot. No buses nor trailers shall be permitted to park in the
Lakewood Industrial Commission Park and Ride Lot.
e.
It shall be unlawful to use the Lakewood Industrial Commission Park
and Ride Lot" for play or recreation purposes, except in the event
of a specifically approved activity by the Township Committee of the
Township of Lakewood. No overnight parking shall be permitted in the
Lakewood Industrial Commission Park and Ride Lot.

a.
During the hours between 6:00 a.m. and 6:30 p.m. (prevailing time)
daily, except Saturdays, Sundays and national holidays, parking in
the Lakewood Industrial Commission Park and Ride Lot shall be restricted
to passenger vehicles with an unexpired park and ride permit displayed
from the dashboard, sun visor or otherwise in such a way that the
expiration date thereof shall be plainly visible through the windshield
from the center front of said vehicle. The initial cost of the parking
permit shall be $0.00 per annum, to be issued by the Lakewood Industrial
Commission. A permit shall be nontransferable and shall only be permitted
to be utilized with a vehicle that is registered with the Township.
b.
A prime, front section of the Lakewood Industrial Commission Park
and Ride Lot comprised of approximately 50 spaces shall be designated
for exclusive use by commuter/car pool residents of Lakewood Township
that commute to north Jersey or New York on a daily basis, as determined
by the Lakewood Industrial Commission upon application for a parking
permit, with the balance of approximately 80 spaces to be utilized
by employees employed within the Lakewood Industrial Park whose employers
have obtained permits and registered them for these exclusive reserved
parking privileges.
c.
Evening use by event venues can be authorized by the Executive Director
of the Lakewood Industrial Commission or his designee based on approval
of the planned use and adherence to the proper protocols instituted
by the Lakewood Industrial Commission. Shuttle service or valet service
to utilize this lot shall be required and shall be the sole responsibility
of the venue making these arrangements. Proof of insurance and other
documents may be required for evening use, as determined by the Lakewood
Industrial Commission.

a.
Head-In Parking. All vehicles in the Lakewood Industrial Commission
Park and Ride Lot shall be parked within a delineated parking space
head in, that is, with the front of the vehicle toward curbs or stops
and the rear toward driving lanes.
b.
Registered Vehicles Only. Vehicles that do not have currently valid
registration tags affixed thereto shall not be parked in the Lakewood
Industrial Commission Park and Ride Lot at any time.
c.
Removal of Unauthorized Vehicles. In addition to penalties for violations
as herein provided, any vehicle left parked or unattended in the Lakewood
Industrial Commission Park and Ride Lot contrary to the provisions
of this section may be removed, and it shall be the obligation of
the owner of such vehicle to pay reasonable costs for the removal
and for any storage which may result from such removal before he shall
be entitled to recover possession of such vehicle.
d.
Overnight Parking. Overnight parking is strictly prohibited. Any
vehicle left unattended in the Lakewood Industrial Commission Park
and Ride Lot after the hour of 12:00 a.m. may be removed, and it shall
be the obligation of the owner of such vehicle to pay reasonable costs
for the removal and for any storage which may result from such removal
before he shall be entitled to recover possession of such vehicle.
e.
Restricted Activities. Any and all activities, within the discretion
of the Executive Director of the Lakewood Industrial Commission and
his agents, that are not considered associated with commuting and/or
utilization of the Lakewood Park and Ride facility are expressly prohibited.
This includes, among other things, repair work on vehicles and storage
of vehicles and/or equipment. Violators shall be subject to penalties
as set forth in § 11.4 of the Township of Lakewood Code.

The Mayor and Governing Body of the Township of Lakewood, in
consultation with the Executive Director of the Lakewood Industrial
Commission, may by ordinance adopt and amend rules not inconsistent
herewith for the purpose of protecting and promoting the public welfare
by encouraging the most efficient use of the Lakewood Industrial Commission
Park and Ride Lot. Upon adoption, such regulations shall be posted
conspicuously at the point or points of vehicular access to the lot.
