This article will be known as "Transportation of Hazardous Materials."
The purpose of this article is to protect the residents and environment of the Town of Hillsdale against injury or damage caused by or incident to the transportation of hazardous substances.
As used in this article, the following terms shall have the meanings indicated:
HAZARDOUS MATERIALS
Those substances as defined under § 37-0101 of the Environmental Conservation Law and those materials listed as hazardous substances by the Department of Environmental Conservation pursuant to § 37-0103 of the Environmental Conservation Law.
PERSON
Individual, trust, firm, joint-stock company, corporation, joint venture, partnership, association, state, county, federal government or any agency thereof, municipality, commission, political subdivision of the state, school district, special district or any interstate body or commission.
TRANSPORT
The movement of hazardous substances over the highways and private roadways within the Town of Hillsdale.

Transportation of any hazardous materials on or over any highway or private roadway in the Town of Hillsdale shall comply with § 14-f of the Transportation Law.

Any person found guilty of transporting hazardous materials over any highway or private roadway in the Town of Hillsdale shall, upon conviction thereof, be guilty of a misdemeanor and subject to a fine not exceeding $1,000 or imprisonment for a period not exceeding one year in the Columbia County Correctional Facility, or by both such fine and imprisonment.
