There is hereby established in accordance with and pursuant to the provisions of N.J.S.A. 2:8A-1 to 2:8A-41, inclusive, and the several acts amendatory thereof and supplementary thereto, a Court within the Borough, to be known as the "Municipal Court of the Borough of New Milford."
a. 
Application Fee for Public Defender.
1. 
Pursuant to Public Law 93, C.293 there is hereby established an application fee of up to $200 for those defendants applying for a Public Defender.
2. 
The Municipal Court Judge may waive any application fee in whole or in part if the Judge determines, in his discretion, that the application fee represents an unreasonable burden on the person seeking representation.

a. 
All requests for discovery in matters pending in the New Milford Municipal Court shall be submitted through the Municipal Prosecutor.
b. 
The following fees shall be payable by the requestor to the Borough of New Milford for any discovery and non-OPRA police reports provided:
1. 
Reports picked up in person: $0.75 per page. Reports over four pages add an additional dollar.
2. 
Reports mailed: $0.75 per page, plus $5.00, plus an additional dollar for reports over four pages:
(a) 
1 page- $5.75
(b) 
2 pages- $6.50
(c) 
3 pages- $7.25
(d) 
4 pages- $9.00
(e) 
5 pages- $10.75
(f) 
6 pages- $12.50
(g) 
7 pages- $14.25
(h) 
8 pages- $16.00
(i) 
9 pages- $17.25
(j) 
10 pages- $19.50
3. 
Reports requested on disk, regardless of amount of images/audio contained: $30.00.
4. 
Five digital photos or less printed from the records computer- $1.00 per photo.

Rates for discovery/police report photos developed at an outside facility:

Fees for copies of telephone and radio transmissions burned to a disk will be set at the hourly rate of the officer preparing the evidence plus the thirty ($30.00) dollar disk preparation fee.
c. 
Where the discovery must be obtained from an entity other than the Borough of New Milford, e.g. another police department, the actual costs paid to the other entity shall be paid by the prosecutor.
