[1968 Code § 83-1]
A code regulating and controlling the location and construction,
alteration and operation of swimming pools, the issuance of permits
to locate and construct, alter or operate swimming pools, and declaring
and defining certain swimming pools as nuisances and fixing penalties
for violations is hereby adopted. A copy of the code is annexed hereto
and made a part hereof without inclusion of the text thereof herein.

The code established and adopted by this section is described
and commonly known as the "Swimming Pool Code of New Jersey (1955)."

Three copies of the Swimming Pool Code of New Jersey (1955)
have been placed on file in the office of the Borough Health Officer
and three copies of the code have been placed on file with the Borough
Clerk and will remain on file in the offices for the use and examination
of the public.

No person shall locate and construct, alter or operate a swimming
pool until permits therefor shall have been issued by the Board of
Health.

The following fees and charges are herewith established:
a.
For the issuance of a permit to construct or alter a swimming pool,
the fees as established in the Borough Building Code shall govern.
b.
For the issuance or renewal of a permit to operate a swimming pool,
$50.
c.
Weekly bacterial test of the water in the swimming pool and monthly
bacterial test of the potable water thereat shall be made by a local
laboratory authorized to do so by the Board of Health; copies of the
reports shall be sent directly by the laboratory to the New Milford
Board of Health, and the costs thereof shall be paid by the person
to whom the swimming pool permit was issued.

Permits issued for the operation of a swimming pool shall expire
annually on December 31 of each year and application for renewal thereof
shall be submitted, together with the required fee, prior to December
31 of each year.

a.
Permits required by this section or code may be denied or suspended
by the Board of Health for failure to comply with this chapter or
code.
b.
This Board of Health shall afford the person whose permit to locate
and construct, alter or operate has been denied or suspended an opportunity
to be heard in public hearing; and following this, to be informed
of the Board's decision as hereafter provided by Section 2 of
this code.

All residential swimming pools, tanks or plunges now existing
or hereinafter constructed or installed, having a depth of two (2')
feet or more, whether or not the pool, tank or plunge has water in
the facility or not, and located two hundred (200') feet or less
from any property line of the lot or plot upon which the same is situated,
shall be enclosed by a substantial fence no less than forty-eight
(48") inches in height. This fence shall be constructed to prevent,
within reason, any person from gaining access beneath or through the
fence and shall have a similarly substantial gate. The gate shall
be locked at all times whether the pool, tank or plunge is filled
with water or is not filled with water.

No swimming pools, tanks, plunges or appurtenances thereto hereafter
constructed or placed shall be within six (6') feet of any property
line.

Prior to any person constructing a swimming pool, tank or plunge
in the Borough, he shall submit the plans and specifications for the
same to the Construction Official who shall issue a permit if the
plans and specifications comply with the ordinances of the Borough.

The permit fee for inspection by the Health Officer shall be
issued upon payment of a five ($5.00) dollar fee.
