That a certain document, three copies of which are on file in
the office of the borough Clerk of the Borough of Pine Hill, County
of Camden and State of New Jersey being marked and designated as "The
BOCA Basic Fire Prevention Code Fifth Edition, 1981" as published
by Building Officials and Code Administrators International Inc. including
Appendix A and Appendix B therein, is hereby adopted as the Fire Prevention
Code of the Borough of Pine Hill, County of Camden and State of New
Jersey, for the control of buildings and structures as herein provided,
and each of all of the regulations, provisions, penalties, conditions
and terms of the BOCA Basic Fire Prevention Code, Fifth Edition, 1981
are hereby referred to, adopted and made a part thereof, as if fully
set out in this section; except that Section F-102.1, Enforcement
Officer, is adopted as set forth in this section.
The BOCA Basic Fire Prevention Code Edition as published including
Appendix A and Appendix B therein should be automatically amended
to comply with the current edition as published and updated by the
Building Officials and Code Administrators International Inc. in order
to stay current with the Uniform Fire Code.
The International Fire Code Edition as published should be automatically
amended to comply with the current Edition as published and updated
by the Building Officials and Code Administrators International Inc.
in order to stay current with the Uniform Fire Code.
All ordinances or parts of ordinances to conflict herewith are
hereby repealed.
That nothing in this section or in the BOCA Basic Prevention Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in subsection 9-1.2 of this section, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this section.
Section F-102.1, Enforcement Officer is deleted from the BOCA
Code as adopted herein, and the following language is adopted in its
stead:
a.ย
There is hereby created the position of fire inspector of the Borough
of Pine Hill.
b.ย
The fire inspector shall be appointed by the governing body for a
term of three years.
c.ย
It shall be the duty and responsibility of the fire inspector to
enforce the provisions of this Fire Prevention Code of the Borough
of Pine Hill. The fire inspector is the designated enforcement officer
of the BOCA Code and is referred to therein as the fire official,
d.ย
The fire inspector shall notify the County Fire Marshal of every
fire or explosion occurring within the borough that is of a suspicious
nature.
a.ย
The fire inspector or duly authorized representative, as may be in
charge at the scene of a fire or other emergency involving the protection
of life and/or property, is empowered to direct such operations as
may be necessary to extinguish or control any suspected or reported
fires, gas leaks, or other hazardous conditions or situations or of
taking any other action necessary in the reasonable performance of
their duty. The fire official may prohibit any person, vehicle or
object from approaching the scene and may remove or cause to be removed
from the scene any person, vehicle or object which may impede or interfere
with the operations of the fire department. The fire inspector may
remove or cause to be removed any person, vehicle or object from hazardous
areas. All persons ordered to leave a hazardous area shall do so immediately
and shall not reenter the area until authorized to do so by the fire
inspector.
b.ย
It shall be unlawful to interfere with, attempt to interfere with,
conspire to interfere with, obstruct or restrict the mobility of,
or block the path of travel of any fire department emergency vehicle
in any way, or to interfere with, attempt to interfere, conspire to
interfere with, obstruct or hamper any fire department operation.
c.ย
A person shall not willfully fail or refuse to comply with any lawful
order or direction of the fire inspector or to interfere with the
compliance attempts of another individual.
d.ย
A vehicle shall not be driven or propelled over any unprotected fire
hose of the fire department when laid down on any street, alley-way,
private drive or any other vehicular roadway without the consent of
the fire official in command of said operation.
e.ย
Authorized emergency vehicles shall be restricted to those which
are defined and authorized under the laws of the State of New Jersey.
f.ย
Upon the approach of any authorized emergency vehicle, giving audible
and visual signal, the operator of every other vehicle shall immediately
drive the same to a position as near as possible and parallel to the
right-hand edge or curb of the street or roadway, clear of any intersection,
and shall stop and remain in such position until the authorized emergency
vehicle or vehicles shall have passed, unless otherwise directed by
the fire inspector or a police officer.
g.ย
It shall be unlawful for the operator of any vehicle, other than
one on official business, to follow closer than 300 feet from any
fire apparatus traveling in response to a fire alarm, or to drive
any vehicle within the block or immediate area where fire apparatus
has stopped in answer to a fire alarm.
h.ย
A person shall not without proper authorization from the fire inspector
in charge of said fire department emergency equipment, cling to, attach
himself to, climb upon or into, board or swing upon any fire department
emergency vehicle whether the same is in motion or at rest, or sound
the siren, horn, bell or other sound-producing device thereon, or
to manipulate or tamper with, or attempt to manipulate or tamper with
any levers, valves, switches, starting devices, brakes, pumps, or
any equipment or protective clothing, or a part of, any fire department
emergency vehicle.
i.ย
It shall be unlawful for any person to damage or deface, or attempt,
or conspire to damage or deface any fire department emergency vehicle
at any time, or to injure, or attempt to injure or conspire to injure
fire department personnel while performing departmental duties.
j.ย
The driver of any emergency vehicle, as defined in this subsection,
shall not sound the siren thereon or have the front red lights on
or disobey any existing traffic regulation, except when said vehicle
is responding to an emergency call or when responding to, but upon
returning from a fire. Tactical strategies such as, but not restricted
to, "move-ups" do not constitute an emergency call. The driver of
any emergency vehicle may:
1.ย
Park or stand irrespective of the provisions of existing traffic
regulations;
2.ย
Proceed past a red or stop signal or other sign, but only after slowing
down as may be necessary for safe operation;
3.ย
Exceed the prima facie speed limit so long as the action does not
endanger life or property;
4.ย
Disregard regulations governing direction of movement or turning
in specified directions;
5.ย
The exemptions herein granted to an emergency vehicle shall apply
only when the driver of any such vehicle while in motion sounds audible
signal by bell, siren or exhaust whistle as may be reasonably necessary,
and when the vehicle is equipped with at least one lighted lamp displaying
a red light visible under normal atmospheric conditions from a distance
of 500 feet to the front of such vehicle.
k.ย
It shall be unlawful to obscure from view, damage, deface, obstruct
or restrict the access to any fire hydrant or any fire department
connection for the pressurization of fire suppression systems, including
fire hydrants and fire department connections that are located on
public or private streets and access lanes, or on private property.
If upon the expiration of the time mentioned in a notice of
violation, obstructions or encroachments are not removed, the fire
inspector shall proceed to remove the same. Cost incurred in the performance
of necessary work shall be paid from the treasury on certificate of
the fire inspector and with the approval of the borough council; and
the borough shall institute appropriate action for the recovery of
such costs.
l.ย
A person shall not use or operate any fire hydrant intended for use
of the fire department for fire suppression purposes unless such person
first secures a permit for such use from the fire inspector and the
water company having jurisdiction. This subsection shall not apply
to the use of such hydrants by a person employed by, and authorized
to make such use by, the water company having jurisdiction.
m.ย
The fire inspector shall recommend to the council the location or
relocation of new or existing fire hydrants and the placement or replacement
of inadequate water mains located upon public property and deemed
necessary to provide an adequate fire flow and distribution pattern.
A fire hydrant shall not be placed into or removed from service until
approved by the fire inspector.
n.ย
A person shall not obstruct, remove, tamper with or otherwise disturb
any fire hydrant or fire appliance required to be installed or maintained
under the provisions of the Fire Prevention Code except for the purpose
of extinguishing fire, training or testing purposes, recharging, or
making necessary repairs, or when permitted by the fire inspector.
Whenever a fire appliance is removed as herein permitted it shall
be replaced or re-installed as soon as the purpose for which it was
removed has been accomplished. Defective and non-approved fire appliances
or equipment shall be replaced or repaired as directed by the fire
inspector.
o.ย
A person shall not sell, trade, loan or give away any form, type
or kind of fire extinguisher which is not approved by the fire inspector,
or which is not in proper working order, or the contents of which
do not meet the requirements of the fire inspector. The requirements
of this subsection shall not apply to the sale, trade or exchange
of obsolete or damaged equipment for junk when said units are permanently
disfigured or marked with a permanent sign identifying the units as
junk.
p.ย
A person or persons shall not erect, construct, place, or maintain
any bumps, fences, gates, chains, bars, pipes, wood or metal horses
or any other type of obstruction in or on any street within the boundaries
of the borough. The word "street" as used in the ordinance, shall
mean any roadway accessible to the public for vehicular traffic, including,
but not limited to, private streets or access lanes, as well as all
public streets and highways within the boundaries of the borough.
The fees for any permit required under the BOCA Basic Fire Prevention
Code shall be $25, said sum to be paid to the borough Clerk of the
Borough of Pine Hill. In case of any nonprofit corporation, application
shall be made, however, no fee shall be charged.
Pursuant to N.J.S.A. 52:27D-202 the New Jersey Uniform Fire
Code shall be locally enforced in the Borough of Pine Hill.
The local enforcing agency of the Borough of Pine Hill shall
be the Pine Hill Fire District Number One. The subsidiary unit within
the Pine Hill Fire District Number One designated to enforce the minimum
fire safety standards shall be known as "The Pine Hill Fire District
Number One, Bureau of Fire Safety."
The local enforcement agency shall enforce the Uniform Fire
Safety Act and the codes and regulations adopted under it in all buildings,
structures and premises within the established boundaries of the Borough
of Pine Hill, other than owner occupied one and two-family dwellings,
and shall faithfully comply with the requirements of the Uniform Fire
Safety Act and the Uniform Fire Code.
The local enforcing agency shall carry out the periodic inspections
of life hazard uses required by the Uniform Fire Code on behalf of
the Commissioner of community affairs.
The Pine Hill Fire District Number One, Bureau of Fire Safety
shall be under the direct supervision and control of an appointed
"fire official," who shall report directly to the Commissioners of
the Pine Hill Fire District Number One.
The Commissioners of the Pine Hill Fire District Number One
shall be responsible for appointing and removing personnel of the
Pine Hill Fire District Number One, Bureau of Fire Safety.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,
any person aggrieved by any order of the local enforcement agency
shall have the right to appeal to the Construction Board of Appeals
of Camden County.
The permit fee shall be as specified in the Uniform Fire Code.
All ordinances or parts of ordinances which are inconsistent
with the provisions of this section are to the extent of such inconsistency
hereby repealed.
This section shall be effective upon passage and publication
as required by law with enforcement commencing January 1, 1986.
In addition to the inspections and fees for life hazard uses,
the following additional inspections and fees shall be required:
a.ย
The fire official will register all non-life hazard structures and
premises within the Township, except single family and two-family
dwellings occupied by the holder of title to the property and dwelling
units within two family and multifamily dwellings.
b.ย
Inspection fees for non-life hazard structures and premises shall
be:

dwelling units: time of inspection, once every four years.

Includes buildings with dwelling units not listed as high-hazard

monoxide alarm compliance (CSDCMAC) shall be as specified by 5:70-2.9(d)
of the State of New Jersey Uniform Fire Code and this fee section
should be automatically amended to comply with the State of New Jersey
Uniform Fire Code Fees.
e.ย
After two inspections that result in failure an additional $35 will
be charged for the third inspection.
