A. 
It is the policy of the Borough of Garwood to establish a compensation and benefits package that will allow the Borough of Garwood to effectively compete and maintain qualified personnel in its employ and to ensure that salaries and benefits are equitable and commensurate with the duties performed by each employee. To this end, the Mayor of the Borough of Garwood shall have the right, with the concurrence of Council annually, to review and/or adjust salaries and benefits.

The purpose is as follows:

C. 
General purpose. These policies are enacted by the Borough of Garwood in order to further the following goals:
(1) 
To provide a uniform system of personnel administration throughout the Borough service.
(2) 
To ensure that recruitment, selection, placement, promotion, retention, and separation of Borough employees are based upon employees' qualifications and fitness, and comply with federal and state laws.
(3) 
To assist department heads in the development of sound management practices and procedures, and to make effective consistent use of human resources throughout the Borough.
(4) 
To promote communication between management and employees.
(5) 
To ensure, protect and clarify the rights and responsibilities of employees.
D. 
Scope.
(1) 
These personnel policies and procedures shall apply to all Borough employees, except elected officials and independent contractors, provided that in the event of conflict between these rules and any collective bargaining agreement, Police Department rules and regulations, Borough ordinance, or state or federal law, the terms and conditions of that contract, rule, or law shall prevail. In all other cases, these policies and procedures shall apply.
(2) 
In the event of the amendment of any ordinance, rule or law incorporated in this document or upon which these provisions rely, these rules shall be deemed amended in conformance with those changes.
E. 
The Borough specifically reserves the right to repeal, modify, or amend these policies at any time. None of these provisions shall be deemed to create a vested contractual right of any employee nor to limit the power of the Mayor and Council to repeal or modify these rules. The policies are not to be interpreted as promises of specific treatment.
F. 
Regular full-time employees of the Borough of Garwood include all officers and employees whose regular hours of employment are at least 30 hours per week and are full-time hours for the department or agency in which they are employed.
G. 
Regular part-time employees of the Borough of Garwood include all employees whose regular hours of employment are at least 20 hours per week, during normal business hours, and are generally employed in the office of the Borough Administrator/Clerk or Municipal Court and who are not employed full-time at another municipality. All elected and appointed officials, as such, do not qualify for health benefits or other employment benefits except statutorily required pension benefits.

H. 
Administrative employees of this policy are the Borough Administrator, Borough Clerk, Chief Financial Officer and Chief of Police.

I. 
Professional employees of the Borough of Garwood generally include persons appointed in a professional position who hold a particular license or degree.
J. 
Employees of the Borough of Garwood do not include employees of the Board of Trustees of the Free Public Library with regard to benefits contained in this policy, however employees of the Free Public Library are required to comply with standards and regulations contained in this policy.
K. 
School crossing guards are considered ten-month employees and are not considered regular part-time employees concerning benefits in this policy for regular part-time employees, however they are required to comply with standards and regulations contained in this policy. School crossing guards are considered part-time employees.
L. 
Employees of the Recreation Department are not considered regular part-time employees concerning benefits in this policy for regular part-time employees, however they are required to comply with standards and regulations contained in this policy. Recreation Department employees are considered part-time employees.
M. 
Any other part-time employees not specified by description in this section are not considered regular part-time employees concerning benefits in this policy for regular part-time employees; however, they are required to comply with standards and regulations contained in this policy. All other employees are considered part-time employees. All elected and appointed officials, as such, do not qualify for health benefits or other employment benefits except statutorily required pension benefits.

N. 
Temporary, seasonal or employees employed full-time in another municipality or employees who work less than 20 hours per week are not entitled to the benefits of this policy, however they are required to comply with standards and regulations contained in this policy.

A. 
The subject of this section is general employment practices.
B. 
Statement of policy:
(1) 
The Mayor and Council must formally effect the creation of any new position by ordinance and authorize the filling thereof prior to the employment or engagement of a person to serve in any such position.
(2) 
The application for employment form, to be obtained at the office of the Borough Administrator, shall be completed by all persons seeking employment.

(3) 
The Borough Administrator will administer and coordinate the hiring process for certain positions vacancies to ensure compliance with contractual, legal and equal opportunity requirements.

(4) 
The Police Department is responsible for the testing and certification of police officers.
(5) 
Except when statutory requirements direct otherwise, all new employees shall be considered to be on probation for a period of one year, during which time they may be dismissed without recourse.
(6) 
The Borough Administrator or other employee so designated will, for each employee, establish and maintain a personal history file and maintain a complete and accurate record of the attendance, vacations, sick leave, overtime, and other pertinent information.
