This chapter shall be known as the "Electrical Code of the Town of Perinton."
The purpose of this chapter is to regulate the manner in which wiring is installed for electric light, heat, power and signal systems in or on all real property within the Town of Perinton.
All electrical installations referred to in § 108-2 of this chapter shall be made in conformity with the requirements of the New York State Uniform Fire Prevention and Building Code (NYSFPBC) and the National Electrical Code (NEC) as adopted by the National Fire Protection Association. In the event of any conflict between the NYSFPBC and the NEC, the provisions of the NEC shall be recognized as proper compliance with this chapter.
Duly appointed inspectors of the Town of Perinton are hereby authorized to make inspections and reinspections of all electrical installations heretofore and hereafter described and to approve or disapprove the same.

It shall be a violation of this chapter for any person, firm or corporation to install or cause to be installed or to alter or repair electrical wiring for light, heat or power referred to in § 108-2 of this chapter in or on properties in the Town of Perinton until an inspection has been requested with the Building and Codes Department. It shall be a violation of this chapter for a person or firm or corporation to connect or cause to be connected electrical wiring in or on properties for light, heat or power referred to in § 108-2 of this chapter to any source of electrical energy supply prior to an inspection and approval by the Building and Codes Department.
Any person, firm or corporation who shall violate any of the provisions of this chapter or any rule or regulation made pursuant thereto shall be guilty of a violation and shall be punishable pursuant to Chapter 115, Enforcement Procedures. Each day of such violation shall constitute a separate offense and be subject to separate punishment thereof.

A. 
Town inspectors may make inspections and reinspections of all electrical installations referred to in § 108-2 of this chapter and, where an installation is found to be in compliance with this chapter, may approve the inspection (if it is among a number of inspections required for a building project), or issue a certificate of compliance. Such inspections and reinspections shall be at the request and expense of the property owner.
B. 
Town inspectors shall report, in writing, to the Director of Building and Codes of the Town of Perinton all violations of the NYSFPBC and NEC insofar as they relate to electrical inspections in the Town as referred to in § 108-2 of this chapter.
C. 
Such inspectors shall make inspections and reinspections of electrical installations in the Town, as referred to in § 108-2 of this chapter, upon the written request of the Director of Building and Codes or, in the event of an emergency, upon the oral request of the Director of Building and Codes or any other Town official.
D. 
No inspector shall knowingly accept an application for any location or installation that has previously been rejected due to violations by any other inspector.
This chapter shall not be construed to relieve or diminish the responsibility of any person owning, leasing, operating, controlling or installing any electrical installations referred to in § 108-2 of this chapter for loss of life or injury or damage to any person or property caused by any defect or negligence therein, nor shall the Town or any of its agents, servants or employees be deemed to have assumed any such liability for any reason, including any inspection, reinspection or the issuance of any certificates pursuant to this chapter.
The provisions of this chapter shall not apply to the electrical installations in mines, ships, railway cars or automotive equipment or the installations or equipment employed by a railway, electrical or communication utility in the exercise of its function as a utility and located outdoors or in buildings used exclusively for that purpose. This chapter shall not apply to any work involved in the manufacture, assembly, testing or repair of electrical machinery, apparatus, materials and equipment by a person, firm or corporation engaged in electrical manufacturing as its principal business. It shall not apply to any building which is owned or leased in its entirety by the government of the United States or the State of New York.
If any part or provision of this chapter or the application thereof to any person or circumstance be adjudged invalid by any court of competent jurisdiction, such judgment shall be confined in its operation to the part or provision or application directly involved in the controversy in which such judgment shall have been rendered and shall not affect or impair the validity of the remainder of this chapter or the application thereof to other persons or circumstances, and the Town Board of the Town of Perinton hereby declares that it would have passed this chapter or the remainder thereof had such invalid application or invalid provision been apparent.
All ordinances and parts of ordinances inconsistent with this chapter are hereby repealed.
This chapter shall take effect Monday, April 2, 2018. A building permit issued prior to that date will be allowed to have the previously approved third-party electrical inspection agencies perform the required electrical inspections until certificates of occupancy or compliance are issued for the respective permit.
