There is hereby created a Department of Health and Welfare, the head of which shall be the Director. The Director shall be responsible for the overall supervision of the Department and the coordinator of activities undertaken by its personnel.

Within the Department of Health and Welfare there shall be a Division of Health, the head of which shall be the Health Officer. The Division shall have all the functions and powers under Title 26 of New Jersey Statutes Annotated, except that, as required by the Charter, the Borough Council shall have and exercise all local legislative powers under that title.

a. 
The Board of Health created by Ordinance No. 1, September 14, 1950, pursuant to N.J.S.A. 26:3-1 et seq., is abolished. All moneys and other property held by the Board in its name shall be assigned to the Borough pursuant to this chapter.
b. 
A Health Advisory Council is hereby created. It shall consist of five members. The Mayor shall appoint a Chairperson and four regular members to serve at the pleasure of the Mayor and until the appointment and qualification of their successors. The Health Advisory Council shall advise the Mayor and Borough Council on health issues facing the Borough.

Within the Department of Health and Welfare there shall be a Division of Welfare, the head of which shall be the Director of Welfare appointed by the Local Assistance Board, pursuant to N.J.S.A. 44:8-117. The Local Assistance Board established by Ordinance No. 478, March 11, 1980, pursuant to N.J.S.A. 44:8-115, is hereby abolished and recreated.
