All purchases or contracts involving amounts of $30,000 or more shall require legal public notice and sealed bids to be opened by the City Clerk or Assistant City Clerk at the designated place and time as stated in the public notice. Such bids shall then be forwarded to the Mayor and a committee appointed by the Mayor. Said committee shall evaluate the bids and make a recommendation to the entire City Council as to awarding the lowest and best bid.

The City reserves the right to reject any and all bids received for any City purchase or contract. The City Clerk shall notify the bidder or bidders that all bids have been rejected.

Competitive bidding pursuant to the procedure set forth in § 1-1501 shall not be required in the following instances:
1. 
When purchasing unique or noncompetitive items or when purchasing items of a specialized nature that can only be purchased from one sole source vendor. Sole source vendors are isolated in nature and this designation requires verification by the Department Head;
2. 
When purchasing petroleum products;
3. 
When obtaining professional services;
4. 
When obtaining the services of an operator for the operation of a keno, lottery or other legalized gaming for community betterment purposes;
5. 
When contracting for services for refuse collection and removal;
6. 
When obtaining security and public safety services to be provided on a contract basis to supplement normal police, fire and rescue services at public facilities and assemblies;
7. 
Emergency purchases which include a situation which threatens serious loss of life, health or property of the City or situations which require immediate purchase or contracts for the well being of the City, such emergency purchases should be approved by the City Council; or
8. 
When the price has been established by Federal General Services Administration or the Material Division of the Department of Administrative Services or when State/County contract purchases are available.
Nothing contained in this section shall limit the power and authority of the City Council to seek competitive bids either pursuant to § 1-1501 or other bidding procedures.
