The City owns and manages a public Sports and Event Center and
for that purpose there is hereby established the Arena Facilities
Department. The Governing Body, for the purpose of defraying the cost
of the operation, maintenance, improvements and replacement of the
Arena Facilities may, among other sources of revenue, establish a
seat fee and further may each year levy a tax not exceeding the maximum
limit prescribed by State law, on the actual valuation of all real
estate and personal property within the City that is subject to taxation.
The revenue from said seat fee and property tax along with all other
revenue generated by the Arena Facilities shall be known as the Arena
Fund. The Arena Fund shall at all times be in the custody of the City
Treasurer.

There is hereby created the position of Arena General Manager,
who shall have general responsibility for the operation of the Arena
Facilities and who shall report to the Mayor and Governing Body.

In the performance of his duties, the Arena General Manager
shall have the following responsibilities:
1. Publish and make known to the public the rules and regulations governing
the public's and promoter's use of the Facilities.
2. To cause the preparation of an annual financial audit through appropriate
City channels covering program activities and financial status and
deliver the same to the City Council within six months of the end
of the fiscal period.
3. Deposit all moneys received with the City Treasurer to be credited
to the facilities and make all disbursements utilizing the claims
procedures of the City.
4. Expend revenues received consistent with the provisions of any outstanding
bond issues.
5. Utilize the City's Personnel Department and follow the City's policies
and procedures in the personnel administration of all Facilities employees
subject to any outstanding labor contract.
6. Make all purchases of materials, supplies and equipment through the
Purchasing Department of the City and in accordance with City purchasing
policies; provided, however, that the purchases of materials, supplies,
equipment and services acquired for the purpose of conducting or hosting
an event at the Arena Facility shall be purchased by the Events Facilities
Director at his or her discretion, subject to Council review.
7. Prepare and submit a proposed budget for the Arena Facilities Department
to the City Treasurer consistent with the annual budget process of
the City. Budget shall include all proposed expenditures of facility
revenues and municipal funds allotted for the Facilities. The approved
budget will be the working document for administration of the Facilities.
8. To utilize all the available services provided by the City and refrain
from duplicating them.
9. Employ such persons consistent with the City's position classification
and personnel manuals and limited to positions authorized in the budget
as finally approved by the City Council.
10. Employ persons at wages and benefits based on appropriate classifications
and in accordance with the pay plan adopted by the City.
11. Such other and further responsibilities as may be set forth in his
or her contract of employment or as may be assigned by the City Council
from time to time.

In the performance of his duties, the Arena General Manager
shall have the following authority:
1. To advertise the Facilities locally and nationally to maximize use.
2. To lease and schedule events at the Facilities on such terms as the
Arena General Manager determines will maximize revenue to the City.
3. To enter into contracts to promote and copromote events at the Facilities,
including contracts involving the pledge of money and guarantees.
4. To pay the fees of persons and organizations performing at the Facilities.
5. To issue licenses for exclusive use of suites and for personal seat
licenses at the Facilities.
6. To arrange for food and beverage services at the Facilities under
such terms as to maximize revenues to the City.
7. To enter into agreements with off-site ticket sellers to sell and
promote ticket sales at the Facilities.
8. To purchase contracts of insurance as may be required to comply with
requirements of individuals and organizations using the Facilities.
9. Submit bids which may include guarantees and warranties to acquire
conventions and similar events for the Facilities.
10. To enter into contracts with sales representatives for various services
to be performed on behalf of the City for the operation of the Arena
Facilities Department.
11. Such other and further authority as may be set forth in his or her
contract of employment or as may be assigned by the City Council from
time to time.

In the exercise of his responsibilities and authority, the General
Manager shall act in general conformity with the Mission and Vision
Statements of the City.

1. Single Admission Tickets. There shall be imposed upon every single
admission fee for events to be held at or on the grounds of the Ralston
Arena, a seat fee for every single admission ticket sold for any event
held at the Ralston Arena according to the following schedule:

2. Season Tickets, Ticket Books and Group Promotional Tickets:
a. There shall be imposed upon the sale of every season ticket or book
of single admission tickets or special group promotional tickets for
any event held at the Ralston Arena a seat fee according to the following
schedule per single admission for which such season or book of single
admission tickets or special group promotional tickets shall provide:

b. Provided, that in the event any such season ticket or book of single
admission tickets or special group promotional tickets does not guarantee
admission to each game, performance or event for which the ticket,
book, or tickets are sold, the seat fee imposed shall be 5% of the
cost of any such season ticket or book of single admission tickets
or special group promotional tickets rather than the fee set forth
in subsection a.
3. Exemptions. The fee required by this Section shall not apply in the
following circumstances:
a. If there is no charge made to any person for admission to the event;
or
b. If the event is being held pursuant to a lease of the arena which
schedules not less than 30 annual dates of use by the tenant of the
lease.
c. For any event contracted for prior to the effective date of this
Section (adopted September 2, 2014), unless the contract for the event
specifically provides for the payment of the fee.
4. Use of Proceeds. The intent of the imposition of the fee required
by this Section shall be to provide for additional funds for the City
for construction, operations, renovation, or additions to the Ralston
Arena or for purchase and operation of other City-owned or operated
facilities.
5. Authorization. The General Manager of the Ralston Arena is hereby authorized and directed to require the seat fee as specified in subsections
1 and
2 hereof in all leases and events hereinafter negotiated for the use of such facilities.
6. Collection of Fee by Vendor; Liability for Payment; Returns.
a. Every vendor is required at the time of making such a sale or distribution
of any tickets to collect the fee imposed by this Section from the
purchaser or receiver.
b. Every vendor shall add the fee imposed by this Section to the purchase
price, charge or other consideration paid for the taxable privilege
of admission; however, the vendor shall be liable and responsible
to the City for the payment of an amount equivalent to said fees on
each such admission based on his gross taxable sales.
c. The vendor shall prepare and file returns showing fees due hereunder
in such manner and upon such forms as the City Treasurer of the City
may prescribe; provided that returns must be filed and the fees paid
to the City, or its designated agent, upon final financial settlement
of any event, but under no circumstances later than 30 days after
the last day of the event unless the general manager prescribes a
different time.
