The inspection of food service establishments; the issuance, suspension and revocation of permits to operate food service establishments; the prohibiting of the sale of unsound or mislabeled food or drink and the enforcement of this Chapter shall be regulated in accordance with the 1976 Edition of the Food and Drug Administration, the United States Department of Health, Education and Welfare, "Food Service Sanitation Manual" as it may be modified or amended from time to time. The provisions of this Chapter shall apply to all restaurants and itinerant restaurant shall pay to the County a fee or fees for each such establishment in accordance with the fee schedule as set forth by the County Health Department. (Ref. 16-240 RS Neb.)
Three copies of the Food and Drug Administration "Food Service Manual" shall be on file in the office of the City Clerk; and the words "Municipality of" in the manual shall be understood to refer to the City of Ralston, Nebraska. (Ref. 16-240 RS Neb.)

It is unlawful for any person, persons, corporation, or other entity to operate a restaurant in the City who does not possess an unrevoked permit from the County Health Department to operate such restaurant. Such permit shall be posted in a conspicuous place. Only persons who comply with the requirements of this Chapter shall be entitled to receive and retain such a permit. A person conducting an interant restaurant shall also be required to secure a permit.

Such a permit may be temporarily suspended by the Health Officer upon the violation by the holder of any of the terms of this Chapter, or revoked after an opportunity for hearing by the Health Officer upon a serious or repeated violation.

This Chapter shall be enforced by the County Health Department in accordance with the Food Service Sanitation Manual of 1976, as amended and published by the United States Department of Health, Education and Welfare; Provided, further, that should any provision, item or part thereof fail to meet the minimum requirements of State law, the requirements of the State law shall apply only to that provision, item or part thereof so affected.
