Section 101.1 Title. These regulations
shall be known as the Swimming Pool and Spa code of the City of Ralston,
Nebraska, hereinafter referred to as "this code."

Section 105.3 Construction documents. Construction documents, engineering calculations, diagrams and other
such data shall be submitted in two or more sets with each application
for a permit. The code official shall require construction documents,
computations and specifications to be prepared and designed by a registered
design professional where required by state law. Construction documents
shall be drawn to scale and shall be of sufficient clarity to indicate
the location, nature and extent of the work proposed and show in detail
that the work conforms to the provisions of this code. The required
construction documents for both below-ground and above-ground swimming
pools shall include the following information, as well as such other
data as may be reasonably required by the Code Official:

The dimensions of the pool, including its length, width, and
depth.

2.
|
The water capacity of the pool in gallons.
|
3.
|
Diagrams showing the size of all pipes and valves.
|
4.
|
A description of the pool's filter system and capacity.
|
5.
|
A description of the overflow gutters or skimmers.
|
Section 105.6.2 Fees Schedule. The
fees for work shall be as indicated in the following schedule: City
of Ralston Master Fee Schedule.

Section 105.6.3 Fee Refunds.

Not more than 70 percent of the permit fee paid when no work
has been done under a permit issued in accordance with this code.

3.
|
Not more than 90 percent of the plan review fee paid when an
application for a permit for which a plan review fee has been paid
is withdrawn or canceled before any plan review effort has been expended.

Section 105.6.4 Other Permits Required. In addition to swimming pool or spa permit, additional permits may
be required and shall be filed for separately.

Plumbing Permit. Before work is commenced on the construction
of a swimming pool, the appropriate plumbing permit must be secured
from the City.

Electrical Permit. Before work is commenced on the construction
of a swimming pool, the appropriate electrical permit must be secured
from the City.

106.4 Other inspections. In addition
to the inspections specified in Sections 106.2 and 106.3, the code
official is authorized to make or require other inspections of any
construction work to ascertain compliance with the provisions of this
code and other laws that are enforced. No commercial or non-commercial
swimming pool may be opened until the Code Official has inspected
and approved its design and construction, and has been shown evidence
of inspection and certification by the Nebraska State Department of
Health, Division of Environmental Engineering. (Ref. 16-246 RS Neb.)

Section 107.4 Violation Penalties. Any
person who shall violate a provision of this code or shall fail to
comply with any of the requirement thereof or who shall erect, install,
alter or repair a pool or spa in violation of the approved construction
documents or directive of the code official, or of a permit or certificate
issued under the provisions of this code, shall be guilty of a misdemeanor,
punishable by a fine of not more than $100.00 or by imprisonment not
more than 30 days, or both, and in addition shall pay all costs and
expenses involved in the case. Each day such violation continues shall
be considered a separate offense.

Section 107.5 Stop work orders. Upon
notice from the code official, work on any system that is being performed
contrary to the provisions of this code or in a dangerous or unsafe
manner shall immediately cease. Such notice shall be in writing and
shall be given to the owner of the property, or to the owner's authorized
agent, or to the person performing the work. The notice shall state
the conditions under which work is authorized to resume. Where an
emergency exists, the code official shall not be required to give
a written notice prior to stopping the work. Any person who shall
continue any work in or about the structure after having been served
with a stop work order, except such work as that person is directed
to perform to remove a violation or unsafe condition, shall be liable
to a fine of up to four times the regular permit fee.

Section 107.8 Closing of Private Swimming
Pools. The City Building Inspector is authorized to close any
private swimming pool which in his opinion, is in violation of the
provisions of this Article. No person shall use a pool during the
time it is closed. The owner of any private pool which has been closed
may appeal to the Board of Health and have the Board determine the
legality of such closing.

Section 202 Definitions.

SWIMMING POOL. Any above-ground or below-ground
body of water in an artificial or semi-artificial receptacle for other
container, over two feet in depth at any point and having a surface
area exceeding 100 square feet, used or intended to be used for swimming
or bathing. The term includes all structures, equipment and fixtures,
such as filters and pumps, which are appurtenant to and intended for
the operation and maintenance of a swimming pool.

PRIVATE SWIMMING POOL. A swimming pool maintained
for use solely by the owner or lessee and his family, licensees, guests,
permittees and invitees without payment of any fee, which is located
as an accessory structure on the same lot as his residence.

NON-COMMERCIAL SWIMMING POOL. A swimming pool maintained
by a private club or group, not operated for profit, limited to a
specific number of members or residents of a block, subdivision, neighborhood
or community, for the exclusive use of those members or residents
and their guests.

COMMERCIAL SWIMMING POOL. A swimming pool operated
for profit.

Section 323-4 Life Saving Equipment for Private
Swimming Pools. The occupier of land on which a private swimming
pool is located, shall provide in a conspicuous, easily accessible,
and plainly marked location, the following life-saving equipment for
each 1,500 square feet of surface water area or fraction thereof:

A ring-buoy with a minimum outside diameter of 20 inches, secured
to a 1/2 inch diameter rope as long as 1 1/2 times the maximum
width of the pool, or 50 feet, whichever is less.

2.
|
A light, but strong life-pole, with blunt ends, and not less
than 12 feet long.
|
3.
|
A first aid kit.
|
Section 324 Enclosure of Private Pools.

324.1 Height of Walls. Walls of the
pool shall be located at least four feet from any lot line.

324.2 Fencing. Every outdoor private,
residential or family pool shall be completely surrounded by a fence
or wall not less than four feet in height, which shall be so constructed
as not to have openings, holes or gaps larger than four inches in
any dimension except for doors and gates. If a picket fence is erected
or maintained, the horizontal dimension shall not exceed four inches.
A dwelling or accessory building may be used as part of such enclosure.

324.3 Gates. All gates, doors or openings
through such enclosure shall be equipped with a self-closing and self-latching
device for keeping the gate or door securely closed at all times.
This requirement shall be applicable to all new family pools hereafter
constructed, other than indoor pools, and shall apply to all existing
pools which have a minimum depth of 24 inches of water. No person
in possession of land within the City or its jurisdictional limits,
either as owner, purchaser, lessee, tenant or licensee, on which is
situated a family pool having a minimum depth of 24 inches, shall
fail to provide and maintain such fence or wall as provided in this
Section.
