As hereinafter used in this Code, unless the context otherwise
requires, the following terms, phrases, words and their derivation
shall have their meaning given herein (Ref. 9-124, 9-125 RS Neb.):
BINGO
Means a game, whether known as beano, bingo, keno, lotto,
or any other name, in which each participant receives one or more
cards each of which is marked off into 25 squares arranged in five
horizontal rows of five squares each and five vertical rows of five
squares each, with each square being designated by number, letter,
or combination of numbers and letters, no two cards being identical,
with the players covering squares as the operator of such game announces
the number, letter, or combination of numbers and letters appearing
on an object selected by chance, either manually or mechanically,
from a receptacle in which have been placed objects bearing numbers,
letters, or combinations of numbers and letters corresponding to the
system used for designating the squares, with the winner of each game
being the player or players first properly covering a predetermined
and announced pattern of squares on a card being used by him or them.
PERSON
Means any person, partnership, firm, corporation, association,
or other entity.
Games of bingo shall be conducted within the Municipality in
accordance with all laws of the Municipality and the State of Nebraska
if the same game of bingo is played for or involves profit or gain.
Any association duly licensed by the State of Nebraska to conduct
the game of bingo shall obtain a written permit from the Governing
Body before commencing operation of said game. Application shall be
made to the Municipal Clerk for such permit. Said application form
shall contain such information and documents or copies thereof as
the Governing Body deems necessary to determine whether to grant or
reject the application. Upon the determination that granting the application
would be proper, the Governing Body shall immediately direct the Municipal
Clerk to issue the said license to the applicant upon the payment
of an annual permit fee of $10. Said license shall be subject to revocation
at any time for good cause. Any person or persons, so licensed, shall
be subject to any other fees, rules, and regulations which the Governing
Body may designate. All permits so issued will automatically expire
on September 30th, following its issuance or renewal. The fee for
each renewal unless otherwise prescribed shall be in the sum of $10.
Said fee shall be credited to the General Fund. The permit shall be
on display at any place where a game of bingo is conducted. (Ref.

A tax of 2% of the gross receipts of each licensed association
deriving revenue from the game of bingo is hereby imposed and levied
against each such association and payable on or before the 30th day
of the immediately succeeding calendar quarter to the Municipal Treasurer.
Such tax shall be credited to the Municipal General Fund, and shall
be used to pay for the cost of regulation and enforcement of this
article. (Ref. 9-239 RS Neb.)
Each association conducting the game of bingo shall submit a
written quarterly report to the Municipal Clerk covering the preceding
calendar quarter on or before the 30th day of the immediately succeeding
calendar quarter. (Ref. 9-165 RS Neb.)
All applicable State statutes as they now exist or may hereafter
be amended shall be, and will constitute, a part of this article as
if repeated verbatim herein, and violation of any State statute will
be a distinct and separate offense against the Municipality as well
as against the State. Violators thereof shall be separately prosecuted
by the Municipality for each of such offenses, and if convicted, shall
be deemed to be guilty of a misdemeanor. (Ref. 9-124 through 9-176

No person under the age of 18 years shall be permitted to participate
in any bingo came conducted by a licensee. (Ref. 9-124 RS Neb.)
No licensee shall sell, serve, or permit to be consumed any
alcoholic liquor, including beer, in any room or outdoor area where
bingo is conducted during the time that it is being conducted. (Ref.
